SUBJECT: ZONING ORDINANCE AMENDMENTS TO SECTION 12,
DEFINITIONS; SECTION 24, "CN" NEIGHBORHOOD
COMMERCIAL DISTRICT; SECTION 28, "CBD" CENTRAL
BUSINESS DISTRICT; AND SECTION 60, SIGN STANDARDS
RECOMMENDATION:
Staff recommends City Council consider the following zoning ordinance amendments
and take any action necessary.
BACKGROUND:
Section 12, Definitions and Section 24, "CN" Neighborhood Commercial District
Staff has received a request from Mr. Don Kiker to amend the zoning ordinance as
necessary to allow the construction and operation of three "day cottages" on his property
located at 420 North Main Street. Mr. Kiker's property comprises approximately 17,100
square feet and has an existing frame structure that has been designated as historically
significant by the Historic Preservation Commission. Mr. Kiker's property is zoned "CN"
Neighborhood Commercial District; currently, "day cottages" or any other type of
temporary residential use is not permitted in the district. To accommodate Mr. Kiker,
Section 12, Definitions, relative to the definition of "Inn" must be modified to eliminate the
requirement for room access from common areas only. Mr. Kiker's plan calls for the
cottages to each be stand-alone structures with separate outside entry/exit to each
cottage. Section 24, "CN" Neighborhood Commercial District will also require an
amendment since no type of temporary residential use is allowed in the district. A
possible addition to the list of conditional uses allowing "Inns" as a conditional use will
allow Mr. Kiker's proposal to be considered by City Council. If the course of action
outlined is appropriate, Staff recommends City Council authorize Staff to set a public
hearing for the aforementioned zoning ordinance amendments.

0 Section 28, "CBD" Central Business District
Staff has received a request from Mr. Terry Musar, the owner/operator of Mad Duck
Adventure Sports at 816 South Main Street, to allow outside display of merchandise
such as bicycles and kayaks. This site, located at the northwest corner of South Main
Street and Dallas Road is zoned "CBD" Central Business District and has a historic
subdistrict overlay. There is approximately eight feet between the building where Mad
Duck is located and the property line to the east; to the north an open area previously
designated as a sculpture garden could also support some outside display. As the
ordinance is currently written, outside display in the "CBD" Central Business District is
not permitted. Staff receives a number of requests every year from businesses along
Main Street seeking some type of outside display of merchandise; these requests have
been denied.
Allowing outside display of merchandise in the "CBD" Central Business District has been
discussed in a Planning and Zoning Commission workshop that occurred in the fall of
2001 however, the Commission elected not to take any action relative to allowing
outside display in the district. Allowing outside display of merchandise as a conditional
use in the "CBD" Central Business District would allow Council to determine the relative
need of each request on a case-by-case basis. Staff recommends Council consider the
appropriateness of outside display in the "CBD" Central Business District and determine
a necessary course of action.
Section 60, Sign Regulations
Staff receives numerous requests throughout the year for banner signs; although these
types of signs are basically exempt from the general standards established in the
ordinance, a permit is still required and the amount of time the banner sign may be
displayed and its placement is regulated. In general, a banner sign may be displayed no
more than two weeks in any quarter of a calendar year. The Building Official has
allowed, if requested, the display of a banner sign to span the end of one quarter and
the beginning of the next—thus within a six month period of time a banner sign could be
displayed for a continuous four weeks. Banner signs are also allowed to remain for up
to 30 -days within 60 -days of the issuance of a certificate of occupancy for a new
business. If a business is going out of business, a quarterly banner sign may be
extended for a period not to exceed 30 -days. Staff regularly receives complaints that
the two-week limit per quarter on banner signs is too restrictive. Attached is a survey of
cities throughout the Metroplex and their regulations relative to banner signs. Staff
recommends City Council consider, if needed, any amendment to Section 60, Sign
Regulations relative to banner signs and direct Staff as to the appropriate course of
action.

Mad Duck Adventure Sports is a Grapevine -centric store at the far end of the Main Street Historic
District. We do not get the foot traffic of central Main Street but are still proudly part of the Historic
district. We feel we have some unique offerings for Grapevine as well as some special challenges.
We sell, service and rent custom and family bicycles and kayaks. Our focus is on supporting outdoor
activities that can be done in Grapevine and we draw customers from around the state. We love
being a part of Grapevine but have some space and marketing challenges in our current location. We
are not within the walking section of Main Street and would like to be able to visually attract visitors
from the walking section and the train depot. They tend to stop short of the area immediately south
of the train station. We would also like car traffic on Main Street and Dallas to have a clear idea of
what we sell.

We believe we can attract positive attention and enhance the look of our store by displaying pieces of
our merchandise outside, during business hours. Our site has several feet of ground between the store
and the sidewalk where specially designed stands and display structures could be placed without
interfering with the sidewalk traffic. There is also a courtyard on the non -street sides of the building
that are perfect display areas, as no foot or parking traffic goes there and the area is rather bland.
Our bikes and kayaks make a wonderful enhancement to the silver corrugated walls of our structure.
We would like to decorate this outdoor area with merchandise that is designed to be used outside, and
do not wish to display clothing or tables of smaller objects, etc. as we feel they may distract from
rather than enhance the building.
We are requesting a change in the rules governing display merchandise at our location on the corner
of Main Street and Dallas. Please let me know if I can answer any questions or you have any
