will be placed on the agenda for public hearing at the discretion of the staff. Based on the size
of the agenda, your application may be scheduled to a later date.
All public hearings will be opened and testimony given by applicants and interested citizenry.
Public hearings may be continued to the next public hearing. Public hearings will not be
tabled.
Any changes to a site plan (no matter how minor or major) approved with a conditional use or
a special use permit can only be approved by city council through the public hearing process.
Any application for a change in zoning or for an amendment to the zoning ordinance shall
have, from the date of submittal, a period of four months to request and be scheduled on an
agenda before the Planning and Zoning Commission and City Council. If after said period of
four months an application has not been scheduled before the Commission and Council said
application shall be considered withdrawn, with forfeiture of all filing fees. The application,
along with the required filing fee may be resubmitted any time thereafter for reconsideration.
Delays in scheduling applications before the Planning and Zoning Commission and City
Council created by city staff shall not be considered a part of the four month period.

AMENDMENTS TO COMPREHENSIVE ZONING ORDINANCE 82-73
The City Council and the Commission will consider amendments and changes to the
Comprehensive Zoning Ordinance, No. 82-73, same being Appendix D of the Code of
Ordinances as follows:

Sections 23, 23A, 24, 25, 26, 27, 30, 31, and 32 relative to the 120 -foot setback

Sections 55 and 58, relative to outdoor lighting;
Sections 31 and 32 relative to design standards and location of loading dock doors;
Sections 23, 24, 25, 26, 27, 29, 30, 31, 32, 36, 37, 55 relative to the placement of
landscaping;
Section 60, relative to pole signs;
Section 50, relative to the placement of screening.
and any other additions, deletions, or changes to various sections, articles and provisions
contained in said Ordinance No. 82-73.
After all parties have been given an opportunity to speak, the public hearing will be closed
and the Commission and the City Council will deliberate the pending matters. Please

REQUESTED CONDITIONAL USE AND COMMENTS:
The applicant is requesting a conditional use permit to establish an automotive/leasing
facility.
The applicant proposes to utilize the existing site as a leasing/car rental business for
Enterprise Rent -a -Car. An existing pole sign located at the northwest corner of the site will
be removed and replaced with a 65 square foot monument sign adjacent to the drive off
of West Northwest Highway. The applicant proposed to close the drive immediately east
of the Northwest Highway/Scribner Street intersection.
The applicant will be seeking a variance to Section 53.H.2.a Landscaping Regulations at
the Board of Zoning Adjustment's May 7, 2001 meeting. The applicant will be requesting
to reduce the required 15 -foot landscaping setback along Scribner Street to five feet so
that more of the site can be utilized for the stacking and display of rental vehicles. This will

be a first reading of an ordinance on this request.
The property is currently zoned "HC" Highway Commercial District and was developed as
the Egg Roll House restaurant. The restaurant has ceased operation and the site is now
awaiting redevelopment.
The subject property and the property to the north and west was zoned "C-2" Community
Business District prior to the 1984 City Rezoning. The property to the south and east was
zoned '14' Limited Industrial District prior to the 1984 City Rezoning.
