HomeMy WebLinkAboutItem 08 - Speed Limit ChangesMEMO TO FROM: MEETING DATE: SUBJECT RECOMMENDATION: !-' rIt :.:,..�,�_ m . � � HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL BRUNO IZUMBELOW, ACTING CITY MANAGER b, JULY 05, 2005 SPEED LIMIT CHANGES City Council consider adopting an Ordinance amending Section 23-26, Speed Limits - Schedule for Certain Public Streets and Ways, of the City Code of Ordinances to remove conflicting or outdated speed limits on specific streets, set new speed limits on other streets and remove portions of the code pertaining to streets that no longer exist. BACKGROUND: Section 23-26 references streets that no longer exist, streets with conflicting speed limits and other inconsistencies. Section 23-26 is being revised to address these items. Streets for which new speed limits are needed. • Northwest Highway from Grapevine-Southlake city limits to 950 feet west of Ruth Wall Street - the current posted speed limit (40 mph) does not match the speed limits in the code (45 mph from Grapevine-Southlake city limits to Lucas Street; 35 mph from Lucas Street to Boyd Street and 45 mph from Boyd Street to Ruth Wall Street). A new speed limit survey was conducted, and based on this survey, a 40 mph speed limit is recommended on the section between the Grapevine-Southlake city limits and Dooley Street and a 45 mph speed limit between Dooley Street and 950 feet west of Ruth Wall Street. East of this section, the speed limit is already set at 45 mph. • Park Boulevard - this street has two conflicting speed limits over the same section, one for 35 mph and one for 45 mph. There is no speed limit survey to support either one of these speed limits. The posted speed limit is 35 mph. A new speed survey indicates an 85th percentile speed of 40 mph. Therefore, a 40 mph speed limit is recommended. Streets for which the speed limit should be changed. • SH 114 (from Grapevine-Southlake City limits to Grapevine -Irving City limits): TXDOT recently conducted a new speed survey and is recommending a 60 mph to replace this section which currently has a speed limit of 55 mph. 0:\agenda\2005\6-21-05\Speed Limit Changes June 29, 2005 (10:46AM) Streets for which Section 23-26 needs to be modified for clarification. • Anderson Gibson Road: Has three separate segments (old and new segments) in the code with the same speed limit of 25 mph. The code will be rewritten to indicate that the entire section of Anderson Gibson Road will have a speed limit of 25 mph. • Bethel Road between State Highway 26 and Coppell city limits: The street name needs to be changed to Bass Pro Drive to reflect the correct street name. • Dallas Road from William D. Tate Avenue to Loop 382: The reference to "Loop 382" should be removed and replaced with "Texan Trail." • Hall -Johnson Road: The code references two street sections (one from Pool Road to Parr Road and one from Parr Road to State Highway 121) that both have the same speed limit of 35 mph. The code will be rewritten to indicate that the entire section between Pool Road and State Highway 121 has a speed limit of 35 mph. • Parr Road: The code references a 20 mph speed limit for a section of Parr Road that runs east -west (from the intersection of Parr Lane and Parr Road to the east terminus of the street). This street is not actually Parr Road but Parr Lane. The ordinance will be modified to make this change. • Spur 103, Control 363-4: The limits for this street make reference to State Highway 121, which is now, Hudgins Street. The code will be changed to reflect the correct street name. • Spur 382 (Northwest Highway): This refers to the east -west portion of Northwest Highway between Grapevine/Southlake City limits and Ruth Wall Street and the north -south portion of Northwest Highway between Ruth Wall Street and State Highway 114 (Business 114/ Texan Trail). The east -west portion will be replaced with a newer speed limit based on the speed survey and can be removed from this section of the code. There are also references to school zones that need to be deleted since there are no school zones on Northwest Highway. In addition, references to Loop 382 will be deleted and replaced with Business 114L. Streets for which Section 23-26 contains conflicting speed limits. • Dove Road between Cimarron Trail and Park Boulevard: there are two speed.. limits in the code for the same street section — an outdated 30 mph speed limit and the current 35 mph speed limit. The 30 mph speed limit will be removed. • Loop 382, Control 353-7: this is the portion of Northwest Highway between Grapevine-Southlake city limits and State Highway 114. This is an outdated speed limit and will be removed from the code. 0:\agenda\2005\6-21-05\Speed Limit Changes June 29, 2005 (10:46AM) Mustang Drive from State Highway 121 frontage road to South Main Street: there are two speed limits in the code for the same street section- an outdated 35 mph speed limit and the current 45 mph speed limit. The 35 mph speed limit will be removed. William D. Tate Avenue (SH 121 Service Roads) from Glade Road to 500 feet north of Mustang Drive: The section of William D. Tate Avenue between Glade Road and Mustang Road has been replaced with a newer speed limit of 50 mph. The older speed limit of 40 mph speed limit will be removed. The street section between Mustang Drive and State Highway 114 (approximately 1,000 feet long) will still have a 40 mph speed limit. Streets to be removed from Section 23-26. 1. FM 157 - street no longer exists 2. Fairway Detour - detour no longer exists 3. School Access Road - possibly refers to a temporary access road from Pool Road to cross timbers middle school that no longer exists. 