HomeMy WebLinkAboutItem 03 - Code AmendmentsITEM # ,� TO: HONORABLE MAYOR AND MEMBERS OF CITY COUNCIL FROM: ROGER NELSON, CITY MANAGER MEETING DATE: MARCH 1, 2005 SUBJECT: ADOPTION OF AMENDMENTS TO CHAPTER 7 OF THE GRAPEVINE CODE OF ORDINANCES, BUILDINGS AND CONSTRUCTION RECOMMENDATION Staff and the Building Board of Appeals recommend City Council approve the adoption of amendments to Chapter 7 of the Grapevine Code of Ordinances, Buildings and Construction, relating to the adoption of the 2003 International Building Code, the 2003 International Residential Code, the 2003 International Mechanical Code, the 2003 International Plumbing Code, the 2003 International Fuel Gas Code, and the 2002 National Electrical Code. BACKGROUND INFORMATION In 2000, the three major code publishing bodies (International Conference of Building Officials, Southern Standard Building Code International, and Building Officials and Code Administrators) ceased to exist, and merged into a single group, the International Code Council. Correspondingly, the codes published by the three former groups were replaced by a single family of codes, the International Codes. The International Codes were developed by committees and membership vote, and combined content from the three former codes. Therefore, much of the wording in the new International Codes is exactly the same as was previously contained in the old Uniform Codes. Even in areas where the wording is not exactly the same, the content is often very similar. In other words, the new International Codes are not radically different from the codes previously adopted by the City. While working on the adoption of the International Codes, staff took the opportunity to propose adoption of the latest electrical code, the 2002 National Electrical Code. Most of the changes to the ordinance were made to mesh old amendments into the language of the new codes. Other changes were made to address the recommendations of the North Central Texas Council of Governments Coordinating Committees (two of which the Building Official has served on for several years). Yet other changes (primarily relating to fire sprinklers) were initiated by the fire department. At it's November 8, 2004 meeting, the Building Board of Appeals reviewed this proposed ordinance and unanimously voted to recommend Council approval. O:SW\Council Agendas\2005\Agenda Memo Ord Amend 3.1.05 February 15, 2005 (3:04PM) Following is an itemized list of what staff feels are the most significant changes in the codes and ordinances: ANALYSIS OF SIGNIFICANT CHANGES Building Code Section 108.2: Schedule of Permit Fees — Staff has incorporated a valuation table based on the one published by the International Code Council in its October, 2004 "Building Safety" periodical. The previous ordinance referenced a similar table in the April, 2002 edition of the now out -of -publication periodical "Building Standards," however, April 2002 was the last edition with a valuation table included. The fees are generally 25%-35% higher than the table that was previously used. Therefore, although the fee schedule is not being modified, the adjustments to the valuation table should translate into increased revenue. Section 108.4, 108.5: Investigation Fees, Reinspection Fees — These sections were added, as there are no provisions for them in the International Codes. These sections have been in the Uniform Codes for years, and have always been an important tool in limiting work without permits and unnecessary inspection requests by contractors. (W Therefore, staff felt it was very important to keep this language in all of the new codes. Section 112: Board of Appeals — Although the International Codes are published by a single entity, they are developed by different committees. Therefore, the building, plumbing, mechanical, etc. codes have inconsistencies in this section. As consistency is critical in the wording for a board that interprets every code, staff has consolidated uniform language and inserted it into the ordinance for each code. Additionally, staff incorporated important language from the previous code "The Board shall have no authority to... make interpretations in the administrative provisions of this code." It is important that functions such as fees and department administration be left to the department head. Section 403.1: Applicability — The local amendment adopted by the City relating to high-rise construction has been changed. Previously, the local amendment required buildings with occupied floors over 48 feet in height or with four or more stories to meet the very restrictive high-rise criteria. The proposed change requires high-rise provisions to be met only in buildings with occupied floors exceeding 55 feet above fire department access, with no limit on number of stories. This change reflects the current North Central Texas Council of Governments recommendations, and is similar to ordinances adopted by most other north Texas municipalities. The amendment is still more restrictive than the code as written, which requires high-rise provisions to be met only when the highest occupied floor exceeds 75 feet in height. O:SW\Council Agendas\2005\Agenda Memo Ord Amend 