The existing roadway is a two lane asphalt rural roadway section with narrow shoulders and roadside ditches. The Grapevine / Euless City Limits Line runs down the center of the roadway. April 8, 2003 (2:47PM) The new roadway section will be a four lane divided section with landscaped median, underground storm drainage, relocated water and wastewater systems, sidewalks on both sides of the roadway, and the possibility of traffic signals at the intersections with Baze Road and Euless Grapevine Road. The proposed pavement section will mirror those of Hall Johnson Road and Pool Road. The engineering services include the preparation of water and wastewater relocation plans for both the City of Grapevine utilities as well as the City of Euless utilities. The City of Euless has committed to fund 50% of the construction costs for the project, all of the construction costs for relocating their utilities, and the acquisition of all of the right-of-way on their side of the roadway. Likewise, the City of Grapevine will fund 50% of the construction costs, all of the construction costs for relocating our utilities, the acquisition of all of the right-of-way on our side of the roadway, the design for the complete project, construction management and construction inspection. Turner, Collie & Braden has successfully completed several projects in Grapevine. The contract incorporates a design schedule of approximately 11 months which matches the schedule for the last sale of G. O. Bonds in the Spring of 2004 relative to construction funds for Glade Road. JSL O:\AGENDA\4-15-03\ ENGR CONTRACT Glade Road April 9, 2003 (1:06PM) 1 IM THE STATE OF TEXAS ) COUNTY OF TARRANT ) •ff Mwi 0119XIM11IN THIS CONTRACT is made and entered into by and between the CITY OF GRAPEVINE, a Texas municipal corporation, hereinafter referred to as "City", and Turner Collie & Braden Inc., a corporation organized and existing under the law of the State of Delaware and authorized to transact business in the State of Texas, whose local address is 1200 Summit Avenue, Suite 600, Fort Worth, Texas 76102, hereinafter referred to as "Engineer". The terms of this Contract shall be administered on behalf of the City by its Director of Public Works or his designated representative, hereinafter referred to as "Director". The decision of the City Council in all disputes shall be final and binding. WITNESSETH The City hereby contracts for the services of Engineer to prepare right-of-way maps and descriptions, construction plans, details, specifications and special provisions for Glade Road in the City of Grapevine, Tarrant County, Texas in accordance with the terms of this contract. I SCOPE OF SERVICES The Scope of Services is shown in EXHIBIT "A" attached hereto and made a part of this Contract. Submittals required for final submission, after execution of construction contract: 7 conformed sets of bluelines (22" x 34") of plans and documents 4 conformed sets of half -scale plans and documents 1 Set of Final Cross-sections (22" x 34", reproducible) O:Acontract\Glade Road Base Contract 1 1 Set of plans on CD utilizing the *.DWG format for use with AutoCAD. 11 TIME FOR COMPLETION The Time for Completion is shown in EXHIBIT "B" attached hereto and made a part of this Contract. Engineer agrees to complete and submit all work required by City under FINAL DESIGN/PLAN PREPARATION and all other work required under the contract documents within 320 calendar days after receipt of written authorization to commence said work by the Director or his designee; provided however that the time -frame may be extended or suspended due to delays in the right-of-way acquisition, reviews by agencies or franchised utilities or other such matters beyond the control of City or Engineer, with the mutual written consent of both parties. Calendar days under the contract shall be measured including weekends and holidays, but not including reviews by the City. When Engineer submits milestone documents or plans, contract time will stop. When written comments or approvals and a written notice to proceed with subsequent phases of the project are received by the Engineer, contract time will continue with the next sequential day. Services under this contract shall be accomplished in accordance with the following milestone schedule. Phase 1: Submit 30% Construction Plans - Contract Day 100 Phase 2: Submit 90% Plans and Contract Documents- Contract Day 220 Phase 3: Submit Plans and Documents for Bidding - Contract Day 320 III COMPENSATION: SPECIAL SERVICES, BASIC, AND TOTAL ENGINEERING FEE The basis of Compensation is shown in EXHIBIT "C" attached hereto and made a part of this Contract. 0:\contract\Glade Road Base Contract 2 3.1 The BASIC ENGINEERING SERVICES FEE shall provide compensation for all design work, drafting work, computations, and all other work required for the design of this project, except that work described under Section 3.5. below. 3.2 The basis of compensation for Basic Engineering Services shall be Lump Sum. Also, non -salary expenses shall be paid under said SPECIAL SERVICES FEE for reproduction costs, computer services, communication charges and pre -authorized delivery charges as required for execution of the design of all Phases of this project. 