Replace section of fence with six-foot tall fence for the first 17 feet, transitioning to eight feet in the rear of the house, 1 inch x 4inch cedar pickets, with flat top and metal posts; as per the attached drawings and photos with the condition a permit be obtained from the Building Department. An approved Certificate of Appropriateness is not an approved building permit; a building permit is / is not required. All drawings and figures contained herein are estimates only, and Purchaser recognizes that they are not to be construed as guaranteed or actual. The final location of the fence will be determined after a city permit is obtained. The Final invoice shalt be based upon actual installed footage and shall be calculated using the quoted per unit prices identified herein. 2) Payments shall be made as follows: 1/2 before project starts, 1/2 upon completion. 3) The fence shall follow the contour of the ground unless otherwise specified and shall be installed approximately 2" above the grade. Purchaser shall obtain and pay for all permits required by any and all local and state governmental entities. 4) Purchaser agrees that in the event payment in full is not made by Purchaser, and/or is not received by T Bar Fence, inc. within seven (7) days of completion of the Work. Purchaser expressly consents to the removal of all materials installed, regardless of any partial payments made, and regardless of whether or not such materials constitute "fixtures" as defined by Texas law. 5) Rock Removal: Purchaser is responsible for rental of equipment if necessary to facilitate rock removal plus an extra charge for labor (with or without equipment) of $35 per hole. 6) All labor and workmanship on fence is guaranteed for double drive gates carry no warranty unless constructed using steel frame and steel posts. No warranty for damages caused by storm or ind damage or abuselneglect of fence. 7) in the event partial payment is made by credit or debit card in connection with this Proposal, Purchaser expressly authorizes T Bar Fence, Inc. to charge/debit the remainder of the amounts owed under this agreement automatically, to the same credit or debit card which was used to make such partial payment, without further notice or authorization after seven (7) days have elapsed after completion of the work. inrmf 8) This Proposal constitutes the entire and exclusive scope of work and materials to be provided by T Bar Fence, Inc, to Purchaser for the referenced property at this time. Any and all prior or contemporaneous understandings, promises, representations, warranties or covenants, whether written or oral, or whether expressed, implied or apparent, are hereby deemed merged into and made a part of this Proposal. 9) Purchaser shall be responsible for payment of all costs incurred to repair accidental damage to any underground wires, pipes, sprinklers, conduits or utilities. Reasonable care shall be taken by T Bar Fence, Inc. to avoid accidental damage to landscape during installation. Purchaser shall be responsible for protecting any landscape directly adjacent to the work area. Purchaser to carry fire, tornado and other hazard insurance upon above work.
