SUBJECT: ABANDONMENT RIGHT-OF-WAY — 943 JEAN STREET (EAST
CORNER)
RECOMMENDATION: City Council consider adopting an ordinance abandoning a 200-square-
foot corner clip of street right-of-way located at the southeast corner of Lot
8, Block 2, Hilltop Addition located at 943 Jean Street, and take any
necessary action.
FUNDING SOURCE:
BACKGROUND: The owner of 943 Jean Street in the Hilltop Addition, has requested the
abandonment of a 200-square-foot corner clip of street right-of-way within
the southeast corner of Nash and Berry Streets. The developer of the
proposed Nash and Berry Addition (Case TDO 24-01, approved April 16,
2024) is constructing single family attached townhomes within a Transit
District Overlay, located north of Nash Street between Jean and Berry
Streets. The right-of-way abandoned will be retained as a sight visibility
easement and a portion of a utility easement. The segment proposed for
abandonment is not needed by the City for right-of-way purposes.
Staff recommends approval.
ORDINANCE NO. 2024-039
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS, ABANDONING AND VACATING A
CORNER CLIP OF RIGHT OF WAY LOCATED 943 JEAN
STREET IN THE CITY OF GRAPEVINE, TEXAS AS
HEREINAFTER DESCRIBED; SAVE AND EXCEPT THE
RETENTION OF SAID RIGHT-OF-WAY FOR A SIGHT
VISIBILTY EASEMENT AND PORTION OF AN UTILITY
EASEMENT; PROVIDING A SEVERABILITY CLAUSE;
DECLARING AN EMERGENCY AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, the property owners of Lot 8, Block 2, Hilltop Addition, recorded in
Volume 388-2 Plat Records, Tarrant County, Texas, the property containing a right of way,
more specifically described in Exhibits "A" and "B" attached hereto and incorporated herein
for all purposes, has requested the right of way, as herein after described be abandoned
and vacated; and
WHEREAS, the right of way is not needed for public use and will not be needed in
the future for public use; and
WHEREAS, abandoning and vacating the said right of way will relieve the City of
Grapevine, Texas from the cost and expense of maintaining said property; and
WHEREAS, the City Council deems the adoption of this ordinance to be in the best
interests of the health, safety, and welfare of the public.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1. That all matters stated in the preamble of this ordinance are true and
correct and are hereby incorporated into the body of this ordinance as if copied in their
entirety.
Section 2. That the right of way located within the property described in Exhibit
"A" and "B", attached hereto and incorporated herein for all purposes, is hereby
abandoned and vacated for public use and the same is hereby abandoned and vacated
insofar as all public right, title, interest in and to said right of way is concerned, save and
except the retention of said right-of-way as a drainage and utility easement for public use.
Section 3. That the terms and provisions of this ordinance shall be deemed to be
severable, and that if the validity of any section, subsection, word, sentence or phrase
shall be held to be invalid, it shall not affect the remaining part of this ordinance.
Section 4. The fact that the right of way is no longer needed by the public for
public usage and would create a hardship or burden upon the City of Grapevine to keep
open and maintain such right of way creates an urgency and an emergency for the
immediate preservation of the public health, safety, and general welfare which requires
that this ordinance shall take effect immediately from and after its passage and it is
accordingly so ordained.

County, Texas and being that same tract as described in Deed to the CITY OF GRAPEVINE as recorded in
Instrument No. D218256699, Plat Records, Tarrant County, Texas and being more particularly described by
metes and bounds as follows:
BEGINNING at a 1/2 inch steel rod found with cap stamped "PRISM SURVEYS" (CM) for the southeast corner
of said CITY TRACT, also being the Intersection of the westerly right-of-way line of Berry Street with the
northerly right-of-way line of Nash Street;
THENCE North 89 degrees 10 minutes 57 seconds West with said northerly right-of-way line, 20.01 feet;
