PROPERTY LOCATION AND SIZE:
The subject property is located at the southwest
corner of Mustang Drive and Southwest Grapevine
Parkway and is proposed to be platted as Lot 1 R-2
Southwest Grapevine Commercial Park. The site
contains approximately 2.4 acres and has 434 feet of
frontage along Southwest Grapevine Parkway, 368
feet of frontage along Mustang Drive, and 528 feet of
frontage along Heritage Avenue.
REQUESTED CONDITIONAL USE AND COMMENTS:
The applicant is requesting a conditional use permit to allow the development of a personal
care facility.
This is the first phase of a multi -phase project. This first phase will contain 42 -beds for the
proposed personal care facility.
This request was tabled during the public hearing at the November 19, 2002 meeting in
order for the applicant to address both the City Council and Dallas/Fort Worth Airport staff
concerns relative to sound attenuation. The applicant requested the issue be tabled a

second time at the December 17, 2002 in order to work out the details of the sound
attenuation with a sound engineer as well as to work out an agreement with the Dallas/Fort
Worth Airport Board to garner their support for the project. Attached is a copy of the letter
from Dallas/Fort Worth Airport staff stating that all their concerns have been addressed.
As a part of the ordinance associated with this request, the applicant has:
• Agreed to dedicate on the plat and by separate instrument an avigation easement;
• Understands that no building permit will be issued for any building on the subject
property unless the plans have been stamped and sealed by an acoustical engineer,
qualified and licensed in the State of Texas, certifying that the building to be
constructed shall include sound treatment to achieve at least 25 dB Noise Level
Reduction as recommended by the FAA;
• Understands that no Certificate of Occupancy shall be issued for any building on the
subject property unless an acoustical engineer, qualified and licensed in the State of
Texas certifies that the building has been constructed in accordance with the standard
provided hereinabove.
PRESENT ZONING AND USE:
The property is currently zoned "CC" Community Commercial District and is undeveloped.
HISTORY OF TRACT AND SURROUNDING AREA:
The subject and surrounding property was rezoned from "R-1" Single Family District to
"PID" Planned Industrial Development District, "LI" Light Industrial District, "CC" Community
Commercial District and "R -MH" Manufactured Home District during the 1984 Citywide
Rezoning. The property to the south of the subject site received a zone change (Z99-14)
at the September 21, 1999 meeting rezoning 4.435 acres from "PID" Planned Industrial
Development District to "CC" Community Commercial District for an office development.

The subject tract is located within "Zone B" Middle Zone of Effect as defined on the
"Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" map. In Zone B,
the following uses may be considered only if sound treatment is included in building design:
multi family apartments, motels, office buildings, movie theaters, restaurants, personal and
business services. Single family residential and sound sensitive uses such as schools and
churches should avoid this zone. The applicant's proposal is an appropriate use in this
noise zone.
The Master Plan designates the subject property as a Commercial land use. The
applicant's request is in compliance with the Master Plan.

Gentlemen:
This letter is written to be included in the Conditional Use Application pertaining to the above
captioned property.
We propose to improve the property with a one story building designed as an Assisted Living
Facility for residents with memory impairment. The facility will provide living units for 42
residents, along with a commercial kitchen, dining rooms, staff offices, bathing areas, laundry
rooms and common areas to include game rooms, library, therapeutic kitchen and greenhouse
area. There will also be secured outside garden areas for the use of residents.
The building will be staffed 24 -hours per day, 7 days per week and will be fully secured to
prevent residents from leaving the building without staff supervision.
We feel that the proposed use will positively influence the value, use and enjoyment of other
property within the neighborhood, as the facility will be of very high quality construction and
provide a buffer between the residential area to the south and the commercial uses provided on
the adjoining land and our building will blend very well with the medical office building directly
across Heritage Avenue. Also, since the residents do not drive, there should be very little
additional vehicular traffic generated by this facility.

