HARDY, DIRECTOR OF DEVELOPMENT SERVICES , -.\ MEETING DATE: JULY 15, 2003 SUBJECT: DEVELOPMENT SERVICES TECHNICAL REPORT OF ZONE CHANGE APPLICATION Z03-05 AND CONDITIONAL USE APPLICANTION CU03-24 \---Z------------ Grapevine Do Lake i APPLICANT: Laney Newman and Kristen Newland PROPERTY LOCATION AND SIZE: The subject property is located at the southeast corner of Ira E. Woods Avenue and Pool Road and is proposed to be platted as Lots 1 R1, Lot 1 R2, and 1R3, S.H. 26 and Pool Road Addition. The site contains approximately 7.352 acres and has approximately 7800 feet of frontage along Pool Road. REQUESTED ZONE CHANGE/CONDITIONAL USE AND COMMENTS: The applicant is requesting a zone change to rezone 5.823 acres from "CN" Neighborhood Commercial District and 1.529 acres from "PO" Professional Office District to "CC" Community Commercial District for development of a personal care facility and general office/retail development with deed restrictions limiting uses to those permitted and conditional uses in the "PO" Professional Office District and N" Neighborhood Commercial District. The applicant is also seeking a conditional use permit to allow for the development of a personal care facility. The applicant rezoned the subject property in December 2002 in an effort to market the property to potential office and small retail users. With this request the applicant is seeking to rezone a total of 7.352 acres to "CC" Community Commercial District for a personal care facility. Although personal care facilities are allowed as a conditional use in the zoning 0:\ZCU\Z03-05.4 & CU03-24 1 July 8, 2003 (8:22AM) Professional Office District and the "CN" Neighborhood Commercial District are problematic for the personal care provider. A rezoning to "CC" Community Commercial District will allow a height of 50 -feet, provided a buffer exists between the subject property and the "R-7.5" Single Family District property to the south. The personal care provider has shown as a part of their conditional use request a structure that is 35 -feet in height. In addition to the zone change request, a conditional use request to establish a 115 -bed personal care facility is also being submitted. An 80 -foot by 400 -foot portion of the "PO" Professional Office District (approximately 32,000 square feet) has been retained to provide a buffer between the "R-7.5" Single Family District property to the south and the subject property. Without this buffer, no structure could be built that would exceed one floor level or 25 -feet in height. In an effort to assure the surrounding property owners and the City Council/Planning & Zoning Commission of his intent, the applicant has voluntarily submitted deed restrictions as a part of the rezoning request limiting the uses on the property to those uses allowed as permitted or conditional uses in the "PO" Professional Office District and the "CN" Neighborhood Commercial District. PRESENT ZONING AND USE: The property is currently zoned "CN" Neighborhood Commercial District and "PO" Professional Office District and is undeveloped. HISTORY OF TRACT AND SURROUNDING AREA: The subject property was zoned 1-1" Light Industrial District and "C-2" Community Business District prior to the 1984 City Rezoning. A conditional use permit (CU86-07) was granted in 1986 for a convenience store with gasoline sales and off -premise alcohol beverage sales (Seven -Eleven) at the southwest corner of Pool Road and Ira E. Woods Avenue but was never constructed. A zone change request (Z98-23) to rezone the entire site to "CC" Community Commercial District was denied at the October 20, 1998 meeting. A subsequent conditional use request (CU99-20) to develop the site as a planned commercial center with a grocery store with off -premise alcohol beverage sales and convenience store with gasoline sales and off -premise alcohol beverage sales was denied at the August 17, 1999 meeting. At the December 19, 2000 meeting Council considered and denied both a conditional use request and zone change request on the subject site. The applicant at that time was requesting a conditional use permit to establish a planned commercial center and allow the possession, storage, retail sale and off -premise consumption of alcoholic beverages (beer and wine only) in conjunction with a grocery store and allow gasoline sales and the possession, storage, retail sale, and off -premise consumption of alcoholic beverages (beer and wine only) in conjunction with a convenience store. That same applicant was also requesting a zone change to rezone 2.586 acres from "HC" Highway Commercial District, 0AMU203-05.4 & CU03-24 2 July 9, 2003 (9:54AM) possession, storage, retail sale, and off -premise consumption of alcoholic beverages (beer and wine only) in conjunction with a convenience store. That same applicant was also requesting a zone change to rezone 2.586 acres from "HC" Highway Commercial District, 5.594 acres from "CN" Neighborhood Commercial District, and 3.504 acres from "PO" Professional Office District to "CC" Community Commercial District for development of a retail shopping center. At the December 17, 2002 meeting Council approved a rezoning on the subject tract (Z02-07) rezoning 0.72 acres from "HC" Highway Commercial District and 5.10 acres from "PO" Professional Office District to "CN" Neighborhood Commercial District for future development. Council accepted without prejudice the property owner's request to withdraw a conditional use application for a 115 -bed personal care facility and a zone change application to rezone approximately 7.794 acres from "PO" Professional Office District and "CN" Neighborhood Commercial District (CU03-16 & Z03-03) at the June 17, 2003 meeting. SURROUNDING ZONING AND EXISTING LAND USE: NORTH: "HC" Highway Commercial District—CVS Pharmacy, City of Southlake SOUTH: "PO" Professional Office District --vacant EAST: "HC" Highway Commercial District and "GU" Governmental Use District—Hansome Hank's Shell and Grapevine High School WEST: "CN" Neighborhood Commercial District—vacant The subject tract is located within "Zone A" zone of minimal effect as defined on the "Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" map. Few activities will be affected by aircraft sounds in Zone A, except for sound sensitive activities such as auditoriums, churches, schools, hospitals, and theaters. The applicant's proposal is an appropriate use in this noise zone. The Master Plan designates the subject property as a Low Intensity Commercial land use. The applicant's request is not in compliance with the Master Plan. Enforcement shall be by any proceeding at law or in equity against any person or persons violating or attempting to violate any part of the Declaration, either to restrain violation or to recover damages. Failure by the City to enforce any provision of the Declaration shall in no event be deemed a waiver of the right to do so thereafter. With respect to any litigation hereunder, the prevailing party shall be entitled to recover court costs and reasonable attorneys' fees from the non -prevailing party. Severability. They include: I. TOTAL INDEPENDENT LIVING Complete living units, with kitchens — age restricted (non -medically licensed). These vary from rentals, to condos, to co-ops, etc. Typically the resident rents or owns the unit, pays the utilities, cooks the meals, and provides their own transportation. Generally the resident is younger than those who might choose the other more congregate type of housing/care herein described. II. INDEPENDENT LIVING WITH AN OPTION Typically a full living unit with kitchens, but included within the facility is a congregate dining room which allows the resident the choice of either cooking for one's self, or eating in the congregate dining facility. These facilities typically are rental units, but some co-op's are found. Different levels or menus of services are provided, depending on the owner/operator/sponsor. Very often these facilities are sponsored by a non-profit institution such as a church, lodge or other non-profit organization. These models often are sponsored and receive financial support from outside sources, i.e., a church, lodge, civic institution, or financing incentives. Financially, this model is weak. Given the opportunity, enough of the residents will choose the option of cooking for themselves. This may not be what is best for the resident, socially, physically, medically, etc., but human nature what it is, it appeals to the fiscal sense of a senior. The facility must still maintain the full kitchen, staffing, etc. The overhead goes on but the revenue is not generated to support it. There is another condition that results from this option being given the senior resident. Because they do not need to eat in the dining room, they become less involved socially. Experience has shown this markedly impacts their physical and metal well being. Many will then begin to show the same symptoms which were evident prior to moving into a congregate facility and were a prime reason why they moved into the residence in the first place. III. CONGREGATE SENIOR RESIDENCE Holiday Retirement Corp. manages approximately 130 Congregate Senior Residences throughout the United States and Canada. This residence is a "suite" only facility. The suites do not have full kitchens. All residents eat "congregate style". The facility is not medically licensed. It is i based on a lease/rental arrangement, which for one monthly fee the resident receives a package of the services, including the following: 0 Three meals a day served in common dining room RECEIVED • All utilities, except telephone • Light housekeeping and linens • Strong social activity program • Transportation to and from local desired locations P&.A N G • Security program/live-in management This is what is termed "active retirement living". These residents may have lost a spouse and are now socially "shrinking". They are tired of and burdened with the large home. Physically they are slowing down. Loneliness has an impact on their eating and other physical habits, generally to their detriment. They do not want to admit they are getting old. The last thing they want is to be reminded they may soon be having medical problems. Experience has shown this resident does not want to live in the same residence with those who they consider to be infirm, need help with eating, bathing and assistance with medication. M A residential/light medical facility with or without kitchens for those seniors who require light medical attention (medically licensed) typically these are rental units. The typical service package includes those provided by the congregate facility (III. above), and the addition of some level of medical attention. It might be the monitoring of medications taken by the resident, assistance in bathing, eating, and/or moving around. These residents are considered frail and the residence is built to different standards than the congregate, and of course part of the staff is licensed by the State Health Department. Residence turn over rate is high because of the very condition that existed that brought the resident into the facility. T-7:11 :15 14 MUMNZ��� A "community" that might offer all of the above, plus skilled nursing facility, is generally called a CCRC, or continuing care retirement community. These typically require a large up front deposit which is used to fund a long-term care contract with the resident. In addition, monthly fees are charged to cover things such as rent of the unit, food, utilities, etc. This arrangement might be termed a "buy -in". It obviously has risk for the resident as well as the operator because usually there is a contract for life. Very often associated with a religious or other social institution.
