Tate Ted R. Ware Sharron Spencer C. Shane Wilbanks Clydene Johnson Roy Stewart Darlene Freed Mayor Mayor Pro Tem Council Member Council Member Council Member Council Member Council Member constituting a quorum, with the following members of the City Staff: Roger Nelson Bruno Rumbelow John F. Boyle, Jr. Linda Huff Melisa Leal Jennifer Hibbs CALL TO ORDER City Manager Assistant City Manager City Attorney City Secretary Assistant to the City Manager Assistant to the City Manager Mayor Tate called the meeting to order at 7:10 p.m. ITEM 1. EXECUTIVE SESSION Mayor Tate announced the City Council would conduct a closed session regarding: (A) real property relative to public parking on South Main Street; (B) conference with City Manager and Staff to discuss and deliberate commercial and financial information received from business prospects the City seeks to have locate and expand in the City; with which businesses the City is conducting economic development negotiations under Sections 551.072 and 551.087, Texas Government Code. Upon reconvening in open session in the Council Chambers, Mayor Tate asked if there was any action necessary relative to the closed session. City Manager Roger Nelson stated there was no action necessary relative to the closed session under Section 551.087, Texas Government Code. 05/06/03 "In Regarding real property, City Manager Nelson requested authorization for the City Manager to deposit $348,000.00 with the Registry of the Court relative to the Foust case. Council Member Spencer, seconded by Council Member Stewart, offered a motion authorizing the City Manager to deposit $348,000.00 with the Registry of the Court relative to the Foust case. The motion prevailed by the following vote: Ayes: Tate, Ware, Spencer, Wilbanks, Johnson, Stewart & Freed Nays: None NOTE: City Council continued with the Regular City Council meeting in open session in the Council Chambers. ADJOURNMENT Council Member Wilbanks, seconded by Council Member Stewart, offered a motion to adjourn the meeting at 8:00 p.m. The motion prevailed by the following vote: Ayes: Tate, Ware, Spencer, Wilbanks, Johnson, Stewart & Freed Nays: None PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS on this the 20th day of May, 2003. ITEM 1. PRESENTATION, PROCLAMATION NATIONAL POLICE WEEK AND NATIONAL PEACE OFFICERS' MEMORIAL DAY Mayor Tate presented a proclamation to Police Chief Dale Wilkins declaring the week of May 11-17, 2003 as National Police Week honoring Police Officers, past and present, who by their devotion to their responsibilities have rendered a dedicated service to their communities in preserving the rights and security of all citizens, Mayor Tate declared May 14 as Peace Officers' Memorial Day in honor of those peace officers who, through their courageous deeds, have lost their lives or have become disabled in the performance of duty. ITEM 2. PRESENTATION, PROCLAMATION FOLEY, ALABAMA FESTIVAL EXCHANGE WEEKEND 05/06/03 wail Mayor Tate presented a proclamation to Main Street Days Chairman, Mike Hooker, declaring May 16-18, 2003 as Foley, Alabama Festival Exchange Weekend. Foley, Alabama will bring their Heritage Harbor Days Festival to Main Street Days to share their gulf coast heritage with festival attendees. In November, the City of Grapevine will take elements of GrapeFest to Foley to complete the exchange. This festival exchange brings an added element of interest to both festivals as well as an opportunity to educate school children and festival attendees on cultural aspects unique to this gulf coast area. ITEM 3. RESOLUTION, CANVASS CITY OFFICER ELECTION City Secretary Linda Huff reported there are 25,954 registered voters in the City and that 929 valid votes were cast in the 2003 City Officer election for Mayor, Places 1 and 2 as follows: Mayor William D. Tate 818 Place 1 John Kutch 173 C. Shane Wilbanks 713 Place 2 Sharron Spencer 728 Jason R. Elms 193 Ms. Huff requested approval of the resolution declaring the results of the 2003 City Officer election. Council Member Wilbanks, seconded by Council Member Johnson, offered a motion to adopt the resolution declaring the results of the 2003 City Officer election as follows: Mayor — William D. Tate; Council Member, Place 1 — C. Shane Wilbanks and Council Member, Place 2 — Sharron Spencer. The motion prevailed by the following vote: Ayes: Tate, Ware, Spencer, Wilbanks, Johnson, Stewart & Freed Nays: None RESOLUTION NO, 2003-15 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS DECLARING THE RESULTS OF THE 2003 CITY OFFICER ELECTION AND PROVIDING AN EFFECTIVE DATE ITEM 4. OATH OF OFFICE City Secretary Huff administered the Oath of Office to Mayor William D. Tate; Council Member, Place 1, C. Shane Wilbanks; and Council Member, Place 2, Sharron Spencer. CONSENT AGENDA The next order of business for the City Council to consider was the consent agenda items, 05/06/03 which were deemed to need little or no discussion and were acted upon as one business item. Mayor Tate asked if there was any member of the audience or the City Council who wished to remove an item from the consent agenda for full discussion. There were none. Item 5. Lease Agreement, Convention & Visitors Bureau and Russell Anderson Convention & Visitors Bureau Director recommended approval of a 36.5 month lease agreement with an option to renew for an additional 36 months between the Grapevine Convention & Visitors f3ureau and Russell Anderson in the amount of $2,000 per month for property located at 118 West Dallas Road. Motion by Mayor Pro Tern Ware, seconded by Council Member Freed, to approve as recommended