3.1.05 February 15, 2005 (3:04PM) Table 503: Allowable Height and Building Areas — This table is newly amended to , limit institutional occupancies to noncombustible construction materials. Therefore, buildings housing occupancies such as hospitals and nursing homes will no longer be permitted to be constructed of wood. Section 903: Fire Sprinkler Requirements -- The following are changes in fire sprinkler requirements from previous ordinances: Group Al (Assembly such as theatres) — Requires sprinklers in buildings over 12,000 square feet, regardless of fire separations. This requirement, as proposed, was not in previous codes or ordinances. Group A2 (Assembly such as restaurants) — New code requires sprinklers in all restaurants over 5,000 square feet. Previous ordinances only required them in buildings exceeding 5,000 square feet that could serve alcohol. Group A3, A4 (Assembly such as churches or indoor arenas) — Now requires sprinklers in buildings over 12,000 square feet, not previously required. Group B (Business) — Requires sprinklers in buildings over 12,000 square feet, regardless of fire walls. Previous ordinance only required sprinklers in buildings exceeding 24,000 square feet. Group E (Educational) — Requires sprinklers in buildings exceeding 12,000 square feet. Previous ordinance only required sprinklers if building exceeded 24,000 square feet. Group F (Factory) — Requires sprinklers in all F occupancies over 12,000 square feet. Previous ordinance only required sprinklers if building exceeded 24,000 square feet. Group M (Mercantile) — Requires sprinklers in all buildings that exceed 12,000 square feet. Previous ordinance had the same requirement, but provided an exception for multi -tenant retail occupancies. Group R (Residential) — New code requires all Group R (hotels, motels, apartments) to be sprinklered. This does not apply to single family dwellings, duplexes and townhouses not more than three stories in height, as regulated by the International Residential Code. Previous code required sprinklers in apartments three or more stories in height or with sixteen or more dwelling units. Group S (Storage) — New ordinance requires sprinklers in all S occupancies over 12,000 square feet. Previous ordinance required them only if building exceeded 24,000 square feet. O:SW\Council Agendas\2005Wgenda Memo Ord Amend 3.1.05 February 15, 2005 (3:04PM) (W Section 907.2.10.4: Smoke Detectors — Requires smoke detectors to be installed in dwelling units as required for new structures when alterations or repairs take place requiring permits, and when the installation is structurally feasible. Previous ordinance only required installation as per new buildings when the alteration or repair exceeded $2,500.00. 2002 Electric Code Chapter 7, Article III: This article is revised to reflect recent changes in state law requiring all electricians to be licensed by the state. While it appears that there are many changes to this article, much of the content was simply modified to incorporate those changes in state law, make editorial clarifications, and improve administrative wording. Section 7-92: The sections addressing the Electrical Board were changed to mirror similar sections contained in the other codes. 2003 International Residential Code Chapter 7, Article V: Although not contained in the amendments, there is a fairly significant change in the code itself regarding termite protection. Section R320 (attached) requires new structures to be protected from termite damage. The most common method of doing this is through chemical soil treatment. 2003 International Plumbing Code Chapter 7, Article VIII: Section 605 — Deletes many types of plastic water pipe inside buildings. Staff does not feel that many of these plastic water pipe systems have been in use for an adequate amount of time to confirm their dependability. Cities within the Metroplex have allowed certain plastic water pipe systems on a trial basis, and they encountered many failures and leaks, especially around joints and connections. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS AMENDING CHAPTER 7 OF THE GRAPEVINE CODE OF ORDINANCES, BUILDINGS AND CONSTRUCTION, RELATING TO THE ADOPTION OF THE 2003 INTERNATIONAL BUILDING CODE AS PUBLISHED BY THE INTERNATIONAL CODE COUNCIL, ADOPTION OF THE 2002 NATIONAL ELECTRICAL CODE AS PUBLISHED BY THE NATIONAL FIRE PROTECTION ASSOCIATION, ADOPTION OF THE 2003 INTERNATIONAL RESIDENTIAL CODE AS PUBLISHED BY THE INTERNATIONAL CODE COUNCIL, ADOPTION OF THE 2003 INTERNATIONAL MECHANICAL CODE AS PUBLISHED BY THE INTERNATIONAL CODE COUNCIL, ADOPTION OF THE 2003 INTERNATIONAL PLUMBING CODE AS PUBLISHED BY THE INTERNATIONAL CODE COUNCIL, ADOPTION OF THE 2003 INTERNATIONAL FUEL GAS CODE AS PUBLISHED BY THE INTERNATIONAL CODE COUNCIL, PROVIDING AMENDMENTS TO SAME, REPEALING CONFLICTING ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY, NOT TO EXCEED TWO THOUSAND DOLLARS ($2,000.00) FOR EACH SEPARATE OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED UPON EACH DAY DURING OR ON WHICH A VIOLATION OCCURS; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE. That Chapter 7, Buildings and Construction, Article I, is hereby amended