SUBJECT: RENEWAL OF INTERLOCAL AGREEMENT WITH CITY OF
EULESS FOR HEALTH SERVICES INSPECTIONS
RECOMMENDATION
Staff recommends City Council approve a five year contract renewal for Food
Establishment Inspection Services and Public Swimming Pool Inspection Services with the
City of Euless.
BACKGROUND INFORMATION
Since 1990, the City of Euless has performed the administrative and inspection activities
related to enforcement of the food service sanitation (including mobile vendors, day care
facilities and long-term care facilities), food store sanitation, and public swimming pool
sanitation in the City of Grapevine. The present contract expires September 30, 2003.
The program is working well for both Grapevine and Euless, and the Euless Health
Department continues to provide excellent service. This contract has historically been
renewed every two years; however, the Staff of both cities feel that it would be
convenient to change the length of the contract to five years. At the request of the City
of Euless, it is also proposed that the notification period for termination of the contract be
changed from 30 days to 180 days (see attached letter from the City of Euless).

SUBJECT: EXTENSION OF INTERLOCAL AGREEMENT WITH GRAPEVINE
FOR HEALTH INSPECTION PROGRAM
The City of Euless is completing its' thirteenth year of providing health inspection
services to the City of Grapevine. Staff recommends that the City of Euless
renew the Interlocal Agreement with the City of Grapevine with two (2) changes:
1) Increase the renewal period from two (2) to five (5) years; and, 2) Increase the
written notice provision for an amendment or termination from thirty (30) days to
180 days. Fee adjustments can be considered by the respective city councils at
anytime.
A renewal of the Interlocal Agreement with the two recommended changes is
proposed for several reasons. First, the program has been mutually successful.
Our staff is routinely complemented for their positive attitude, good customer
service and timely response to requests. Secondly, Euless and Grapevine
residents enjoy a higher level of service from having a second trained health
inspector that can cover when there is a special need or when the other is in
training, out on vacation, or is ill. Thirdly, the program is stable. Based on a
minimal availability of new prime vacant food establishment locations, failure
rates of current businesses, and a cautious outlook for the economy, staff does
not foresee an increase in the customer base in Grapevine or Euless that would
require additional staffing. The increase to 180 days for the opt out provision is
out of sensitivity to the Health Inspector's job security and to allow a reasonable
period to find a new job.

STATE OF TEXAS INTERLOCAL AGREEMENT FOR FOOD
ESTABLISHMENT SURVEILLANCE
COUNTY OF TARRANT PROGRAM SERVICES
WHEREAS, the governing bodies of the parties herein find the following
agreement to be in the best interest of the citizens they serve; and
WHEREAS, Article 3, Section 64 of the Texas Constitution, and Chapter 791 of
the Texas Government Code authorize Cities in the State of Texas to contract with one
another for the performance of various governmental functions and services; including
those in the area of public health and welfare; and
WHEREAS, the City of Euless and the City of Grapevine pursuant to the
Constitution and the laws of the State of Texas desire to make and enter into a contract
whereby the City of Euless, Texas, will make available to the City of Grapevine, Texas,
Food Establishment Surveillance Program Services for the public health protection of its
residents;
NOW, THEREFORE,
KNOW ALL MEN BY THESE PRESENTS:
City of Euless, a municipal corporation situated in Tarrant County, Texas,
("Euless") acting herein by and through Mary Lib Saleh, its duly authorized Mayor, and
the City of Grapevine, a municipal corporation situated in Tarrant County, Texas
("Grapevine") acting herein by and through William D. Tate, its duly authorized Mayor,
do hereby covenant and agree as follows:

Euless hereby makes available to Grapevine, at no cost or expense to
Grapevine, for the protection of Grapevine's residents Food Establishment Surveillance
Program Services, Public Swimming Pool Surveillance, Day Care Surveillance and
Long Term Care Surveillance through the City of Euless Environmental Health Office.

Euless through its Food Establishment Surveillance Program will provide its
services to all food establishments located within the corporate limits of Grapevine
during the term of this agreement. The said services shall consist of a food
establishment surveillance program to include enforcement of Section (e) (4) of the
rules on food service sanitation, lavatory maintenance, public swimming pool
surveillance, day care surveillance, long term care surveillance, certification of
establishments for issuance of health permits, collection of fees, notification to
Grapevine of violations of health ordinances, and documentation of food establishment
surveillance program activities within Grapevine in a quarterly report.

Grapevine agrees to maintain during the period of this agreement, ordinances
which: adopt the current Texas Board of Health "Texas Food Establishment Rules";
designate the City of Euless Building Official as Health Authority for the purposes of this
agreement; to require all food establishments within corporate limits of Grapevine to
maintain a valid health permit; adopt health permit fees for each food establishment and
for each temporary food establishment and public swimming pool, day care center and
long term care; assign to Euless the authority to collect health permit fees directly from
permit applicants to offset the cost of services being provided.

Grapevine shall be responsible for enforcement of City's health ordinances.

The term of this agreement is for a period of five (5) years commencing on
September 30, 2003, and ending on September 30, 2008, unless either Euless or
Grapevine provides one hundred eighty (180) days written notice to the other that an
amendment or termination is necessary.
6.
Euless is an independent contractor under the terms of this agreement and is not
an officer, agent, servant or employee of Grapevine.
