The site contains 0.65 acre and has approximately 149 feet of frontage on North Main Street. REQUESTED CONDITIONAL USE AND COMMENTS - The applicant is requesting a conditional use permit to amend the previously approved site plan CU96-28 (Ord. 1996-87) for an expansion to the existing building on Lot 5, and a waiver to Section 47.E.2. Site Plan Review in accordance with Section 47.F. Procedure for Processing Site Plans. This request is specifically to allow the possession, storage, retail sales of on- and off- premise consumption of alcoholic beverages (beer and wine only) and a planned development overlav to allow deviation from parking requirements in coniunction with an existing restaurant (Sauce'd). The subject site was developed prior to 1987 as a single -story, multi -tenant building. The applicant is requesting to sell and store beer and wine on -site, specifically for the existing restaurant's customers. The multi -tenant building has one parking lot with a total of 83 parking spaces, which are shared among tenants occupying Lots 1-5. Lot 5 has a total of 40 parking spaces, while the existing three tenants require 50, leaving a deficit of 10 spots. To help address the issue, the applicant has requested a planned development overlay and has agreed to lease five spaces from the adjacent parking lot to the south to alleviate the future deficit. PRESENT ZONING AND USE: The property is currently zoned "HC", Highway Commercial District and is an existing multi - tenant building. HISTORY OF TRACT AND SURROUNDING AREA: The subject site was zoned "C-2", Community Business District prior to the 1984 City-wide Rezoning at which time the subject site was rezoned to "HC", Highway Commercial District. On October 15, 1996, City Council approved conditional use request, CU96-28 (Ord. 1996-87) for an expansion to the existing building on Lot 5, and a waiver to Section 47.E.2. in accordance with Section 475. On October 21, 1997, City Council approved an extension for the previously approved conditional use permit CU96-28 (Ord. 1996-87) for an expansion to the existing building on lot 5, and a waiver to Section 47.E.2. in accordance with Section 475. SURROUNDING ZONING AND EXISTING LAND USE: NORTH: "HC", Highway Commercial District — Multi -tenant building with retail, restaurants, and a salon SOUTH: "HC", Highway Commercial District — Commercial parking lot EAST: "HC", Highway Commercial District —Mohler MMA Mixed Martial Arts WEST: "HC", Highway Commercial — Bank of the West AIRPORT IMPACT: The subject tract is located within "Zone A" zone of minimal effect as defined on the "Aircraft Sound Exposure: Dallas Fort Worth Regional Airport Environs" map. Few activities will be affected by aircraft sounds in Zone A except for sound sensitive activities such as auditoriums, churches, schools, hospitals, and theaters. The applicant's proposal is an appropriate use in this noise zone. MASTER PLAN APPLICATION: Map 2: Land Use Plan of the Comprehensive Master Plan designates the subject property as a Commercial (CO) land use. The applicant's proposal is compliant with the Master CU24-08/ PD24-02 2 Plan. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract or tracts of Ordinance No. 2024-032 3 CU24-08 land described herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the tract or tracts of land described herein.