3.6 The basis for compensation for the above shall be hourly service rates. In no event shall the maximum SPECIAL SERVICES FEE exceed one hundred sixty thousand four hundred seventy dollars ($160,470) regardless of the amount of work required. 3.7 Payment for Special Services shall be on the basis of actual progress, invoiced monthly to the City. 0:\contract\Glade Road Base Contract 4 3.8 For the purpose of budgeting, the separate major elements of Special Services are estimated as follows: Element Estimated Cost Topographic Surveys $ 19,800. Total $160,470. 3.9 No items of work will be included in the SPECIAL SERVICES FEE for compensation except those items described in EXHIBIT "A", Section 3.0 Special Services of this contract. 3.10 The TOTAL ENGINEERING FEE shall be the sum of the SPECIAL SERVICES FEE and the BASIC ENGINEERING SERVICES FEE. The TOTAL ENGINEERING FEE for this Contract shall not exceed five hundred forty-eight thousand nine hundred ninety dollars ($548,990). IV OWNERSHIP OF DOCUMENTS Upon acceptance and approval by City of services provided under EXHIBIT "A", Section 2.0, mylar record copies of original tracings, cross sections, preliminary plans, special provisions, field notes, and any other related documents or items shall become the sole property of the City of Grapevine and shall be delivered to City, without restriction on future use. Engineer may make copies of any and all plans, cross sections, field notes, and related documents for his files. Engineer shall have no liability for changes made to or O:\contract\Glade Road Base Contract 5 subsequent use of the drawings, specifications, and other documents by others after completion of the Project. City shall require that any such change or other use shall be sealed by the engineer making that change or use and shall be appropriately marked to reflect what was changed or modified. V 5.1 After acceptance of the final plans and special provisions by City, Engineer agrees, prior to and during the construction of this project, to perform such engineering services as may be required by City to correct errors or omissions on the original plans prepared by Engineer and to change the original design as required by such errors or omissions at no additional compensation. 5.2 Redesign occasioned for the convenience of the City shall be at additional compensation for Engineer. Any additional compensation shall be as negotiated between Engineer and City and agreed upon in a separate or supplemental contract after authorization by of the City Council. 5.3 Acceptance and approval of the final plans by the City shall not constitute nor be deemed a release of this responsibility and liability of Engineer, its employees, associates, agents, subcontractors and consultants for the accuracy and competency of their Designs, Working Drawings and Specifications, or other Documents and work; nor shall such approval be deemed to be an assumption of such responsibility by the City for any defect in the Designs, Working Drawings and Specifications or other Documents prepared by Engineer, its employees, associates, subcontractors, agents and consultants. 5.4 Engineer agrees to defend, indemnify and hold City, its officers, agents and 0:\contract\Glade Road Base Contract 6 employees, harmless against any and all claims, lawsuits, judgments, costs and expenses including attorney's fees and collection costs for personal injury (including death, property damage or other harm for which recovery of damages is sought) that may arise out of or be occasioned by the intentional or negligent breach of any of the terms or provisions of this Contract by Engineer, its officers, agents, associates, employees or subconsultants, or by any other negligent act or omission of Engineer, its officers, agents, associates, employees or subconsultants, in the performance of this Contract; except that the indemnity provided for in this paragraph shall not apply to any liability resulting from the sole negligence of City, its officers, agents, employees or separate contractors, and in the event of joint and concurrent negligence of both the Engineer and City, responsibility, if any, shall be apportioned comparatively in accordance with the laws of the State of Texas, without, however, waiving any governmental immunity available to the City under Texas law and without waiving any defenses of the parties under Texas law. The provisions of this paragraph are solely for the benefit of the parties hereto and not intended to create or grant any rights, contractual or otherwise, to any other person or entity. VI L�� Engineer, at Engineer's sole cost, shall purchase and maintain the following minimum insurance during the term of this Contract: 6.1 Worker's Compensation and Employers' Liability. This insurance shall protect the Engineer against all claims under applicable state workers' compensation laws. The insured shall also be protected against claims for injury, disease, or death of employees which, for any reason, may not fall within the provision of a workers' compensation law. This policy shall include an all -states endorsement. The liability limits shall not be less than: OAcontract\Glade Road Base Contract 7 M 6.3 =I