as follows: Section 7-1. Building Code — Adopted is hereby amended to read as follows: "Section 7-1 Building Code — Adopted. There is hereby adopted for the purpose of establishing rules and regulations for the construction, alteration, removal, demolition, equipment, use and occupancy, location and maintenance of buildings and structures that certain building code, known as the Uniform International Building Code, 4994 2003 Edition." {Rest of paragraph unchanged} {Second paragraph unchanged} Section 7-2. Same — Conflict with other regulations is hereby deleted in its entirety and replaced with the following: "Section 7-2. Same — Conflict with other regulations. When any portion of this code conflicts with State Law or any other code or ordinance adopted by the city, the most restrictive requirements shall apply. When any provision in this code conflicts with any other provision in this code the most restrictive requirement shall apply. All references made to electrical provisions shall be replaced with the words "electrical code adopted by the cit)". All references to the International Building Code shall mean the building code adopted by the city. All references to the International Plumbing_ Code shall mean the plumbing code adopted by the city. All references to the International Mechanical Code shall mean the mechanical code adopted by the city. All references to the International Residential Code shall mean the residential code adopted by the city. Section 101.1 Title is hereby amended to read as follows: Section 101.1 Title. These regulations shall be known as the Building Code of the Ci of Grapevine, hereinafter referred to as "this code". Section 101.2 Scope, Exception Number 2, is hereby deleted and replaced as follows: Exceptions: 2. Existing buildings undergoing repair, alterations or additions and chanae of occupancy shall comply with the existin building provisions of the construction codes adopted by the city. Section 101.4.1 Electrical is hereby amended to read as follows: Section 101.4.1 Electrical. The provisions of the lGG CleeW+Ga�� Electrical Code adopted by the City shall apply to the installation of electrical systems, including alterations, repairs, replacement, equipment, appliances, fixtures, fittings and appurtenances thereto. Section 101.4.2 Gas is hereby amended to read as follows: Section 101.4.2 Gas. The provisions of the InteF iatienal Fuel G �Plumbing Code and/or Fuel Gas Code adopted by the City shall apply to the installation of gas piping from the point of delivery, gas appliances and related accessories as covered in this code. These requirements apply to gas piping systems extending from the point of delivery to the inlet connections of appliances and the installation and operation of residential and commercial gas appliances and related accessories. Section 101.4.3 Mechanical is hereby amended to read as follows: 3 OASWCouncil Agendas120041090410RDIBCdraft.doc 02/10/05 J Section 101.4.3 Mechanical. The provisions of the Mechanical Code adopted by the City shall apply to the installation, alterations, repairs and replacement of mechanical systems, including equipment, appliances, fixtures, fittings and/or appurtenances, including ventilating, heating, cooling, air-conditioning and refrigeration systems, incinerators and other energy-related systems. Section 101.4.4 Plumbing is hereby amended to read as follows: Section 101.4.4 Plumbing. The provisions of the Intefflatienal Plumbing Code Plumbing Code adopted by the City shall apply to the installation, alteration, repair and replacement of plumbing systems, including equipment, appliances, fixtures, fittings and appurtenances, and where connected to a water or sewage system and all aspects of a medical gas system. The pFevisions of the InteFnational R*ate Sewage Disposal Go shall apply to private sewage dispesal systems, Section 101. 4.5 Property maintenance is hereby amended to read as follows: Section 101.4.5 Property maintenance. The provisions of the codes and ordinances adopted by the city or State Law if more restrictive, shall apply to existing structures and premises; equipment and facilities; light, ventilation, space heating, sanitation, life and fire safety hazards; responsibilities of owners, operators and occupants; and occupancy of existing premises and structures. Section 101.4.6 Fire prevention is hereby amended to read as follows: Section 101.4.6 Fire prevention. The provisions of the InteMatienal FiFe Gedes Fire Code and ordinances adopted by the City shall apply to matters affecting or relating to structures, processes and premises from the hazard of fire and explosion arising from the storage, handling or use of structures, materials or devices; from conditions hazardous to life, property or public welfare in the occupancy of structures or premises; and from the construction, extension, repair, alternation or removal of fire suppression and alarm systems or fire hazards in the structure or on the premises from occupancy or operation. Section 101.4.7 Energy is hereby amended to read as follows: Section 101.4.7 Energy. The provisions of the internatiena' Energy Gensewati Code adopted and/or enforced by the City, or as