On November 13, 2006, the Building Board of Appeals held a public hearing regarding referenced property. At this hearing, it was determined that this is a dangerous building. Pursuant to Section 7-25 of the City of Grapevine Code of Ordinances, the Board determined that this building shall be repaired or demolished within thirty (30) days from the date of the hearing. A permit must be secured from the Building Inspection Department for the work. If action has not been taken within thirty (30) days of receipt of this letter, this case will again be brought before the Board for further consideration. At this time staff will request the Building Board of Appeals to forward a request for demolition to the office of the City Attorney. The owners of this single family structure are Jennie Marie Johnson, Mary Lee Jessie, Harriet Hoskins and Otis T. Shelton. Code Enforcement first notified the property owner and all possible interested parties on September 19, 2006. Since that time no action has been taken. The structure itself is dilapidated and uninhabitable. It has no water or electric service. It is inadequately weather protected, and is structurally unsound. A copy of the Notice of Violation is attached. Should the Board order that the property be repaired or demolished, the owner must comply with said order within thirty (30) days. If action is not taken within this thirty (30) day period, the Board shall report the act of noncompliance to the City Attorney, so that an action for injunction may be filed in district court. Following such action, the city will hire a contractor to demolish the structure, and place a lien on the property to cover the cost of demolition and all associated administrative fees. The request was to Grapevine Code of Ordinances, Chapter 7, Article IV, Fences: Section 7-127, Fences, Front Yard Requirements, requires fences constructed in a required or established front yard to be 36 inches or less in height, and of at least 50 percent through vision. Scott Williams explained that Staff recommended the Building Board of Appeals approve the applicant's request to construct an eight -foot (8') vinyl coated chain link fence that exceeded 36 inches in height, with more than 50 percent through vision, in the established front yard. Mr. Williams stated that Staff found a special condition for this request, while this fence was in fact in the established front yard, the building was set back approximately 200 - feet from the front property line; far more than the 30 -feet required. Additionally, the fence itself would be setback 80 -feet from the front property line, at the closest point. With no further questions for Mr. Williams, Mr. Daniel Johnson, representing International Airport Centers took the Oath of Truth and requested favorable consideration of his request and offered to answer any questions of the Board. Scott Williams explained that Staff recommended the Building Board of Appeals determine the property to be a dangerous building pursuant to Chapter 7, Article ll, of the Grapevine Code of Ordinances and recommended the Board to require the property to be repaired or demolished. 2 Building Board of Appeals 11/13/06 Mr. Williams explained that all property owners within 200 feet as well as the owners of the property were notified according to tax records. Mr. Williams further explained that the owner would have thirty (30) days from the action of the Board, and if the work was not completed within the thirty (30) day period, the Board could report the act of noncompliance to the City Attorney for an injunction to be filed in district court. Following such action, the city would hire a contractor to demolish the structure, and place a lien on the property to cover cost of demolition and associated administrative fees. Mr. Williams stated that the structure was dilapidated and uninhabitable. It had no water or electric service. It was inadequately weather protected, was structurally unsound and unsanitary. Code Enforcement Officers had on numerous occasions, observed an occupant present, who was apparently residing in the structure in violation of the posted order to vacate. Joe Lipscomb asked Mr. Williams if staff had any other contact with the property owners other than by mail. Mr. Williams stated that staff had discussions with the occupant of the residence, however in accordance with city ordinance staff had mailed out certified letters to property owners listed on the last approved tax rolls per advise of City Attorney. With no further questions for Mr. Williams, Ms. Marie Moore, stated that all property owners were deceased, she explained that the property had belonged to her grand mother and all of her children were deceased. The property now belonged to many grandchildren; she stated that one of those grandchildren currently lived in the residence. She further explained that he had no job, nor finances to improve the property. She expressed concern that if he were evicted from the residence he would have no place to go. Joe Lipscomb explained to her that if the Board found the property to be a Dangerous Building they would have the option to demolish or repair it. He asked if the other grandchildren had given