Workers' Compensation Employers' Liability Statutory $500,000 Comprehensive General Liability. This insurance shall be an occurrence type policy written in comprehensive form and shall protect the Engineer and the additional insureds against all claims arising from bodily injury, sickness, disease or death of any person other than the Engineer's employees or damage to property of the City of Grapevine or others arising out of the act or omission of the Engineer or Engineer's agents, employees, or subcontractors. This policy shall also include protection against claims insured by usual personal injury liability coverage, a (protective liability) endorsement to insure the contractual liability, broad form property coverage, xcu, premises/operations, and independent contractors. Bodily Injury $1,000,000 per occurrence Property Damage $2,000,000 aggregate This insurance shall be written in the comprehensive form and shall protect the provider, the Engineer and the additional insured against all claims for injuries to members of the public and damage to property of others arising from the use of motor vehicles, and shall cover operation on and off the site of all motor vehicles licensed for highway use, whether they are owned, non -owned, or hired. The liability shall not be less than: Bodily Injury/Property Damage $1,000,000 Combined Single Limit Professional Liability. Coverage of not less than $1,000,000.00 single limit. The Engineer shall maintain coverage for at period of no less than two (2) years from the date of project completion. 0:\contract\Glade Road Base Contract 8 6.5 The cost of all insurance required herein to be secured and maintained by Engineer shall be borne solely by Engineer, with certificates evidencing such minimum coverage in force to be filed with the City. Such certificates shall provide that City shall receive 30 days prior written notice of any cancellation, change or reduction in coverage. VII CONTRACT TERMINATION In connection with the work outlined in this Contract, it is agreed that the Director may cancel or indefinitely suspend further work by written notice to Engineer with the understanding that immediately upon receipt of said notice all work and labor being performed under this contract shall cease immediately. Before the end of a thirty (30) day period following such notice, Engineer shall invoice the City for all work completed and shall be compensated in accordance with the terms of this Contract for all work accomplished by Engineer prior to the receipt of said notice, and approved by Director. No payment shall be made by City to Engineer for lost or anticipated profits. All plans, field surveys, maps, cross sections and other data related to the project shall become the property of City upon termination of this Contract. Nothing herein shall deprive City of its right to terminate this Contract for breach of same by Engineer and City retains its right to any and all remedies it may have, at law or at equity, to strictly enforce the terms of this Contract, included, but not limited to, its right to seek specific performance of the terms hereof. In case of any default by Engineer, City shall notify Engineer in writing of same. If Engineer does not remedy the default within ten (10) days of said notice, City may terminate this Contract for cause and/or pursue any legal remedy it may have against Engineer. VIII APPLICABLE LAW AND VENUE O:\contract\Glade Road Base Contract 9 This Contract is entered into subject to the Charter and Ordinances of the City of Grapevine, as amended and applicable Federal and Texas State laws. The provisions of this Contract shall be construed in accordance with the laws and court decisions of Tarrant County and the State of Texas; and exclusive venue for any litigation which may be filed by either party hereto in connection with this Contract shall be in Tarrant County, Texas. W ASSIGNMENT This Contract shall be deemed personal to Engineer and in no event shall be sublet or assigned without written approval of City. EN I •- Engineer agrees that City may review any and all work performed by Engineer on this project. The relationship of Engineer to City is that of Independent Contractor. XI As a condition of this Contract, Engineer covenants that he will take all necessary actions to insure that, in connection with any work under this Contract, Engineer, his associates and subcontractors, will not discriminate in the treatment or employment of any individual or groups on the grounds of race, color, religion, national origin, age, sex, or handicap unrelated to job performance, either directly, indirectly, or through contractual or other arrangements. In this regard, Engineer shall keep, retain and safeguard all records relating to this Contract or work performed hereunder for a minimum period of three (3) years from final Contract completion, with full access allowed to authorized representatives of the City, upon request, for purposes of evaluating compliance with this and other provisions of the 0:\contract\Glade Road Base Contract IM Contract. M FINANCIAL INTEREST PROHIBITED Engineer covenants and represents that Engineer, its officers, employees, agents, consultants and subcontractors will have no