required by State Law, whichever is most restrictive shall apply to all matters governing the design and construction of buildings for energy efficiency. Section 102, Applicability is hereby amended to read as follows: Section 102.6 Existing structures. The legal occupancy of any structure existing on the date of adoption of this code shall be permitted to continue without change, except as is specifically covered in this code, other codes adopted by the city, or as is deemed 4 OAS=Council Agendas\2004\0904\ORDIBCdraft.doc 02/10/05 necessary by the building official for the general safety and welfare of the occupants and the public. Section 103, Department of Building Safety is hereby amended to read as follows: Section 103.3 Deputies. In accordance with the prescribed procedures of this jurisdiction and with the concurrence of the appointing authority, the building official shall have the authority to appoint a deputy building official, the related technical officers, inspectors, plan examiners and other employees. Such employees shall have powers as delegated by the building official. Section 105.1 Required is hereby amended to read as follows: Section 105.1 Required. Any owner or authorized agent who intends to construct, enlarge, alter, repair, move, demolish, or change the occupancy of a building or structure, or to erect, install, enlarge, alter, repair, remove, convert or replace any electrical, gas, mechanical or plumbing system, the installation of which is regulated by this code, or to cause any such work to be done, shall first make application to the building official and obtain the required permit. A separate permit for each building or structure_ shall be required Sians are expressly regulated by this code Section 105.1.1 Annual permit is hereby deleted in its entirety. Section 105.1.2 Annual permit records is hereby deleted in its entirety. Section 105.2 Work exempt from permit is hereby amended to read as follows: Section 105.2 Work exempt from permit. Exemptions from permit requirements of this code shall not be deemed to grant authorization for any work to be done in any manner in violation of the provisions of this code or any other laws or ordinances of this jurisdiction. Permits shall not be required for the following: Building: 1. One-story detached accessory structures used as tool and storage sheds, playhouses and similar uses, provided the floor area does not exceed 120 square feet (11.15m2) require permits but are exempt from permit fees 1. Fenees not eveF6 feet (1829 Fnm) high, &2. Oil derricks. 43. Retaining walls which are not over 4 feet (1219 mm) in height measured from the bottom of the footing to the top of the wall, unless supporting a surcharge or impounding Class I, II or III -A liquids. 5-A. Sidewalks and driveway not more than 30 inches (762 mm) above grade and not over any basement or story below and which are not part of an accessible route. 7.6. Prefabricated swimming pools accessory to a Group R-3 occupancy, as applicable in Section 101.2, which are less than 24 inches (610 mm) deep, do not exceed 5,000 gallons (18 925 L) and are installed entirely above ground. 44-.9. Swings and other playground equipment_ 410. Window awnings supported by an exterior wall which do not project more than 54 inches (1372 mm) from the exterior wall and do not require additional support of Group R-3, as applicable in Section 101.2, and Group U occupancies. 443:11. Movable cases, counters and partitions not over 5 feet 9 inches (1753mm) in height. {Remainder of section unchanged) Section 105.3.2 Time limitation of application is hereby deleted and replaced as follows: (W Section 105.3.2 Time limitation of application. Applications for which no permit is issued within 180 days following the date of application shall expire by limitation, and plans and other data submitted for review may thereafter be returned to the applicant or destroyed by the Building Official. The Building Official may extend the time for action by the applicant for a period not exceeding 180 days on request by the applicant showing that circumstances beyond the control of the applicant have prevented action from being taken No application shall be extended more than once. In order to renew action on an application after expiration the applicant shall resubmit plans and pay a new plan review fee. Section 105.5 Expiration is hereby deleted and replaced with the following: Section 105.5 Expiration. Every permit issued by the building official under the provisions of this code shall expire by limitation and become null and void if the building or work authorized by such permit is not commenced and an inspection requested within 180 days from the date of such permit, or if the building or work authorized by such permit is suspended or abandoned at any time after the work is commenced for a period of 180 days or if more than 180 days pass between any two inspections of the building or work including the final inspection Inspections requested and/or performed on work which is not complete shall not constitute an inspection for the purposes of this section In the event of an expired permit before such work can be recommenced, and/or inspections