the property over to him, she stated no, that he just lived there. Michael Shupp asked what type of support he would have from his family to either help him bring the house up to a level that was acceptable or someplace for him to live if the house were demolished. She stated none, which was why he lived there. Jerrold Sklar asked if the occupant or any family had inquired about any local or state services, she stated that she was not aware of anything that had been done. She stated that she was there out of concern for the property and wanted to see what would become of the house. Joe Lipscomb informed Ms. Moore that if the Board found the property to be a Dangerous Building a lien would be placed on the property. She stated that nobody had any money and taxes had not been paid on the property either. Mr. Williams confirmed 3 Building Board of Appeals 11/13/06 that the Board was correct regarding a lien on the property and also verified that taxes had not been paid on the property since 1994. This case was brought to the Building Board of Appeals at the November 13, 2006 meeting. The Board determined the structure to be a dangerous building, and ordered demolition or repair within 30 days. Since that time, no effort has been made to repair or demolish the structure. The vacant residence remains in a dilapidated condition, is structurally unsound, and constitutes a nuisance in accordance with Chapter 7, Article II, Section 7-27 of the Grapevine Code of Ordinances. Staff urges the Board to forward this case to the City Attorney. Injunctive relief will be sought, and the city will demolish the structure. A lien will be placed on the property for the work performed as well as all administrative fees. A judgment will then be pursued to recover the costs. All buildings or structures of any nature that are found to be dangerous buildings or structures or dilapidated buildings or structures or buildings or structures, calculated to increase the fire haz- ard, that injure, hurt or harm individuals or that may damage or cause annoyance on the lands, tenements or hereditaments of another or which endanger life or health or violate -laws of decency or obstruct the reasonable and comfortable use of Property or are subversive of public order, decency or morals and which have any one or all of the following defects, shall be deemed "dangerous buildings." (8) Those which have parts thereof which are so attached that they may fall and injure members of the public or property, (9) Those which, because of their condition, are unsafe, unsanitary, or dangerous to the health, morals, safety or general wel- fare of the people of this city. (10) Those which have a.foundation that is not so free of holes, cracks, buckling, crum- bling and defects as to support adequately the structure. (11) Those which do not have a floor, exterior wall and roof that is or are so free of holes, cracks and loose, rotten, warped or pro- truding boards as to protect the occupants of the structure or unit reasonably from weather elements and from danger of collapse. purpose and as to protect the occupants of the structure from danger of collapse and of fire. The following standards shall be followed in substance by the building official and the building board of adjustment under the terms of this article, in ordering repair, vacation or demolition: (1) If the "dangerous building" can reason- ably be repaired so that it will no longer exist in violation of this article, it shall be ordered repaired. (2) If the "dangerous building" is in such a condition as to make it dangerous to the health, safety, morals or general welfare of its occupants, it shall be ordered to be vacated. (3) In any case where a "dangerous building" is 60 percent or more damaged, decayed or deteriorated from its original value or structure, it shall be demolished and in all cases where a building cannot be re- paired so that it will no longer exist in violation of the terms of this article, it shall be demolished. In all cases where a "dangerous building" is a fire hazard ex- isting or erected in violation of the terms of this article or any ordinance of the city or statute of the state, it shall be demol- ished. (a) The building official or his designee shall inspect or cause to be inspected, semi-annually, all public buildings, schools, halls, churches, the- aters, hotels, tenements or apartments, other multi -family residences, and commercial manu- facturing or loft buildings, for the purpose of determining whether any conditions exist which render such places a "dangerous building" within the terms of section 7-20. (b) The building official or his designee shall inspect any building, wall or structure about which complaints are filed by any person to the effect that a building, wall or structure is or may be existing in violation of this article. (c) The building official or his designee shall inspect any building, wall or structure reported (as hereinafter provided for) by the fire depart- ment or police department as probably existing in violation of the terms of this article. (d) The building official or his designee shall notify in writing, by certified mail, return receipt requested, the