SUBJECT: ADOPT -A -PARK PRORAM
RECOMMENDATION:
The Parks & Recreation Advisory Board and staff recommend the City Council consider
approval of an Adopt -A -Park agreement with the Grapevine Garden Club for the
Botanical Gardens at Heritage Park. The application is attached for Council review.
FUNDING SOURCE:
Adopt-A-Park\Road signage would be placed at both ends of the limits of each program
area. The cost of the signs is approximately $75 and would come from the Grounds
Maintenance Account 100-42205-312-3.
BACKGROUND:
The Grapevine Garden Club has been involved in the Adopt -A Park program since
February of 2000. Since that time, the Garden Club has adopted the City's tree nursery.
However, with the construction of Dove Loop East, the Parks & Recreation Department
no longer has a tree nursery. The proposed agreement is for a period of two years and
requires the applicant to pick up litter or do other maintenance a minimum of 6 times per
year. The Parks & Recreation Advisory Board approved the agreement at the August
19, 2004 meeting. If approved by the City Council, the City will have a total of 28 active
Ado pt-A-Road/Pa rk/Trai I programs.

The City of Grapevine will work with the adopting group to determine the specific park
to be adopted. Typical tasks include litter pickup, turf maintenance, flower bed
planting and maintenance, playground maintenance, sign repair, etc.

ADOPT-A-PARK/MEDIAN PROGRAM
ADOPTION AGREEMENT
TERMS AND CONDITIONS
The City Qf Grapevine, Texas, hereinafter called the "City," and

cal e -d -the IfGroup," recognize the need and the desirability to maintain the City's Tree
Farm are entering this Agreement to permit the Group to contribute toward the effort
of maintaining the City Parks & Recreation Tree Farm.
By signature below, the Group, both jointly and severally, acknowledge the
hazardous nature of the work and agree, both jointly and severally, to the following
terms and conditions:
Participants in the Group agree to obey and abide by all laws and regulations
relating to safety and such terms and conditions as may be required by the
Director of Parks and Recreation for special conditions on the tree farm.
• When participants are 15 years of age or younger, the Group shall furnish
adequate supervision by one or more adults.
• Groups shall be required to adopt for a minimum period of at least two (2) years.
Each request for adoption will be reviewed and approved by the Parks &
Recreation Advisory Board.
• Groups shall perform maintenance a minimum of six (6) times per year and at
such additional times as required by the Director of Parks and Recreation.
Maintenance shall include items such as potting, fertilizing, weeding and pruning
trees.
• The Group shall not subcontract or assign its duties or responsibilities to any
other group, organization or enterprise.
• The Group shall appoint or select a chairperson to serve as spokesperson for the
Group.
• The Group shall obtain required supplies and materials from the City during
regular business hours.
• The Group shall have the option of renewing the agreement subject to the
approval of the Director of Parks and Recreation and continuation by the City's
Adopt-A-Park/Median Program.
• The Group shall release, relieve, hold harmless and indemnify the City, its
agents, servants and employees for any and all actions, claims, injuries, lawsuits
arising out of or in any way connected to the activities connected with the
Adopt-A-Park/Median program.
The City agrees to accomplish the following:
• Erect a sign at the adopted tree farm and at another location the Group's name
or acronym displayed.
• Provide trash bags, planting materials, hand tools, fertilizers, etc.
Additional terms and conditions:
If in the sole judgement of the City, it is found that the adopting Group is not
meeting the terms and conditions of this agreement, upon 30 days notice or a shorter
period in the event of an emergency, the City may terminate the adoption agreement
and remove the signs. This agreement may be modified in scope or altered in any
other manner at the sole discretion of the City. The City reserves the right to modify
or cancel the Program at any time, and for any reason at its sole discretion.
The City and the Group both recognize and agree that in no event, shall the City
have the right to control the Group in performing the actual maintenance of the area
adopted by the Group, and, that the Group shall act as an independent contractor.
The City recognizes the Group as the adopting organization for