Dear Mayor Tate, City Council and Planning & Zoning Commission Members:
At the November 19, 2002 meeting of the joint City Council and Planning & Zoning Commission, the item
noted above was tabled pending further discussions with the DFW Airport Noise Compatibility Office. This
action was prompted by a letter that had been sent by the DFW Noise Office citing concerns about the
proposed use of the property given the noise levels and known aircraft activity in the immediate vicinity. The
proposed use, a personal care facility specifically designed for persons suffering from Alzheimer's disease, is
requested to be located at the southwest corner of the intersection of Mustang Drive and Southwest
Grapevine Parkway. This area is inside the 65 DNL (also referred to as Zone B) as shown on the Airport's
official noise contour. According to the Federal Aviation Administration's (FAA) Land Use Compatibility
Guidelines, this type of land use would be considered compatible in the 65 DNL p-D-ly if it has been designed
and built to achieve an outdoor to indoor Noise Level Reduction (NLR) of at least 25 dB.
Since the November 19`h meeting, the City's Department of Development Services, the applicant for the
referenced use, and representatives of the DFW Noise Office have met. It was agreed that the City would
incorporate specific conditions, by ordinance, into the approval of the conditional use permit. These
conditions are as follows:
1. Dedication to the City of Grapevine, the Dallas -Fort Worth International Airport Board, and the Cities of
Dallas and Fort Worth an avigation easement, on the plat and by separate instrument, in a form
acceptable to DFW Airport and the Cities of Dallas and Fort Worth.
2. Mandatory building shell noise reduction yielding a minimum noise reduction of 25 dB as evidenced on
design drawings and stamped and sealed by a professional engineer licensed in the State of Texas. Such
evidence must be provided to the City prior to the issuance of a building permit(s) and Certificate of
Occupancy.
The Airport is satisfied that the conditions established by the City are appropriate and adequate to comply
with FAA Land Use Compatibility Guidelines.
Let me also add that the Development Services staff and the applicant have been exceptionally proactive,
cooperative and helpful in addressing the Airport's concerns. We commend the City of Grapevine for the
prompt serious attention that has been dedicated to this matter. Thank you.

Dear Committee Members:
I am a Registered Nurse and in charge of the health care for all of the Autumn Leaves
dementia homes. I have cared for several hundred patients over the past fifteen years
with various forms of neurological disorders; I am knowledgeable and highly
experienced when it comes to the care of demented individuals.
I have visited the proposed site on numerous occasions. I have also been at the site when
the winds were out of the south and the closest runway was in use. I also asked Jamie
Anderson, another Registered Nurse who cares for demented patients, to come to the site
under the same wind conditions. We have both reached the following conclusions:
1. Takeoffs and landings of both propeller planes and jets would not be bothersome
to demented (neurologically impaired) individuals standing outside at the
proposed site.
2. Our residents would find the landings in particular very entertaining and thereby
making the proposed site a positive place for demented individuals to live.