owner, occupant, lessee, mort- gagee, agent and all other persons having an interest in said building as shown by the city's tax roll or the deed records of the county clerk, of any building found to be a dangerous building within the terms of section 7-20, stating that: (1) The owner must vacate or repair or demolish said building in accordance with the terms of such notice and this article; (2) the occupant or lessee must vacate said building or may have it repaired in accordance with the notice and remain in possession; (3) the mortgagee, agent or other person having an interest in said building as shown by the deed records of the county clerk may, at said person's own risk, repair, vacate or demolish said building or have such work or act done, provided that any person notified under this subsection to repair, vacate or demolish any building shall be given such reasonable time, not Supp. No. 19 CD7:25 (e) The building official or his designee shall set forth in the notice provided for in subsection (d) hereof a description of the, building or struc- ture deemed unsafe, a statement of the particu- lars which make the building or structure a dangerous building and an order requiring the same to be put in such condition as to comply with the terms of this article within such length of time, not exceeding 60 days, as is reasonable. (f) If the owner, occupant, lessee, mortgagee, agent or any other person with an interest in the building fails to comply with the order provided for in subsection (e) hereof, the building official or his designee shall give notice of a public hearing before the building board of adjustment to con- sider repair, vacation or demolition of the struc- ture. Notice of the public hearing shall be sent to the owner, occupant, lessee, mortgagee, agent or any other person with an interest in the building, and said notice shall be in writing, by certified mail, return receipt requested, at least 15 days prior to the date of the hearing. Notice of the public hearing shall be posted in accordance with law. (g) The building official or his designee shall appear at all hearings conducted by the building board of adjustment and testify as to the condi- tion of dangerous buildings. (h) The building official or his designee shall place a notice on all dangerous buildings within the city, pursuant to subsection (d) above, which shall state as follows: "This building has been found to be a danger- ous building by the City of Grapevine Building Official. This notice is to remain on this build- ing until it is repaired, vacated or demolished in accordance with the notice which has been given the owner, occupant, lessee, mortgagee or agent of this building and all other persons having an interest in said building as shown by the Deed Records in the office of County Clerk of Tarrant or Dallas County, Texas. In cases, except those that constitute a clear and present danger as defined in section 7-26, where the owner, occupant, lessee, agent or mort- gagee is absent from the city, all notices or orders provided for herein shall be sent by certified mail, return receipt requested, to the owner, occupant, mortgagee, lessee, agent and all other persons having an interest in said building as shown by city records or the deed records of the county clerk's office, to the last known address of each, and a copy of such notice shall be posted in a conspicuous place on the building in question. Such mailing and posting shall be deemed suffi- cient notice for the building board of adjustment to hold its hearing. (Ord. No. 71-32, § 8, 9-19-71; Ord. No. 87-63, § 6, 10-6-87) Sec. 7-25. Hearing; abatement generally. (a) A public hearing shall be held by the build- ing board of appeals, which shall determine the issue of whether the building is dangerous and whether the building should be repaired, vacated or demolished. Written notice of the public hear- ing shall be sent by certified mail, return receipt requested, to the owner, occupant, mortgagee, lessee, agent, and all other persons having an interest in said building, at least 15 days prior to the hearing. (b) The board shall hear testimony from the building official or his designee, owner, occupant, mortgagee, lessee, agent or any person with an interest in the property and any other interested person, on the issue of whether the building or structure in question is a dangerous building. (d) Upon a determination by the board that a building or structure constitutes a dangerous building, it shall issue an order based upon its findings of fact and order the owner, occupant, mortgagee, lessee, agent and all persons having an interest in the building to either repair, vacate or demolish said building. The order shall be mailed to said persons by certified mail, return receipt requested. (e) In the event the owner, occupant, mort- gagee or lessee fails to comply with the order provided for in .subsection (d) hereof within 30 days, the board shall report the act of noncompli- ance to the office of the city attorney; it shall be the duty of the city attorney to file an appropriate action for injunction in the district court of the appropriate county, to compel said owner, occu- pant, mortgagee, lessee, agent and any person