RECOMMENDATION
City Council to consider Applicant's request for a one-year extension on Conditional
Use Permit CU99-45 and take any necessary action.
BACKGROUND INFORMATION
Staff received a request from Mr. Bill Deacon requesting a one year extension to the
previously approved conditional use permit to allow the possession, storage, retail sale,
and on -premise consumption of alcoholic beverages (beer, wine, and mixed drinks) in
conjunction with a restaurant in a mixed-use development addressed as 213 West
Hudgins Street and platted as Lot 1, Block 1, B&D Mills Market Center.
Conditional Use Request CU99-45 (Ord. 99-134) was originally considered and
approved with a first reading at the September 7, 1999 joint public hearing. Variances
for the project were approved by the Board of Zoning Adjustment on September 13,
1999. The second reading and final approval of the Conditional Use Permit occurred at
the September 13, 1999 City Council Meeting. The applicant has not applied for a
building permit for the project due to the uncertainty of historic tax credits for the project.

Dear Mr. Hardy:
In September of 1999 a zoning change and a conditional use was approved by the
City of Grapevine for our property known as Lot 1, Block 1, B & D Mills Market
Center (213 West Hudgins Street). The zoning ordinance is 99-134, and it may
include the approval of the preliminary and final plat. The conditional use permit
is CU99-45.
The first reading of the City Council occurred on September 7, 1999. Variances
't for the project were approved by the Board of Zoning Adjustments on September
13, 1999. The second reading of the City Council occurred on September 21,
1999.
In addition, we met with the Historic Preservation Council on July 28, 1999
regarding a Certificate of Appropriateness (CA). This allowed the demolition of
various storage bins that are defined as "structures" by the National Parks Service.
These bins were constructed on the property after the historic Period of
Significance, which is currently proposed to end in 1956. It is our understanding
that the CA is perpetual, but we would like an extension on it as well if it is not.
We have not taken out a building permit since the zoning, platting, and
conditional use approval because of the uncertainty surrounding the historic tax
credits for the projects. Therefore, we would like to request an extension of one
year for these approvals.