Dear Sir or Madam:
I recently read an article in the Ft Worth Star -Telegram about a proposed health care facility
being built at the corner of Mustang Drive and Heritage in Grapevine. The article caught my
attention because I am the son-in-law of a dementia patient and a pilot flying out of DFW. I felt
compelled to write this letter to highlight some information in the article that seemed to be a bit
misleading. Specifically, the article addressed the noise generated by aircraft taking off and
landing at Dallas/Ft Worth (DFW) International Airport and its impact on the proposed Autumn
Leaves Care Facility. It presented what seemed to be a "worst-case" scenario and led the readers
to believe that it constantly occurred. Furthermore, it led the readers to believe that building a
health care facility on the proposed site would somehow be detrimental to dementia patients.
Nothing in this letter is intended to dispute the facts as presented by the DFW Airport authorities.
Instead, I wish to make some distinctions between DFW's "worst-case" scenario and what I have
observed to be common practice in my 3.5 years of flying in and out of DFW. Because
operations surrounding Runway 13 Right (13R)/31 Left (31L) are the most bothersome to the
proposed site, my comments will be concentrated on that runway.
Before I go further, let me provide some of my background. I am a retired Air Force pilot with
over 30 years flying experience. I am currently flying as an airline pilot based at DFW and have
flown both turboprop and turbojet aircraft in and out of DFW on a routine basis since October
1999. My father-in-law has suffered from dementia for over a decade and is currently residing in
a health care facility in central Texas.
The specific information I would like to provide to you in this letter concerns the utilization of
Rwy 13R/3IL, the noise generated by aircraft using that runway, and future runway proposals at
DFW. This information was obtained through informal, unscientific research and through
personal observations.
Runway 13R/31L is not a runway of choice for most airline pilots flying into and out of DFW.
The primary reason for this is that taking off or landing on this runway significantly adds to the
taxi time and fuel burn. Runway 13R/31L is used primarily by aircraft arriving from the
northwest (Bowie Arrival) and only then when other aircraft arriving have saturated the Runway
18 Right (18R) pattern. If landing south and given a choice of landing runway, most pilots who
are parking on the west complex will request Runway 18R. Those parking on the east request
Runway 17 Center (17C). When landing to the north, the point is moot because Runway 3 1 L is
never used for landing. DFW`s own runway usage analysis states that the runway is used only by
approximately 10% of the traffic at DFW. This figure is further broken down in a letter from
Wrightson, Johnson, Haddon & Williams to Mr. Win Warren to be "7.5% of both day and night
commuter aircraft" --meaning turboprops and "2.5 % of day and night large airliners" --meaning
turbojets. Through my experience, I believe these numbers to be accurate. While both turboprop
and turbojet use the runway for landing, it is important to note that, in practice, the only aircraft
that take off on this runway are turboprops, and then only when taking off to the north.
Furthermore, the departure procedures require the turboprops to execute a turn to the west (2400
or 2700 magnetic) after reaching a safe altitude, which is usually obtained before the aircraft
reaches the end of the runway. The typical departure routes for these aircraft are depicted in
Attachment 1 and usually avoid the proposed site by enough distance to significantly reduce the
aircraft noise footprint. Therefore, the proposed site for Autumn Leaves will be spared the noise
generated by aircraft taking off and departing as all that activity occurs well south of the
proposed site. The only noise generated by airborne aircraft that might affect the proposed site is
that of landing aircraft.
The two aspects of noise from landing aircraft involve the height of the aircraft as they pass the
proposed site and the types of engines on these aircraft. DFW authorities state that aircraft might
be as low as 250 feet while passing the Autumn Leaves site. While technically correct, this
altitude is deemed dangerously low by all pilots queried. To better understand the 250 -foot
quote, a brief outline of glide path guidance may be necessary. Typically, a commercial pilot
strives to fly a 3 -degree glide path during the final portion of his approach. This roughly equates
to descending 300 feet for every nautical mile traveled until touchdown. FAA standards allow
the pilot to momentarily deviate one-half of one degree above or below the glide path throughout
the approach (meaning 50 feet for each nautical mile from touchdown). To accurately determine
where an aircraft should be at any given point during an approach, one should measure from
touchdown (not just the end of the runway) and add 300 feet for every nautical mile from that
touchdown point. Because most commercial landing profiles are predicated on the aircraft
crossing the landing threshold at 50 feet, one could also derive the glide path information by
measuring the nautical miles from the end of the runway and adding an additional 50 feet to the
300/1 rule. If either of these methods are applied to Rwy 13R/31L, the aircraft are closer to 400
feet when passing the Autumn Leaves site. When landing on Rwy 13R, pilots use instruments
located in the cockpit to align themselves with the appropriate glide path. They are provided
with immediate feedback if the aircraft deviates from the desired glide path. In all instances,
when I asked fellow pilots if they would either fly or allow another crewmember to fly one-half a
degree low during the approach either visually or in the weather, their answer was a resounding
no. Furthermore, all pilots stated that they would expect an immediate correction back to or
above the glide path for any deviation below the glide path. It is important to note that even
though aircraft fly below 500 feet as they pass the proposed Autumn Leaves site, they do not fly
directly over the site. Instead, the arrival path of the aircraft is offset approximately one-half
mile east of the proposed site.
The second aspect of the noise footprint is the type of engines used. In 1990 when the survey
was conducted, the typical jet engine used was the turbojet. This engine used 100% of the
airflow entering the engine to flow through the burner section of the engine to produce thrust.
Although the turbojet is still in use, today's newer jet aircraft are being equipped with turbofan
engines. These engines typically use less than half the air entering the engine in the burner
section. The rest of the air enters a "fan" section of the engine and produces most of the thrust.
The result of bypassing this air is a significantly quieter engine. My guess is that noise footprints
will continue to shrink as engine makers of the future continue to search for quieter engines as
well as those that produce an increased amount of thrust and use less fuel.