requested a new permit shall be first obtained to do so, and the fee therefor shall be one-half the amount required for a new permit for such work, provided 6 WS\MCouncil Agendas\2004\0904\O RDIBCdraft. doc 02/10/05 no changes have been made or will be made in the original plans and specifications for such work and provided further that not more than 30 days has passed since the permit expired. In order to renew action on a permit more than 30 days after expirat permittee shall pay a new full ion the permit fee The building official shall have the sole discretion, except as otherwise provided herein to extend permits and inspection deadlines for projects of an unusually large scope Any building or work subject to a permit _which has expired for a period of more than 30 days shall be declared a nuisance in accordance with Cha ter 7 Article II and/or Chapter 12 Article VI of the Grapevine Code of Ordinances Any permittee holding an unexpired permit may apply for an extension of the time within which work may commence under that permit when the permittee is unable to commence work within the time required by this section for -good and satisfacto reasons. The building official mayextend the time for action by the permittee for a period not exceeding 180 days on written request by the permittee showing that circumstances beyond the control of the permittee have prevented action from being taken. No permit shall be extended nor renewed more than once Section 108.2 Schedule of permit fees is hereby amended to read as follows: Section 108.2 Schedule of permit fees. For any work On buildings st requiring a permit under the International Building Code, a fee for each permit shall be paid as required, in accordance with Table 1A. Building Permit Fees attached hereto as Exhibit "A" Permit fees for work covered by other adopted codes and ordinances are described elsewhere in this gha ter. For new buildings and additions the building valuations shall be determined by the Building Valuation Data Table attached hereto as Exhibit "B" or the contract valuation whichever is greater. For interior alterations and remodels the building valuation shall be determined by the contract valuation. In all cases it shall be the responsibility of the permit app licant to provide a copy of the construction contract includ ng the total ro'ect cost to the Building Official upon re nest. Section 108.4 Work commencing before permit issuance is hereby deleted in its entirety and replaced with the following: Section 108.4. Investigation Fees work without permit Whenever any work for which a permit is required by this code has been commenced without first obtaining said permit, a special investigation shall be made before a permit may be issued for such work. An investigation fee in addition to the permit fee shall be collected whether or OASW Council Agendas\2004\0904\ORDIBCdraft.doc 02/10/05 not a permit is then or subsequently issued. The investigation fee shall be equal to the amount of the permit fee required by this code. The minimum investigation fee shall be the same as the minimum permit fee set forth in the fee schedule adopted by the City. The payment of such investigation fee shall not exempt any person from compliance with all other provisions of this code nor from any penalty prescribed by law. Section 108.5 Related fees is hereby renumbered 108.8, and a new Section 108.5, Reinspection fee, is added to read as follows: Section 108.5 Reinspection fee. A reinspection fee may be assessed for each inspection or reinspection when such portion of work for which inspection is called is not complete or when corrections called for are not made. This subsection is not to be interpreted as requiring reinspection fees the first time a job is rejected for failure to comply with the requirements of this code, but as controlling the practice of calling for inspections before the job is ready for such inspection or reinspection. Reinspection fees may be assessed when the inspection record card is not posted or otherwise available on the work site, the approved plans are not readily available to the inspector, for failure to provide access on the date for which inspection is requested, or for deviating from plans requiring the approval of the building official. To obtain a reinspection, the applicant shall file an application therefor in writing on a form furnished for that purpose and pay the reinspection fee in accordance with Table 1-A or as set forth in the fee schedule adopted by the jurisdiction. In instances where reinspection fees have been assessed, no additional inspection of the work will be performed until the required fees have been paid. Section 108.6 Refunds is hereby renumbered 108.9 and a new section 108.6, Plan Review Fees is added to read as follows: Section 108.6. Plan Review Fees. When submittal documents are required by Section 106.3.2, a plan review fee shall be paid at the time of submitting the submittal documents for plan review. Said plan review fee shall be 65 percent of the building permit fee as shown on Table 1-A. The plan review fees specified in this subsection are separate fees from the permit fees specified in Section 107.2 and