prevailed by the following vote: Ayes: Tate, Ware, Spencer, Wilbanks, Johnson, Stewart & Freed Nays: None Item 6. Modify Fee Schedule, Corps of Engineers Property Parks & Recreation Director recommended approval of modifications to the fee schedule for City -leased Corps of Engineers property at Lake Grapevine relative to cabin rental, camping and daily park entrance fee. Motion by Mayor Pro Tern Ware, seconded by Council Member Freed, to approve as recommended prevailed by the following vote: Ayes: Tate, Ware, Spencer, Wilbanks, Johnson, Stewart & Freed Nays: None Item 7. Ordinance, Abandon Sanitary Sewer Easement, Western Oaks Estates, Section III Public Works Director recommended approval of an ordinance abandoning a ten -foot sanitary sewer easement located within Lot 4R, Block A, Western Oaks Estates, Section Ill. Motion by Mayor Pro Tern Ware, seconded by Council Member Freed, to approve as recommended prevailed by the following vote: Ayes: Tate, Ware, Spencer, Wilbanks, Johnson, Stewart & Freed Nays: None ORDINANCE NO. 2003-28 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, ABANDONING AND VACATING A PORTION OF A TEN FOOT SANITARY SEWER EASEMENT 3 05/06/03 AS HEREINAFTER DESCRIBED; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE Item 8. Contract, 2003 Utilities Proiect Engineering Services Eng-ineerin_q, Pacheco Koch Consulting Engineers Public Works Director recommended approval of the award of an engineering services contract to Pacheco Koch Consulting Engineers in an amount not to exceed $147,000.00 for the design of the 2003 Utilities Project and authorize Staff to execute said contract. Motion by Mayor Pro Tern Ware, seconded by Council Member Freed, to approve as recommended prevailed by the following vote: Ayes: Tate, Ware, Spencer, Wilbanks, Johnson, Stewart & Freed Nays: None Item 9. Renew Bid 121-2002 Material Disposal Services Annual Contract Public Works Director recommended approval of the renewal of Bid 121-2002 Material Disposal Services Annual Contract to Shred -Tech d.b.a. Sego, Inc. as primary vendor and Airport Sand and Gravel as secondary vendor. Motion by Mayor Pro Tern Ware, seconded by Council Member Freed, to approve as recommended prevailed by the following vote: Ayes: Tate, Ware, Spencer, Wilbanks, Johnson, Stewart & Freed Nays: None Item 10. Renew Bid 123-2002 Vegetation Management Services Annual Contract Parks & Recreation Director recommended renewal of Bid 123-2002 Vegetation Management Services Annual Contract to TruGreen Chemlawn as primary vendor and Spraymax as secondary vendor. Motion by Mayor Pro Tern Ware, seconded by Council Member Freed, to approve as recommended prevailed by the following vote: Ayes: Tate, Ware, Spencer, Wilbanks, Johnson, Stewart & Freed Nays: None Item 11. Renew Bid 117-2002 Equipment Rental Annual Contract Public Works Director recommended approval of the renewal of Bid 117-2002 Equipment Rental Annual Contract to RSC Rental, Briggs Rental, Fox Rental, Holt Rental (previously Darr Rental) and Nations Rent. Motion by Mayor Pro Tern Ware, seconded by Council Member Freed, to approve as recommended prevailed by the following vote: Ayes: Tate, Ware, Spencer, Wilbanks, Johnson, Stewart & Freed Nays: None Item 13. Award Bid 153-2003 Asphalt Material Annual Contract Public Works Director recommended approval of the award of Bid 153-2003 Asphalt Material Annual Contract to Southern Asphalt and Petroleum. Motion by Mayor Pro Tern Ware, seconded by Council Member Freed, to approve as recommended prevailed by the following vote: Ayes: Tate, Ware, Spencer, Wilbanks, Johnson, Stewart & Freed Nays: None Item 14. Renew Fire Protective Clothing Annual Contract Fire Chief recommended approval of the renewal of the Fire Protective Clothing Annual Contract to Casco Industries, Inc. Motion by Mayor Pro Tern Ware, seconded by Council Member Freed, to approve as recommended prevailed by the following vote: Ayes: Tate, Ware, Spencer, Wilbanks, Johnson, Stewart & Freed Nays: None Item 15. Renew Bid 86-2001 Traffic Control Material Annual Contract Public Works Director recommended approval of the renewal of Bid 86-2001 Traffic Control Material Annual Contract to Roadrunner Traffic, Naztec, ACM Highway Products, Flint Trading, Consolidated Traffic Controls, 3M Products, Vulcan Signs, Hall Signs, U. S. Traffic 5 05/06/03 Corp. and H&H Industries. Motion by Mayor Pro Tern Ware, seconded by Council Member Freed, to approve as recommended prevailed by the following vote: Ayes: Tate, Ware, Spencer, Wilbanks, Johnson, Stewart & Freed Nays: None Item 16. Award Bid 152-2003 Police Uniform Cleaning Services Police Chief recommended award of Bid 152-2003 Police Uniform Cleaning Services to Metro Cleaners. Renew Bid 47-2000 Park Janitorial Facility Services Annual Contract Parks & Recreation Director recommended approval of the renewal of Bid 47-2000 Park Janitorial Facility Services Annual Contract to Mary Lou Gilmore. Motion by Mayor Pro Tern Ware, seconded by Council Member Freed, to approve as recommended prevailed by the following vote: Ayes: Tate, Ware, Spencer, Wilbanks, Johnson, Stewart & Freed Nays: None Item 18. Award Bid 150-2003 Material Haulinq Annual Contract Public Works Director recommended approval of the award of Bid 150-2003 Material Hauling Annual Contract to Rocha Trucking, Inc.; Wright Environmental Services; McCauley Dirt Company and Diaz Trucking. Motion by Mayor Pro Tern Ware, seconded by Council Member Freed, to approve as recommended prevailed by the following vote: Ayes: Tate, Ware, Spencer, Wilbanks, Johnson, Stewart & Freed Nays: None Item 19.
