Public hearings will not be tabled.
Any changes to a concept plan approved with a zone change request can only be
approved by city council through the public hearing process.

200 South Main Street, Grapevine, Texas, the City Council and Planning and Zoning
Commission of the City of Grapevine will hold a public hearing to consider the following

Applicant: Gary Cantrell Co, Inc
Location: 3735 Ira E Woods Avenue, proposed to be platted as Lots 1-
30, Block 1, Lots 1-2, Block 2, River Dance Addition
Current Zoning: "CN" Neighborhood Commercial District
Proposal: The applicant is requesting to rezone 12.10 acres from "CN"
Neighborhood Commercial District to "R-5.0" Zero -Lot -Line District for the development of

Proposal: The applicant is requesting a zone change to rezone the subject
property from "R-TH" Townhouse District, "R-3.75" Three and Four Family District and
"CBD" Central Business District to "R-7.5" Single Family District and "GU" Governmental
Use District and amend the City's Future Land Use Plan for this area to low density

AMENDMENTS TO COMPREHENSIVE ZONING ORDINANCE 82-73
The City Council and the Commission will consider amendments and changes to the
Comprehensive Zoning Ordinance, No. 82-73, same being Appendix D of the Code of
Ordinances as follows: Section 12, Definitions relative to "depth of lot" and "depth of rear
yard" and any other additions, deletions, or changes to various sections, articles and
provisions contained in said Ordinance No. 82-73.

REQUESTED ZONE CHANGE, MASTER PLAN AMENDMENT AND COMMENTS:
The applicant is requesting a zone change to rezone the "R-TH" Townhouse District "R-
3.75" Three and _Four Family District and "CBD" Central Business District oror)erty
generally west of Barton Street, east of Ball Street, south of Wall Street and north of
Hudgins Street to "R-7.5" Single Family District and "GU" Governmental Use District and
amend the City's Future Land Use Plan for this area to low density residential.
At its April 3, 2007 workshop, City Council requested that a public hearing be set for
consideration of rezoning the area west of downtown described above. See attached list of
specific properties.
The Development Services department has recently conducted a land use study of the "R-
TH" Townhouse zoning district west of downtown. As a result of this study, staff has

concluded that, other than the large areas owned by the City of Grapevine Housing
Authority and First United Methodist Church the vast majority of the property is currently
utilized as single family residential.
The subject zoning was placed on the property during the citywide rezoning in 1984. Prior
to this, the property was zoned "R-2" Two Family District. While "R-TH" Townhouse District
might have been deemed appropriate in 1984, it may not be realistic or desirable to
perpetuate this zoning. Furthermore, the large percentage of single family property
scattered throughout this "R-TH" Townhouse District could be construed as spot zoning,
which is not ideal. Therefore, it is recommended that this area be rezoned to "R-7.5"
Single Family District. The single family residence located at 221 West College Street is
zoned "CBD" Central Business District, and it is also recommended that his property be
rezoned to "R-7.5" Single Family District.
The City's Master Plan shows the subject area as medium density residential land use, and
the current "R-TH" Townhouse District zoning is compatible with this land use. Therefore,
it is recommended that if the rezoning is desirable, the Master Plan be amended to low
density residential land use.
Notification of this case was sent in accordance with City Ordinances and the State Local
Government Code. Additionally, all property owners within the subject area were sent a
letter inviting them to meet with staff, and of the 30 property owners notified, seven
responded, and four actually met with Development Services personnel. The Assistant
City Manager, Building Official and Development Manager also met with Ken Diehms,
pastor of First United Methodist Church, who did not oppose this case.
PRESENT ZONING AND USE:
The subject property is currently zoned "R-TH" Townhouse District, "R-3.75" Three and
Four Family District and "CBD" Central Business District and is developed as single family
residences, church facilities and the Grapevine Housing Authority.

This letter shall serve to document the impact the proposed "R-7.5" Single Family
District rezoning will have on the existing apartment units owned by the First United
Methodist Church.
The property where these units are located is currently zoned "R-3.75" Three and Four
Family District. This current zoning would not allow apartment complexes, making this
property what is called "Legal Nonconforming". Essentially, this means that although
the use is not permitted, it may continue provided no alterations or additions are made
to the property. Should you wish to make alterations, additions, or change to another
non -conforming use, you would be required to obtain a special exception from the
Board of Zoning Adjustment, which may or may not be granted. Furthermore, should
the structure(s) be damaged to the extent of more than 60% of their replacement cost, a
special exception would be required from the Board of Zoning Adjustment. I have
attached Section 43, Nonconforming Uses and Structures to this letter.
The proposed zoning of this property is "R-7.5" Single Family District, the apartments
would also be considered nonconforming under this zoning designation. Therefore, the
proposed zoning change would have no negative impact on this property as it exists.

AND REZONING OF THE "R-TH" TOWNHOUSE DISTRICT WEST
OF BARTON STREET
RECOMMENDATION:
Staff recommends the City Council consider amending the Master Land Use Plan and
rezoning of the "R-TH" Townhouse District west of Barton Street to "R-7.5" Single Family
District and authorize a public hearing for same.
BACKGROUND INFORMATION:
On March 5, 2007, an application for demolition of the single family residence located at
626 South Church Street was submitted along with a concept plan submittal showing the
proposed construction of a new townhouse project. This property does not have a historic
landmark overlay. It is, however, in the Historic Grapevine Township Revitalization District
and has considerable architectural significance. Because of its location in the Historic
Grapevine Township Revitalization District, a certificate of appropriateness from the
Historic Preservation Commission would be required for demolition; otherwise staff would
have no tools available to block demolition of the architecturally significant structure.
Staff has realized the need to present City Council with a proposal for amending the Master
Land Use Plan to residential low density and rezoning the "R-TH" Townhouse District
generally west of Barton Street, north of Hudgins Street, east of Ball Street and south of
Wall Street. Most of this property is proposed to be rezoned to "R-7.5" Single Family
District. However, staff can also use this opportunity to rezone the Grapevine Housing
Authority property to a more appropriate "GU" Governmental Use District designation (a
detailed map showing the location of the current land uses and proposed rezoning is
attached). The land use study initiated by staff shows that other than the Grapevine
Housing Authority property and First United Methodist Church property, the predominant
use is in fact single family residential. Staff is also suggesting that if City Council decides
to move forward with the rezoning, that the residential lot at the southeast corner of Church
Street and College Street be rezoned from "CBD" Central Business District to "R-7.5"
Single Family District.

The master plan currently shows the proposed rezoning district to be medium density
residential. Staff suggests that should City Council wish to move forward with the proposal
that the master plan be amended to reflect the use of low density residential.
Should City Council wish to move forward with the proposed rezoning, staff will set a public
hearing before the City Council and Planning and Zoning Commission at the earliest
possible opportunity.
