SUBJECT: RIGHT-OF-WAY ABANDONMENT — LOS ROBLES DRIVE
RECOMMENDATION:
City Council consider adopting an ordinance abandoning the western portion of Los Robles
Drive right-of-way, and take any necessary action.
BACKGROUND INFORMATION:
The owner of the tract of land west of the Los Robles Addition has requested that the
unused section of Los Robles Drive be abandoned. This approximate 125 foot segment
of right-of-way currently lies within Tributary BB -4 floodplain and is unused.
The City will retain a drainage easement along this right-of-way. The property owner west
of this right-of-way is proposing to construct a driveway across a proposed culvert bridge
at this location to gain access for future Lot 1, Block 1, Rockbridge Addition.
Staff recommends approval.

PROPERTY DESCRIPTION
BEING a 0.191 acre tract of land in the W.D. Shepherd Survey, Abstract No. 1393, situated
in the City of Grapevine, Tarrant County, Texas and being a portion of the right—of—way of Los
Robles Drive as dedicated by the Final Plat of Los Robles Estates Section I, an addition to the
City of Grapevine, Tarrant County, Texas as recorded in Volume 388-38, Page 69 of the Plat
Records of Tarrant County, Texas (PRTCT I and being more particularly described as follows
COMMENCING at a copped 1/2' iron pin set, said iron pin also being the southwest corner of
Loi 1, Block D of said Los Robles Estates Section I, THENCE S 09°32'37' W, 55.06 feet to a
capped 1/2' iron pin set, said iron pin also being on the north right—of—way line of said Los Robles
Drive, said iron pin also being the Point of Beginning of the herein described tract,
THENCE S 36°56'40' E, a distance of 50.00 feet to a capped 1/2' iron pin set, said iron pin also
being on the northerly line of Lot 9, Block A of said Los Robles Estates, Section I, said iron pin
also being Point of Curvature of a non—longeni circular curve to the right having a radius of 54.72
feet, a central angle of 80°08'00' and being subtended by a chord which bears N 86°52'40'
W, 70.44 feet,
THENCE along said curve to the right and said northerly line of Lot 9, Block A of said Los
Robles Estates, Section I, a distance of 76.53 feet to a capped 1/2' iron pin set,
THENCE N 46°48'40' W tangent to said curve and along said northerly line of Lot 9, Block A
of said Los Robles Estates, Section I, a distance of 125.00 feet to a copped 1/2' iron pin set, said
iron pin also being on the easterly line of a tract conveyed to Daniel and Lisa Goodwin by deed
recorded in Volume 14370, Page 438 of the Deed Records of Tarrant County, Texas (DRTCT 1,
THENCE N 43°11'30' E along the said easterly line of said Goodwin tract, a distance of 50.00
feet to a point in an un—named tributary of Big Bear Creek,
THENCE S 46°48'40' E along the said easterly line of said Goodwin tract, a distance of 125.00
feet to a copped 1/2' iron pin set, said iron pin also being the Point of Curvature of a circular

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS, ABANDONING AND VACATING THE
A PORTION OF THE LOS ROBLES DRIVE RIGHT-OF-WAY
IN THE CITY OF GRAPEVINE, TEXAS AS HEREINAFTER
DESCRIBED; SAVE AND EXCEPT THE RETENTION OF
SAID RIGHT-OF-WAY FOR A DRAINAGE AND UTILITY
EASEMENT; PROVIDING A SEVERABILITY CLAUSE;
DECLARING AN EMERGENCY AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, the owners of the tracts of land described in Volume 14370, Page 438,
Deed Records of Tarrant County, Texas and the property owner of Lot 9, Block A, Los
Robles Estates, Section 1, as filed in Volume 388-38, Page 69, Plat Records of Tarrant
County, Texas, the properties containing said right-of-way, more specifically described in
Exhibit "A" attached hereto and incorporated herein for all purposes, have requested the
said right-of-way, as herein after described, be abandoned and vacated; and
WHEREAS, the said right-of-way is not needed for public use and will not be
needed in the future for public use; and
WHEREAS, abandoning and vacating the said right-of-way will relieve the City of
Grapevine, Texas from the cost and expense of maintaining said property.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1. That the said portion of right-of-way for Los Robles Drive, described
in Exhibit "A", attached hereto and incorporated herein for all purposes, is hereby
abandoned and vacated for public use and the same is hereby abandoned and vacated
insofar as all public right, title, and interest in and to said described portion of said right-of-
way is concerned save and except the retention of said right-of-way as a drainage and
utility easement for public use.
Section 2.' This ordinance effectively abandons and vacates the referenced right-
of-way releasing the City's rights to said right-of-way described in Exhibit "A" of this
ordinance.
Section 3. The fact that the said right-of-way is no longer needed by the public
for public usage or traveling and would create a hardship or burden upon the City of
Grapevine to keep open and maintain such right-of-way and such street creates an
urgency and an emergency for the immediate preservation of the public health, safety, and
general welfare which requires that this ordinance shall take effect immediately from and
after its passage and it is accordingly so ordained.
Section 4. That the terms and provisions of this ordinance shall be deemed to be
severable, and that if the validity of any section, subsection, word, sentence or phrase shall
be held to be invalid, it shall not affect the remaining part of this ordinance.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS on this the 21st day of November, 2000.