Lastly, I'd like to address what I understand to be a proposal to build an additional north/south
runway on DFW s west complex. I have outlined the approximate location of this proposed
runway on Attachment 1. One must ask if Rwy 13R/31L only accommodates 10% of DFW's
traffic, yet completely meets the needs of the airport, why build another runway? I think the
simple answer is that while Rwy 13R/31L is a nice runway to have, it falls short meeting the
future growth needs of DFW. To understand why, one must explore the shortcomings of Rwy
13R/31L. Probably the biggest factor affecting the runway is the fact that traffic using that
runway must converge with the traffic using the other runways. New FAA rules allow for
decreased separation between arriving aircraft, especially when the weather is a factor, for
aircraft that are executing an approach that is aligned with an adjoining approach (provided the
runways are separated by a given distance). Simply stated, Rwy 13R/31L does not meet the
criteria for simultaneous close approaches. Any aircraft using that runway must be provided
additional separation for both the approach and possible go -around. And, an aircraft executing a
go -around from Rwy 13R must immediately execute a climbing right turn with a heading change
greater than 90 degrees in order to deconflict with aircraft taking off from the other runways.
This heading change is not optimum for an aircraft with an engine failure or experiencing flight
control malfunctions. For these reasons, I personally believe building the proposed north/south
runway will enhance DFW's ability to serve the needs of future commercial aircraft. I also think
that when the new runway opens, there will be a significant drop in the number of aircraft using
Rwy 13R/31L. If that happens, then the noise levels experienced at the proposed Autumn
Leaves site will decrease significantly.
Again, my purpose in writing this letter is to draw some distinctions between what the DFW
Airport authorities state may happen with aircraft departing and arriving on Runway 13R/31L
and what I have found to be happening in day-to-day operations, and what may happen if
proposed runway improvements materialize. The plain and simple truth is that operations on
Runway 13R/31L would not adversely impact a health care facility at this location. As a matter
of fact, I think my father-in-law would enjoy living in such a facility where he could watch the
aircraft as they pass by in the distance.

Dear Committee Members:
My name is Troy Hansbarger and I live at 1300 Keller Pkwy in Keller, TX. I am
currently a college student who was asked by LaSalle equity to do a quite important job,
polling the immediate neighbors to the proposed Autumn Leaves site in Grapevine. To
make sure the sound from the nearby runway at the corner of Mustang and Heritage Rd.
was not too loud, I had to find out if and how the airplanes affected the nearby properties.
Although I couldn't speak with absolutely everyone, I did take a large sample space and
gave them a survey to fill out based on the noise the airplanes did or did not make. They
were asked if the airplanes landing or taking off on runway 13R/31 L, about one mile
from the property, were bothersome, either by noise level or by the view.
I covered all the neighborhoods, businesses, and apartment complexes
immediately surrounding the site on all sides of the property. Roughly 98% of the
neighbors said the plane noise would be no problem for the residents whether standing
inside the building or participating in activities outside. In fact, most people stated that it
would be an absolutely great place to have an assisted living home and that the residents
actually would enjoy watching the airplanes go by. Furthermore, I spoke with several
American Airlines employees and Health Care professionals regarding the plane issue.
They all agreed that the airplanes would not be a problem for anyone.
One American Airlines instructor confirmed that most of the pilots request using a
different runway. He stated that the runway is not used often and very rarely will you
ever see an airplane taking off from the 13R/3 IL runway. It is mostly landing that occurs
on that runway and landing is very quiet as opposed to takeoffs. He said that only when
the winds are heavy or southerly or the preferred runways are full, will the pilots land on
that runway.
A couple of the RNs I spoke with had family members who had dementia. One
stated, "I guarantee that the residents would not have a problem with these here airplanes.
I've lived here for 12 years and have never been bothered by them. My father would love
to live by here and watch the planes fly by."
I asked if in their opinion, do they feel the planes are too noisy in this area. More
than a few times I heard back "Noise? What noise? I barely hear them at all!"
In conclusion, the majority of the surrounding neighbors to the site were all but
ecstatic for the new residents. The opinions and comments that were collected from the
neighbors stated nothing less than Autumn Leaves having absolutely no troubles or
interferences by the nearby planes. Many people stated that the traffic is noisier than the
airplanes. In fact, most of them felt the airplanes would be a positive and entertaining
feature to their residency. Again, 98% of the people I spoke with immediately
surrounding the site said that as long as there is decent insulation in the building, the
planes will not be bothersome to the residents and staff at Autumn Leaves at Grapevine.
The neighbors I spoke with are looking forward to welcoming the new residents to the
community.