are in addition to the permit fees. When submittal documents are incomplete or changed so as to require additional plan review or when the proiect involves deferred submittal items as defined in Section 106.3.4.2, an additional plan review fee shall be charged at the rate shown in Table 1-A. Section 108.3 108.8 Related fees. The payment of the fee for the construction, alteration, removal or demolition for work done in connection to or concurrently with the work authorized by a building permit shall not relieve the applicant or holder of the permit from the payment of other fees that are prescribed by law. Section 108.9 Refunds is hereby amended to read as follows: Section 49&6 108.9 Refunds. y The building official may authorize refunding of any fee paid hereunder which was erroneously paid or collected. The building official may authorize refunding of not more than 80 percent of the permit fee gaid when no work has been done under a permit issued in accordance with this code. The building official may authorize refunding of not more than 80 percent of the plan review fee paid when an apglication for a permit for which a plan review fee has been paid is withdrawn or canceled before any plan review is performed The building official shall not authorize refunding of any fee paid except on written application filed by the original permittee not later than 180 days after the date of fee payment. The codes, when speeifieall adopted, and standards referenced in this code shall be considered part of the requirements of this code to the prescribed extent of each such reference. Whenever amendments have been adopted to the referenced codes and standards, each reference to said code and standard shall be considered to reference the amendments as well. Any reference made to NFPA 70 or the ICC Electrical Code or any other reference to electrical provisions shall mean the Electrical Code and its amendments as adopted. Where differences occur between provisions of this code and referenced codes and standards, the provisions of this code shall apply, Section R105.5 Expiration is hereby amended to read as follows: Section R105,5 Expiration. Every permit issued by the building official under the provisions of this code shall expire by limitation and become null and void if the building or work authorized by such permit is not commenced and an inspection requested within 180 days from the date of such permit, or if the building or work authorized by such permit is suspended or abandoned at any time after the work is commenced for a period of 180 days or if more than 180 days pass between any two inspections of the building or work, including the final inspection. Inspections requested and/or performed on work which., is not complete shall not constitute an inspection for the purposes of this section. In the event of an expired permit, before such work can be recommenced, and/or inspections requested, a new permit shall be first obtained to do so, and the fee therefor shall be one-half the amount required for a new permit for such work, provided no changes have been made or will be made in the original plans and specifications for such work; and provided further that such suspension or abandonment has not exceeded 30 days. In order to renew action on a permit more than 30 days after 37 OASW\Council Agendas\2004k0904\ORDIBCdraft,doc 02/10/05 expiration, the permittee shall pay a new full permit fee. The building official shall have the sole discretion, except as otherwise provided herein, to extend permits and inspection deadlines for projects of an unusually large scope. Any building or work subject to a permit which has expired for a period of more than 30 days shall be declared a nuisance in accordance with Chapter 7, Article 11, and/or Chapter 12, Article VI of the Grapevine Code of Ordinances. Any permittee holding an unexpired permit may apply for an extension of the time within which work may commence under that permit when the permittee is unable to commence work within the time required by this section for good and satisfactory reasons. The building official may extend the time for action by the permittee for a period not exceeding 180 days on written request by the permittee showing that circumstances beyond the control of the permittee have prevented action from being taken. No permit shall be extended nor renewed more than once. Section R106 Construction Documents is hereby amended by the addition of a new Subsection R106.6 to read as follows: Section R106.6 Expiration of Plan Review. Applications for which no permit is issued within 180 days following the date of application shall expire by limitation and plans and other data submitted for review may thereafter be returned to the applicant or destroyed by the building official The building official may extend the time for action by the applicant for a period not exceeding 180 days on request by the applicant showing -that circumstances beyond the control of the applicant have prevented action from being taken. No application shall be extended more than once. In order to renew action on an application after expiration the applicant shall resubmit plans and pay a new plan review fee.