having an interest in said property to abide by the board's order and to take whatever legal action the city attorney deems expedient to enforce the order. (f) If, at the expiration of 30 days from a final judicial determination that a building or struc- ture is to be demolished, the same has not been destroyed, it shall be demolished at the expense of the owner thereof by the city or its contractor. The materials of such building shall be sold and the net cost of the demolition shall be charged to the owner, and, if any balance remains, it shall be held for the owner or any other parties entitled thereto. If the cost of the demolition exceeds the value of theateri of such building, such excess shall be charged as a lien upon the real property on which the building is situated. (g) It shall be the duty of the office of the city attorney to file suit in a court of competent jurisdiction in the appropriate county to satisfy the lien acquired pursuant to subsection (f) of this section, which may be accomplished in the origi- nal suit. (a) The building official is hereby authorized to secure substandard buildings regardless of the date of their construction when the city deter- mines: (1) The building violates the minimum stan- dards established in chapter 2, Section 203 of the Grapevine Building Code; (2) The building is unoccupied or is occupied only by persons who do not have a right of possession to the building. (b) Before the 11th day after the date the building is secured, the building official shall give notice to the owner by. (1) Personally serving the owner with writ- ten notice, (2) Depositing the notice in the United States mail addressed to the owners post office address shown on the last approved tag roll of the city, (3) Publishing the notice at least twice within a ten-day period in a newspaper of gen- eral circulation if personal service cannot be obtained and the owner's post office address is unknown; or (4) Posting the notice on or near the front door of the building if personal service cannot be obtained and the owners ad- dress is unknown. (c) The notice must contain: (1) An identification, which is not required to be a legal description of the building and the property on which it is located; (2) A description of the violation of the stan- dards that are present at the building, (3) A statement that the city will secure or has secured the building as the case may be; §727 (4) An explanation of the owners entitlement to request a hearing about any matter relating to the city securing the building. (d) The city shall conduct a hearing at which the owner may testify or present witnesses or written information about any matter relating to the city securing of the building if, within 30 days after the date the city secures the building the owner files with the city a written request for the hearing. The city shall conduct the hearing within 20 days after the date the request is filed. (e) In the event that the city building official secures any building, a statement of the cost incurred by the city to secure a building shall be mailed to the owner of said premises, which said statement shall be paid within 30 days of the date of the mailing thereof. In the event that said statement has not been paid within such period, the city manager may file a statement with the Tarrant County clerk of the expenses incurred to abate such condition on said premises, and the city shall have a privileged lien on any lot, tract or parcel of land upon which such expense is in- curred, together with ten percent on the delin- quent amount from the date such payment is due. For any such expenditure and interest, as .afore- said, suit may be instituted and recovery and foreclosure had in the name of the city and the statement so made, as aforesaid, or a copy thereof shall be prima facie proof of the amount expended in any such work performed by the city. Scott Williams explained that Staff recommended the Building Board of Appeals request the City Attorney to seek an injunction for the demolition of this dangerous building pursuant to Chapter 7, Article II, of the Grapevine Code of Ordinances. Mr. Williams stated that since the Building Board of Appeals November meeting, where it was determined that the structure was a dangerous building; no action had been taken regarding the renovation or demolition of this structure. With no further questions for Mr. Williams, Jack Brewer of Minneapolis, Minnesota explained that he had recently purchased the adjoining property from his grandmother and was interested in the property in question. Mr. Williams explained to Mr. Brewer the Building Board of Appeals 2/12/07 procedures that would take place once the city attorney's office filed the injunction on the property. Mr. Brewer stated that he was very interested in the property and would like to pursue whatever steps were necessary. Stan Wasielewski asked Mr. Williams if the city would establish a time frame for completion. Mr. Williams stated that the city attorney's office had stated that once an injunction was filed the city had the discretion to allow a reasonable amount of time for a potential property owner or interested party to rectify the situation.