financial interest, direct or indirect, in the purchase or sale of any product, materials or equipment that will be recommended or required for the construction of the project. X111 The Engineer shall maintain, and the City shall have the right to examine books, records, documents, and other evidence and accounting procedures and practices, sufficient to reflect properly all direct and indirect costs of whatever nature claimed to have been incurred and anticipated to be incurred in the performance of this Contract. Such right of examination shall include inspection at all reasonable times of the Engineer's offices or facilities, or such parts thereof, as may be engaged in the performance of this Contract. XIV NOTICES All written notices and correspondence given to City by Engineer shall be mailed or delivered to the City of Grapevine, Director of Public Works, 200 South Main Street, P.O. Box 95104, Grapevine, Texas 76099. All written notices and correspondence from City to Engineer shall be mailed or delivered to the Engineer as follows: Mr. Phillip G. Reach EXHIBIT "A" GLADE ROAD RECONSTRUCTION SCOPE OF SERVICES 0.0 GENERAL 0.1 Project Description This project consists of the design of approximately 5,700 if of four -lane divided roadway, including storm drainage system, illumination, landscaping, and related improvements, from east of SH 121 to SH 360. The project is partially in the City of Grapevine and partially in the City of Euless. The project will include the following features. • Approximately 5,700 if of four lane divided concrete roadway with curb and gutter. • Intersection improvements to the Baze Road and Euless -Grapevine Road intersections. • Drainage plans for a closed drainage system. • Utility relocation plans. • Traffic Control Plans for construction. • Permanent Striping Plans. • Illumination Plans. • Warrant studies for the Baze Road and Euless -Grapevine Road intersections. • Landscaping plans. 0.2 Design Standards Design and preparation of constriction drawings and technical specifications required for the project will be in accordance with the following standards. a. City of Grapevine Design Standards b. AASHTO Design Standards C. TxDOT Design Standards (signalization) d. Architectural Barriers Act (sidewalks and wheelchair ramps) e. EPA and FEMA Regulations (environmental and drainage) 1.0 Basic Services Phase 1 — Roadway Plans 1.1 Data Collection a. Existing Utilities and Underground Facilities (1) Provide a list to the City of as -built street, water, sanitary sewer, and storm sewer plans needed for design (City to provide hard copy plans). City of Grapevine — Scope of Services 4/10/2003 Glade Road Reconstruction (2) Obtain plans on existing power, telephone, cable television, long distance communications, and natural gas. b. Obtain GPS coordinate data from the City. c. Meet with City personnel to assess other planned improvements. 1.2 Roadway Plans a. Typical Sections Typical sections will be developed for various locations along the alignment to reflect proposed roadway pavement, base, and subgrade thickness, pavement materials, cross - slopes, and embankment slopes. b. Roadway Plan & Profile Plan and Profile sheets will be provided at a 1" = 20' horizontal and 1"= 4' vertical scales. Roadway plan & profile sheets will contain the following information: ■ Curb lines; ■ Proposed roadway profile grades and elevations; ■ Existing ground at the right and left right-of-way lines; ■ Driveways; ■ Medians; ■ Sidewalks; ■ Retaining walls; ■ Elevations at all p.v.i.'s, p.i.'s, p.c.'s, p.t.'s, half stations, high and low points; Vertical curve information; ■ Limits of grading and limits of easement; and ■ Existing found property corners along the existing right-of-way. c. Surface Drainage and Storm Sewer Design Based on the corridor hydraulic studies, inlets will be located and storm sewers sized to accommodate the design storm. The storm sewer system for the roadway will be developed and shown on drainage plan and profile sheets. Pipe sizes, grades, and hydraulic data will be shown. Storm drain pipe and inlet computations will also be shown in tabular form. d. Utility Drawings Utility drawings will be prepared for relocation of City of Grapevine and City of Euless utilities. Drawings will be prepared for the City of Grapevine 12" water main and 8" sanitary sewer and for the City of Euless 12" water main. Plan / profile format will be used to show required detail. Drawings will be prepared in accordance with City standards. Euless water line plans will be prepared in accordance with Euless standards. City of Grapevine - Scope of Services 4/10/2003 Glade Road Reconstruction Page 2 e. Signing & Pavement Marking Permanent pavement marking plans will be prepared. Permanent signing plans will be prepared by the City of Grapevine. f. Illumination Plans Illumination plans will include the proposed location of pole foundations and conduits, with appropriate pole foundation details. g. Cross Sections Cross-sections will be developed at intervals not -to -exceed 50 feet along the project length and will extend a minimum of 10 feet past the right-of-way line on both sides of the street. Additional cross-sections at important features including driveways, p.i.'s of intersecting streets, retaining walls, etc., will also be provided. Profiles of centerline of driveways will also be provided where necessary. Cut and fill volumes and end area computations shall also be provided. 