STREET RIGHT OF WAY ABANDONMENT — ANDERSON
GIBSON ROAD
City Council consider adopting an ordinance abandoning street right of way on the north
end of Anderson Gibson Road at its intersection with Grapevine Mills Circle West,
authorizing the City Manager to execute a Quit Claim Deed to the abutting property
owner, and take any necessary action.
BACKGROUND:
The original property owner abutting the west side of Grapevine Mills dedicated street
right of way to connect the old section of Anderson Gibson Road with the new alignment
of Grapevine Mills Circle West. This property to date has not been developed.
The current owner is proposing to develop the abutting property and has requested that
the right of way be abandoned by the City. The final plat of the proposed development
is being considered in the April 19, 2005 Joint City Council and Planning and Zoning
Commission meeting.
The right of way will be retained as an access, drainage and utility easement to insure
continued access from the north end of the old Anderson Gibson Road to Grapevine
Mills Circle.
Staff recommends approval.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS, ABANDONING AND VACATING A
SEGMENT OF ANDERSON GIBSON ROAD RIGHT OF WAY
IN THE CITY OF GRAPEVINE, TEXAS AS HEREINAFTER
DESCRIBED; DECLARING EMERGENCY AND PROVIDING
AN EFFECTIVE DATE
WHEREAS, the property owner abutting the west side of Grapevine Mills Circle
West has requested that a 0.516 acre parcel of right of way of Anderson Gibson Road as
herein after described be abandoned and vacated; and
WHEREAS, the subject right of way was originally dedicated by the previous owner
of the property abutting the west side of Grapevine Mills Circle West; and
WHEREAS, the right of way is not needed for public use and will not be needed in
the future for public use; and
WHEREAS, abandoning and vacating the said right of way will relieve the City of
Grapevine, Texas from the cost and expense of maintaining said property.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1. That all matters stated in the preamble of this ordinance are true and
correct and are hereby incorporated into the body of this ordinance as if copied in their
entirety.
Section 2. That the public street right of way for Anderson Gibson Road
described in Exhibit "A", attached hereto and incorporated herein for all purposes, is hereby
abandoned and vacated for public use and the same is hereby abandoned and vacated
insofar as all public right, title, interest in and to said right of way is concerned, subject to
the retention by the City of said right of way as a public access, drainage and utility
easement.
Section 3. That the terms and provisions of this ordinance shall be deemed to be
severable, and that if the validity of any section, subsection, word, sentence or phrase shall
be held to be invalid, it shall not affect the remaining part of this ordinance.
Section 4. The fact that the right of way is no longer needed by the public for
public usage and would create a hardship or burden upon the City of Grapevine to keep
open and maintain such access easement creates an urgency and an emergency for the
immediate preservation of the public health, safety, and general welfare which requires that
this ordinance shall take effect immediately from and after its passage and it is accordingly
so ordained.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS on this the 19th day of April, 2005.

PROPERTY DESCRIPTION
BEING a tract of land situated in the Henry Suggs Survey, Abstract No. 1415, City of
Grapevine, Tarrant County, Texas, and being all of that tract known as "Tract C" as
conveyed to the City of Grapevine, Texas, by Street Right of Way Grant recorded in Volume
12429, Page 2322, Deed Records, Tarrant County, Texas, and being more particularly
described as follows:
BEGINNING at a 1/2" iron rod found for corner at the southeast corner of Tract 1, as
conveyed to Grapevine Multi—Family Land, L.P., by deed recorded in Volume 13225, Page
505, Deed Records, Tarrant County, Texas, and the southwest corner of the said street
right of way tract;
THENCE N 00'07'10" E, along the common line of said tracts, a distance of 336.08 feet to
a 5/8" iron rod set with cap stamped "BDD" (hereafter called "capped iron rod set") for
corner at the beginning of a curve to the right which has a central angle of 110'15'17", a
radius of 124.74 feet and a chord which bears N 55"14'58" E, 204.68 feet;
THENCE continuing along said common line and with said curve to the right, an arc
distance of 240.04 feet to a capped iron rod set for corner at the beginning of a curve
to the left which has a central angle of 81'4329", a radius of 20.00 feet and a chord
which bears N 69'31'05" E, 26.17 feet;
THENCE continuing along said common line, an arc distance of 28.53 feet to a capped
iron rod set for corner in the present west line of Grapevine Mills North Boulevard (a
variable width R.O.W.);
THENCE S 28'39'21" W, along said west line, a distance of 92.61 feet to a capped iron rod
set for corner at the beginning of a curve to the left which has a central angle of
11222'41", a radius of 20.00 feet and a chord which bears N 2731'59" W, 33.24.feet;
THENCE continuing along said west line and with said curve to the left, an arc distance of
39.23 feet to a copped iron rod set for corner at the beginning of a curve to the left
which has a central angle of 96'0921", a radius of 74.74 feet and a chord which bears S
48'12'00" W, 111.22 feet;
THENCE continuing along said west line and with said curve to the left, an arc distance of
125.43 feet to a capped iron rod set for comer,
THENCE S 00'07'10" W, continuing along said west line, a distance of 146.41 feet to a
capped iron rod set for corner at the beginning of a curve to the left which has a central
angle of 17'37'17", a radius of 634.00 feet and a chord which bears S 1233'31" W, 194.22
feet;
THENCE continuing along said west line and with said curve to the left, an arc distance of
194.99 feet to a a copped iron rod set for corner,
THENCE N 8958'41" W, continuing along said west line, a distance of 6.16 feet to the
