Staff recommends the Planning and Zoning Commission and the City Council accept the
applicant's request to withdraw Tree Removal Request TR05-01 and the final plat of Silver
Lake Estates, Phase 3 and take any other action necessary.
BACKGROUND INFORMATION:
The applicant, Mr. Martin Schelling of Wright Development, has requested to withdraw both
the tree removal request and the final plat associated with Phase 3, of Silver Lake Estates.
See the attached letters.

RECOMMENDATION:
Staff recommends the City Council consider the applicant's request relative to tree removal
and mitigation for an approximate seven acre tract of land proposed to be platted as Lots
1-5 and Lots 7-29, Block 5, Silver Lake Estates, Phase III, and take any action necessary.
BACKGROUND INFORMATION:
Section 52, Tree Preservation allows the City Council to consider a tree preservation plan
in special circumstances in connection with a zone change request or a conditional/special
use request or in conjunction with a plat on the subject property. In conjunction with the
final plat for Silver Lake Estates, Phase III, the applicant is seeking authorization to remove
trees where necessary within an approximate seven acre area which is proposed to be
platted as Lots 1-5 and Lots 7-29, Block 5, Silver Lake Estates, Phase III. Along with being
densely wooded, the subject area has some extreme topography with some areas having
up to 30 -feet of elevation change between lots. Approximately 26,000 cubic yards of soil
will need to be excavated during the construction phase of the subdivision. Allowing the
trees to be removed where necessary and allowing the excavation to proceed during the
construction phase will minimize damage to the street and minimize any problems
associated with drainage. To mitigate those trees removed the applicant proposes to plant
150 trees from the City's approved tree list that will be a minimum three caliper inches in
diameter which will be planted during the home construction phase of the project. See the
attached letter.

Dear Mr. Stombaugh:
Attached please find a Tree Removal Permit Application for the proposed Silver Lake Estates, Phase 3
subdivision. This proposed development will be the final phase of the Silver Lake community.
The topography of the phase is the driving factor for the tree removal request. From east to west across
two lots there is an extreme drop in elevation. In the worst case the land drops approximately 30 feet
from rear lot line to rear lot line.
The approval of the tree removal request will allow us to prepare the lot building pads on the east side of
Spring Creek Drive during the construction of the subdivision. From a practical view point this is the
only feasible way to construct the community. The project will require 26,000 cubic yards of dirt to be
excavated. Performing the excavation during the subdivision construction phase will minimize drainage
problems, damage to a new street and protect the integrity of the public improvements. The lot pads on
the west side of Spring Creek Drive will be constructed by the builder at the time building permits are
issued.
The Silver Lake project contains a total of 115 acres and approximately 40 acres of the project will
remain undeveloped. The tree removal request area contains approximately 7 acres and is shown on the
aerial included with the application. As with all of our developments, we will only remove the trees
necessary to adequately complete our improvements.
We propose to plant a total of 150 trees in this phase of Silver Lake with a minimum caliper size of 3
inches. The trees will be planted during the home construction phase and the varieties will be from the
City's approved tree list.

Trees proposed to be replaced and include a legend indicating the species, caliper
size and height of proposed tree replacement. Replacement trees shall be
designated by a square. The legend shall also be submitted on an 8.5" x 11" sheet
of paper.
(a) No replacement tree may be planted within a visibility triangle, a water
course, or an existing or proposed street or alley.
(b) A replacement tree must have a minimum caliper of at least three (3) inches
when measured at six (6) inches above ground level.
(c) A replacement tree that dies within two years of the date it was planted must
be replaced by another replacement tree that complies with the Tree
Preservation Permit.
14. Tree Protection Plan: The plan shall describe how existing healthy Protected Trees
proposed to be retained will be protected from damage during construction.