1.3 Cost Estimates - Update estimate of projected construction costs at 30% and 60% plans. 1.4 Plan Review — 30% Complete a. Meet with City of Grapevine and Euless staff to review 30% complete plans. b. Address Cities comments. 1.5 Plan Review — 60% Complete a. Meet with City of Grapevine and Euless staff to review 60% complete plans. b. Address Cities comments. 1.6 Construction Drawings and Contract Documents a. Prepare construction plans suitable for bidding and construction. b. Prepare bid documents and contract documents. c. Develop any special specifications required for project not covered by standard specifications. d. Prepare executed and conformed contract documents for use during construction. City of Grapevine - Scope of Services 4/10/2003 Glade Road Reconstruction Page 3 0 2.0 Basic Services Phase 2 - Bidding and Construction 2.1 Bidding The Engineer will provide sufficient copies of the contract documents for bidding. The cost of printing the documents will be recovered through charging for copies. It is assumed that the City of Grapevine will advertise the project. The Engineer will distribute contract documents to contractors and plan rooms; maintain a plan holders list; and issue addenda, if required. The Engineer will attend the pre-bid meeting and the bid opening; tabulate bids received; and issue a Recommendation of Award. After award of contract, prepare executed contract documents and conformed documents. 2.2 Construction Phase Services Attend the Pre -construction Meeting to respond to questions. Make a maximum of 18 site visits during construction to observe construction. Review and make recommendations on shop drawing submittals. Respond to requests for information as needed; and prepare change orders if necessary to clarify the intent of the plans. Recommend final acceptance of the project at the completion of construction; and prepare record drawings based on marked up plans supplied by the City. 3.0 Special Services 3.1 Topographic Survey a. Abstract existing property owners along the alignment of the proposed road from SH 121 to SH 360. Abstracting will include deeds and recorded plats. b. Use City of Grapevine GPS monuments to establish horizontal and vertical control for the project. c. Perform topographic and planimetric surveys along the proposed alignment. d. Determine horizontal and vertical locations at manholes, valve boxes, and other surface evidence of underground utilities. e. Obtain field ties to property corners to compute the existing right-of-way. f. Prepare right-of-way map for the proposed right-of-way along the alignment, showing the adjacent ownership. g. Deliverables will be a complete topographic survey and right-of-way map in hard copy and digital file for project. Copies of all deeds and recorded plats will also be delivered. h. Provide up to ten right-of-way metes and bounds descriptions, including exhibits. Set parcel corners with 5/8 inch iron rods. Stake proposed centerline at 500 foot intervals and at PI's, PC's and PT's. j. Stake centerline of relocated water lines. 3.2 Public Meetings Attend up to three public meetings, which the City of Grapevine will hold to make the public aware of the project and to solicit public comments. The Engineer will provide graphics for the meetings, based on the construction plans for the project, and attend the meetings. The City will arrange for and conduct the meetings. 3.3 Geotechnical Investigation The Engineer will provide geotechnical services required to evaluate subsurface conditions in the areas of the proposed roadway. Ten (10) borings will be performed along the length of the proposed roadway. The borings will be advanced to a depth sufficient to evaluate the subgrade conditions for pavement. The boring locations will be staked and locations will be cleared for conflicts with underground utilities. The soils will be classified with liquid limit, plastic limit tests, plasticity limits, and moisture contents. Hand penetrometer tests are planned to evaluate the strength characteristics of the soil. Unconfined compressive strength tests will be performed on samples of soil and rock. Absorption swell and controlled swell tests are planned to evaluate the volume change potential of the soil. Sulfate content and lime series tests will be performed, if lime treatment is chosen for the roadway subgrade. The pH test (also referred to as the Eades and Grimm method) will also be used to determine the optimum amount of lime for lime treatment. The results of the field and laboratory data will be summarized in an engineering report. The report will include recommendations to guide design and construction of the road structure. 