ALLOW THE DEVELOPMENT OF A PERSONAL CARE
FACILITY IN A DISTRICT ZONED "CC' COMMUNITY
COMMERCIAL DISTRICT REGULATIONS ALL IN
ACCORDANCE WITH A SITE PLAN APPROVED PURSUANT
TO SECTION 47 OF ORDINANCE NO. 82-73 AND ALL
OTHER CONDITIONS, RESTRICTIONS AND SAFEGUARDS

WHEREAS, an application was made requesting issuance of a conditional use
permit by making applications for same with the Planning & Zoning Commission of the City
of Grapevine, Texas, as required by State statutes and the zoning ordinance of the City of
Grapevine, Texas, and all the legal requirements, conditions and prerequisites having been
complied with, the case having come before the City Council of the City of Grapevine,
Texas, after all legal notices requirements, conditions and prerequisites having been
complied with; and
WHEREAS, the City Council of the City of Grapevine, Texas, at a public hearing
called by the City Council did consider the following factors in making a determination as
to whether this requested conditional use permit should be granted or denied: safety of the
motoring public and the pedestrians using the facilities in the area immediately surrounding
the site; safety from fire hazards and measures for fire control; protection of adjacent
property from flood or water damages, noise producing elements, and glare of the
vehicular and stationary lights and effect of such lights on established character of the
neighborhood; location, lighting, and types of signs and relation of signs to traffic control
and adjacent property; street size and adequacy of width for traffic reasonably expected
to be generated by the proposed use around the site and in the immediate neighborhood;
adequacy of parking as determined by requirements of this ordinance for off-street parking
facilities; location of ingress and egress points for parking and off-street locating spaces,
and protection of public health by surfacing on all parking areas to control dust; effect on
the promotion of health and the general welfare; effect on light and air; the effect on the
overcrowding of the land; the effect on the concentration of population; the effect on the
transportation, water, sewerage, schools, parks and other facilities; and
WHEREAS, the subject property is located within "Zone B" Middle Zone of Effect
as defined on the "Aircraft Sound Exposure: Dallas/Fort Worth Regional Environs" map,
a status which mandates sound treatment be included in any building design, along with
the dedication of an avigation easement for the property; and
WHEREAS, the City Council of the City of Grapevine, Texas, at a public hearing
called by the City Council of the City of Grapevine, Texas, did consider the following factors
in making a determination as to whether this requested conditional use permit should be
granted or denied; effect on the congestion of the streets, the fire hazards, panics and
other dangers possibly present in the securing of safety from same, the effect on the
promotion of health and the general welfare, effect on adequate light and air, the effect on
the overcrowding of the land, the effect on the concentration of population, the effect on
the transportation, water, sewerage, schools, parks and other public facilities; and
WHEREAS, all of the requirements of Section 48 of Ordinance No. 82-73 have
been satisfied by the submission of evidence at a public hearing; and
WHEREAS, the City Council further considered among other things the character
of the existing zoning district and its peculiar suitability for particular uses and with the view
to conserve the value of buildings and encourage the most appropriate use of land
throughout this City; and
WHEREAS, the City Council of the City of Grapevine, Texas, does find that there
is a public necessity for the granting of this conditional use permit, that the public demands
it, that the public interest clearly requires the amendment, that the zoning changes do not
unreasonably invade the rights ofthose w -ho bought or Improved property with reference
to the classification which existed at the time their original investment was made; and
WHEREAS, the City Council of the City of Grapevine, Texas, does find that the
conditional use permit lessens the congestion in the streets, helps secure safety from fire,
panic and other dangers, prevents the overcrowding of land, avoids undue concentration
of population, facilitates the adequate provisions of transportation, water, sewerage,
schools, parks and other public requirements; and
WHEREAS, the City Council of the City of Grapevine, Texas, has determined that
there is a necessity and need for this conditional use permit and has also found and
determined that there has been a change in the conditions of the property surrounding and
in close proximity to the property requested for a change since this property was originally

