SUBJECT: RIGHT OF WAY ABANDONMENT — REGIONAL ROAD AND A
PORTION OF INDUSTRIAL BOULEVARD
RECOMMENDATION:
City Council consider adopting an ordinance abandoning a 65,048 square foot segment
of Industrial Boulevard and all of Regional Road (45,453 square feet) located on Lots 1 and
2, Block 1, Wal-Mart Addition and take any necessary action.
BACKGROUND INFORMATION:
The owner of Lots 1 and 2, Block 1, of the Wal-Mart Addition, has requested the
abandonment of a 65,048 square foot segment of Industrial Boulevard and all of Regional
Road (45,453 square feet).
The segment of Industrial Road right-of-way and Regional Road right-of-way proposed for
abandonment has been developed by Wal-Mart/Sam's into a retail center. The utilities
previously existing in said right-of-way have been relocated as part of the development of
the retail center.
The segment proposed for abandonment is not needed by the City for right-of-way
purposes.
Staff recommends approval.

ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS, ABANDONING AND VACATING A
PORTION OF THE INDUSTRIAL BOULEVARD RIGHT-OF-
WAY AND ALL OF THE REGIONAL ROAD RIGHT-OF-WAY
IN THE CITY OF GRAPEVINE, TEXAS AS HEREINAFTER
DESCRIBED; PROVIDING A SEVERABILITY CLAUSE;
DECLARING AN EMERGENCY AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, the owner of the property, Lots 1 and 2, Block 1, Wal-Mart Addition as
filed in Cabinet A, Slide 8058, Plat Records of Tarrant County, Texas, containing said right-
of-way, more specifically described in Exhibits "l a", "1 b", "2a" and "2b" attached hereto and
incorporated herein for all purposes, has requested the said right-of-way, as hereinafter
described, be abandoned and vacated; and
WHEREAS, the said right-of-way is not needed for public use and will not be
needed in the future for public use; and
WHEREAS, abandoning and vacating the said right-of-way will relieve the City of
Grapevine, Texas from cost and expense of maintaining said property.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1. That the said portion of right-of-way for Industrial Boulevard and
Regional Road, described in Exhibits "la", "lb", "2a", and "2b", attached hereto and
incorporated herein for all purposes, is hereby abandoned and vacated insofar as all public
right, title, and interest in and to said described portion of said right-of-way is concerned.
Section 2. The fact that the said right-of-way is no longer needed by the public
for public usage or traveling and would create a hardship or burden upon the City of
Grapevine to keep open and maintain such right-of-way and such street creates an
urgency and an emergency for the immediate preservation of the public health, safety, and
general welfare which requires that this ordinance shall take effect immediately from and
after its passage and it is accordingly so ordained.
Section 3. That the terms and provisions of this ordinance shall be deemed to
be severable, and that if validity of any section, subsection, word, sentence or phrase shall
be held to be invalid, it shall not affect the remaining part of this ordinance.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS on this the 18th day of November, 2003.