3.4 Corridor Hydraulic Analysis Coordinate with the City of Euless to obtain existing and future conditions drainage information relating to areas within the City of Euless pertinent to the proposed roadway project. Develop existing conditions and design conditions discharges for the outfall drainage systems and proposed internal storm drains to serve the proposed roadway. Conduct outfall system hydraulic studies to establish starting conditions for hydraulic design of the proposed internal storm drain system. Also evaluate the potential impact of the proposed roadway and its drainage systems on downstream drainage and flooding conditions. Specifically regarding these outfall systems: City of Grapevine - Scope of Services 4/10/2003 Glade Road Reconstruction Page 5 ■ Conduct a backwater analysis of the channel discharging south into Euless near the Mulberry Blvd. intersection to establish drainage outfall conditions. Identify any improvements or mitigation measures necessary to provide adequate drainage of the Glade Road widening project or mitigate drainage impacts of this project. • Conduct a hydraulic analysis of the existing storm drain system discharging south into Euless near the Cambridge Court intersection to establish drainage outfall conditions. Identify any improvements or mitigation measures necessary to provide adequate outfall drainage of the Glade Road Widening project or to mitigate drainage impacts of this project. • Conduct a backwater and storm drain analysis of the outfall drainage system discharging northeasterly near the Euless -Grapevine Road intersection to establish drainage outfall conditions. Identify any improvements or mitigation measures necessary to provide adequate drainage to the Glade Road Widening Project. Prepare a technical memorandum summarizing the outfall drainage studies including recommendations for improvements to be designed and constructed under separate authorizations. Determine erosion control requirements for storm sewer or culvert outfalls. Prepare Drainage Area Map and Hydraulic Data sheets for construction plans. 3.5 Traffic Signal Warrant Study and Signal Plans Perform warrant studies and prepare a technical memorandum for the intersections at Baze Road, Euless -Grapevine Road, the southbound SH 360 frontage road, and the northbound SH 360 frontage road, in accordance with TxDOT standards. If warrant studies show that signals are warranted, plans and details will be prepared for permanent traffic signals at the Baze Road and Euless -Grapevine Road intersections. Plans will include location of all existing and proposed facilities including signal poles, underground conduit, detectors, pull boxes, controllers, circuit wiring, signal heads, and electrical sources. 3.6 Landscaping Design Based on 30% roadway plans, develop a schematic landscape plan, including recommendations for potential tree preservation or relocation; development of typical landscape planting schemes for the right of way, medians and intersections; and development of recommendations for typical hardscape improvements at the two intersections. Recommendations for portal development or private subdivision walls are not included. Based on City comments on the schematic landscape plan, develop construction documents, specifications, and estimates for median planting, limited right of way planting, and intersection corner planting. Limited irrigation design will also be included. Prepare City of Grapevine - Scope of Services 4/10/2003 Glade Road Reconstniction Page 6 any special specifications required for the work, and prepare construction cost estimates at each submittal. 4.0 Information To Be Provided By The City 1. Provide City's plat, easement and plan files. 2. Provide available previous studies for the project. 3. Notify residents, establish time and location, and make arrangements for public meetings. 4. Provide right -of -entry and access along the right-of-way and existing easements. Notify residents in the area of the pending survey work. Provide access to private properties adjacent to the proposed alignment as required to obtain the required topographic survey, geotechnical investigations, and environmental assessment. Box 95 104 Grapevine, Texas 76099 Dear Roger: Well, the new fiscal year is under way, and that nieans our Glade Road project si1ouidn't be fay behind. We look forward to working with the City of Grapevine on this joint project. I am including my thoughts as to how we will progress, however, we will definitely need to formalize these suggestions with a City Council approved inter -local agreement. We have budgeted funds for ROW acquisition during 2003. If the ROW maps are not available, we will wait, however, we have a window of time available for ROW acquisition during 2003. We plan to budget for utility relocation in the 2004 budget, and will commit to our half of the construction cost, not to exceed your estimate of $1,799,000.00. We are still not certain of the most favorable mechanism for paying our half of the construction costs, but \r ill determine that in the near future as we begin our inter -local agreement preparation. We appreciate your offers of assistance and will keep those under consideration as we formalize our agreement. Roger, it is our hope that construction would begin by spring of 2004, with completion 12-1 months later. Since it sounds as though your schedule may not accomplish that desired time line, would you respond with your estimated time line for completion? We took forward to moving forward with this project.