classified and, therefore, feels that the issuance of this conditional use permit for the
particular piece of property is needed, is called for, an is in the best interest of the public
at large, the citizens of the City of Grapevine, Texas, and helps promote the general health,
safety and welfare of this community.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1. That all matters stated in the preamble are found to be true and
correct and are incorporated herein by reference as if copied in their entirety.
Section 2. That the City does hereby issue a conditional use permit in
accordance with Section 48 of Ordinance No. 82-73, the Comprehensive Zoning Ordinance
of the City of Grapevine, Texas, same being also known as Appendix "D" of the City Code,
by granting Conditional Use Permit No. CU02-47 to allow the development of a personal
care facility (Autumn Leaves) in a district zoned "CC" Community Commercial District
Regulations within the following described property: Lot 1 R-2, Southwest Grapevine
Commercial Park (southwest corner of Mustang Drive and Southwest Grapevine Parkway)
all in accordance with a site plan approved pursuant to Section 47 of Ordinance No. 82-73,
attached hereto and made a part hereof as Exhibit "A", and all other conditions,
restrictions, and safeguards imposed herein, including but not limited to the following:
A. The property owner must dedicate to the City of Grapevine, the Dallas/Fort
wt Worth International Airport Board, the City of Dallas, and the City of Fort
Worth, on the plat and by separate instrument, an avigation easement in a
form acceptable to the Dallas/Fort Worth International Airport Board, the City
of Dallas, and the City of Fort Worth.
B. No building permit shall be issued for any building on the subject property
unless the plans have been stamped and sealed by a professional or
acoustical engineer, qualified and licensed in the State of Texas, certifying
that the building to be constructed shall include sound treatment to achieve
at least 25 dB Noise Level Reduction as recommended by the FAA.
C. No Certificate of Occupancy shall be issued for any building on the subject
property unless a professional or acoustical engineer, qualified and licensed
in the State of Texas certifies that the building has been constructed in
accordance with the standard provided hereinabove in Section 2.B.
Section 3. The City Manager is hereby directed to amend the official zoning map
of the City of Grapevine, Texas, to reflect the herein conditional use permit.
Section 4. That in all other respects the use of the tract or tracts of land herein
above described shall be subject to all the applicable regulations contained in said City of
Grapevine zoning ordinance and all other applicable and pertinent ordinances of the City
of Grapevine, Texas.

Section 5. That the zoning regulations and districts as herein established have
been made in accordance with the comprehensive plan for the purpose of promoting
health, safety, morals and the general welfare of the community. They have been
designed with respect to both present conditions and the conditions reasonably anticipated
to exist in the foreseeable future; to lessen congestion in the streets; to secure safely from
fire, panic, flood and other dangers; provide adequate light and air; to prevent
overcrowding of land, to avoid undue concentration of population; facilitate the adequate
provisions of transportation, water, sewerage, drainage and surface water, parks and other
public requirements, and to make adequate provisions for the normal business, commercial
needs and development of the community. They have been made with reasonable
consideration, among other things, of the character of the district, and its peculiar suitability
for the particular uses and with a view of conserving the value of buildings and encouraging
the most appropriate use of land throughout the community.
Section 6. This ordinance shall be cumulative of all other ordinances of the City
of Grapevine, Texas, affecting zoning and shall not repeal any of the provisions of said
ordinances except in those instances where provisions of those ordinances which are in
direct conflict with the provisions of this ordinance.
Section 7. That the terms and provisions of this ordinance shall be deemed to be
severable and that if the validity of the zoning affecting any portion of the tract or tracts of
land described herein shall be declared to be invalid, the same shall not affect the validity
of the zoning of the balance of the tract or tracts of land described herein.
Section 8. Any person violating any of the provisions of this ordinance shall be
deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not
to exceed Two Thousand Dollars ($2,000.00) and a separate offense shall be deemed
committed upon each day during or on which a violation occurs or continues.
Section 9. The fact that the present ordinances and regulations of the City of
Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace
and general welfare of the inhabitants of the City of Grapevine, Texas, creates an
emergency for the immediate preservation of the public business, property, health, safety
and general welfare of the public which requires that this ordinance shall become effective
from and after the date of its final passage, and it is accordingly so ordained.