4. SH 114 control section 353-03 - this is a short section of SH 114 from Grapevine- Southlake city limits to the 114/121 merge. This is an outdated speed survey and will be replaced by the new TXDOT speed survey. 5. SH 121 Control 743-3 (Conpection B) - the street no longer exists, 6. State Highway 26, Control Section 364-6, Tarrant County — this is a short section of Northwest Highway from 950 feet west of Ruth Wall Street to Ruth Wall Street. This stretch of roadway is no longer called State Highway 26. Since this street section also has a speed limit of 45 mph, it will be combined with the speed limit for the section of Northwest Highway between Dooley Street and 950 west of Ruth Wall Street. 0:\agenda\2005\6-21-05\Speed Limit Changes June 29, 2005 (10:46AM) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS AMENDING THE GRAPEVINE CODE OF ORDINANCES, CHAPTER 23 TRAFFIC, SECTION 23-26 SCHEDULES FOR CERTAIN PUBLIC STREETS AND WAYS, ALTERING THE PRIMA FACIE SPEED LIMITS ESTABLISHED FOR VEHICLES UNDER THE PROVISIONS OF SECTIONS 167 AND 169 OF ARTICLE XIX, R.C.S. 6701 d, UNIFORM ACT REGULATING TRAFFIC ON HIGHWAYS, UPON THE BASIS OF AN ENGINEERING AND TRAFFIC INVESTIGATION UPON CERTAIN STREETS AND HIGHWAYS, OR PARTS THEREOF, WITHIN THE CORPORATE LIMITS OF THE CITY OF GRAPEVINE AS SET OUT IN THE ORDINANCE; AUTHORIZING THE ERECTION OF TRAFFIC REGULATION SIGNS; REPEALING CONFLICTING ORDINANCES; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF FIVE HUNDRED DOLLARS ($500.00) FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH AN OFFENSE OCCURS OR CONTINUES; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, Sections 167 and 169 of Article XIX, R.C.S. 6701 d, Uniform Act Regulating Traffic on Highways, provide that whenever the governing body of the City shall determine upon the basis of an engineering and traffic investigation that any prima facie speed therein set forth is greater or less than is reasonable or safe under the conditions found to exist at any intersection or other place or upon any part of a street or highway, with the City taking into consideration the width and condition of the pavement and other circumstances on such portion of said street or highway, as well as the usual traffic thereon, said governing body may determine and declare a reasonable and safe prima facie speed limit thereat or thereon by the passage of an ordinance, which shall be effective when appropriate signs giving notice thereof are erected at such intersection or other place or part of the street or highway. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That Chapter 23 Traffic, Section 23-26 Schedule for Certain Public Streets and Ways of the Grapevine Code of Ordinances is hereby amended upon the basis of an engineering and traffic investigation heretofore made as authorized by the provisions of Sections 167 and 169 of Article XIX, R.C.S. 6701d, Uniform Act. Section 2. That Section 23-26 is hereby amended by deleting the following sections: "Bethel Road' "FM 157, control 747-3" "Fairway Drive detour" "Loop 382, Control 353-T' "Mustang Drive: (c) from State Highway 121 frontage road to South Main Street...35" "Parr Road' "School Access Road' "SH 114, Control Section 353-03" "SH 121, Control 743-3 (Connection B)" "Spur 382 (Northwest Highway)" "State Highway 26, Control Section 364-6, Tarrant County' Section 3. That Section 23-26 is hereby amended by the addition of the following sections: "Bass Pro Drive, between State Highway 26 and the Coppell City Limits ... 40" "Northwest Highway (Business 114) (a) from Grapevine-Southlake City limits to Dooley Street, both directions... 40 (b) from Dooley Street to Ruth Wall Street, both directions... 45" "Parr Lane, from the intersection of Parr Road and Parr Lane east to the east terminus of Parr Lane ... 20" ORD. That the City Manager, or his agent, is hereby authorized to have the proper traffic signs erected, constructed, and placed at such points along said highways, streets or alleys, or portions thereof under construction, maintenance, or repair, so that travelers will be reasonably notified of said traffic regulations. Section 6. That all ordinances or any parts thereof in conflict with the terms of this ordinance shall be and hereby are deemed repealed and of no force or effect provided, however, that the ordinance or ordinances under which the cases currently filed and pending in the Municipal Court of the City of Grapevine, Texas shall be deemed repealed only when all such cases filed and pending under such ordinance or ordinances have been disposed of by a final conviction or a finding of not guilty, nolo contendere, or dismissal. Section 7. That any person, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction in the Municipal Court, shall be fined in an amount not to exceed the sum of Five Hundred Dollars ($500.00) for each offense and a separate offense shall be deemed committed each day during or on which an offense occurs or continues. Section 8. If any section, article, paragraph, sentence, clause, phrase or word in the ordinance, or application thereto any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of this ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 9. The fact that the present ordinances and regulations of the City of Grapevine, Texas do not adequately regulate the traffic within the City creates an emergency and the preservation of the public health, safety, and welfare requires that this ordinance take effect immediately from and after the date of its passage.
