SUBJECT: RESOLUTION CALLING 2004 CITY OFFICERS ELECTION
RECOMMENDATION:
City Council adopt a resolution calling the 2004 City Officers Election for Saturday, May
15, designating the polling place, election judges, and, if necessary, a run-off election to
be held on June 19, 2004.
FUNDING SOURCE:
City Secretary's Election Account 100-44540-103-1.
BACKGROUND INFORMATION:
As a result of the 75`h Legislative Session, the 2004 City Officer Election will be held on
the third Saturday in May, 2004 and revert back to the first Saturday in May, 2005. Staff
recommends that the polling location for early voting and election day remain at the
Grapevine Community Activities Center. In 2004, due to the Main Street Days Festival,
the City Secretary's Office will relocate to the second floor of the Grapevine Community
Activities Center on election day. The voter entrance will be the south end of the building
and "voter only parking" signs will be posted. Parking will be monitored continuously
during the hours of voting.
Staff recommends approval of the resolution designating the Grapevine Community
Activities Center, 1175 Municipal Way, as the location for election day and early voting by
personal appearance. Early voting and election day voting will be conducted in
compliance with the Texas Election Code.
Mr. Bryan Carlson has agreed to serve as the Election Judge. An Alternate Election
Judge and up to twelve election clerks will be appointed to serve with them.
The first day for candidates to file for a place on the May ballot is Monday, February 16,
2004 and the last day is Monday, March 15. State law provides that the last day for write-
in candidates to file is Monday, March 22. An election schedule for 2004 is attached for
Council's review. Those positions to be placed on the ballot are City Council Place 3
(Clydene Johnson) and City Council Place 4 (Darlene Freed).

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS PROVIDING FOR THE 2004 CITY
OFFICER ELECTION TO BE HELD ON MAY 15, 2004;
DETERMINING THE POLLING PLACE; APPOINTING AN
ELECTION JUDGE; PROVIDING SPECIFIC
INSTRUCTIONS FOR THE CONDUCTING OF SAID
ELECTION; REPEALING INCONSISTENT RESOLUTIONS
AND PROVIDING AN EFFECTIVE DATE
WHEREAS, Section 41.001 of the Texas Election Code provides for the holding of
general city elections on the 3rd Saturday in May; and
WHEREAS, the City desires to conform its practices with State law; and
WHEREAS, the Charter of the City of Grapevine, Texas provides that the Election
Code of the State of Texas is applicable to the City Council and Run -Off Elections, and in
order to comply with said code an order should be passed establishing the procedure to
be followed in said election, and designating the voting place for said election.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS:
Section 1. That the Regular City Officer Election for the City of Grapevine is
hereby called for Saturday, May 15, 2004 for the following:

Section 2. All eligible City of Grapevine voters shall cast their ballots at the
Grapevine Community Activities Center, 1175 Municipal Way, between the hours of
7:00 a.m. and 7:00 p.m. on May 15, 2004.
Section 3. All early voting shall be conducted pursuant to and in accordance
with the applicable provisions of the State of Texas Election Code.
Section 4. The Chief Election Judge shall be Mr. Bryan Carlson and the
Alternate Election Judge will be appointed by Mr. Carlson. Said Election Judge shall
have the ability to hire up to twelve (12) clerks to assist in holding the election. The
Alternate Election Judge shall also serve as the presiding judge of the Early Voting Ballot
Board. Two or more of the clerks serving at the polling place shall make up the members
of the Board.
Section 5. All candidates must file their applications to become candidates with
the City Secretary of said City at City Hall, Grapevine, Texas on or before 5:00 p.m. the
62nd day from the date of said election. That all of the said applications shall be on a
form approved by the City Secretary and shall be in compliance with the City Charter and
the State Election Code.
Section 6. That the City Secretary shall post in her office the names of all
candidates who have filed their applications in accordance with the terms and provisions
of this order.
Section 7. The City Secretary is hereby authorized and instructed to provide
and furnish all necessary supplies and personnel to conduct said election. Said supplies
and personnel shall be furnished at the expense of the General Fund of the City of
Grapevine, Texas. Early voting and election day voting will be on the Optech III -P Eagle
electronic voting system.
Section 8. The City Secretary is hereby instructed to publish notice of said
election once in a newspaper of general circulation not more than thirty (30) days before
the election and not less than ten (10) days before the election.
Section 9. This Resolution shall repeal every prior resolution in conflict
herewith, but only insofar as the portion of such resolution shall be in conflict, and as to all
other sections of resolutions not in direct conflict herewith, this Resolution shall be and is
hereby made cumulative.
Section 10. The Mayor shall issue all necessary orders, writs and notices for said
election and the returns of said election shall be made to the City Council immediately
after the close of the polls and the completion of the counting of the ballots.
Section 11. Any run-off necessitated by the election will be held at the same
location as the May 15, 2004 election in accordance with the Texas Election Code.
Section 12. That this resolution shall be effective from and after the date of its
passage.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS on this the 3rd day of February, 2004.
