RIGHT-OF-WAY ABANDONMENT — FRANKLIN STREET
City Council consider adopting an ordinance abandoning a portion of the Franklin Street
right-of-way effective on the approval of the First United Methodist Church plat, and take
any necessary action.
BACKGROUND INFORMATION:
The First United Methodist Church of Grapevine is the owner of all properties adjacent to
Franklin Street between Scribner Street and Church Street, has requested that the City
abandon the remaining segment (250 feet) of right-of-way (see attached Exhibit "A").
Council abandoned the eastern segment (346 feet) of Franklin Street February 2, 1990.
The abandoned right-of-way will be retained as a drainage and utility easement after
abandonment.
The Replat of First United Methodist Church, being considered on December 19, 2000,
reflects a continuous Public Access Easement providing access between Church Street
and Scribner Street for the general public and for emergency vehicles to access the entire
site.
Staff recommends approval.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS, ABANDONING AND VACATING A
PORTION OF THE FRANKLIN STREET RIGHT-OF-WAY IN
THE CITY OF GRAPEVINE, TEXAS AS HEREINAFTER
DESCRIBED; SAVE AND EXCEPT THE RETENTION OF
SAID RIGHT-OF-WAY FOR A DRAINAGE AND UTILITY
EASEMENT; PROVIDING A SEVERABILITY CLAUSE;
DECLARING AN EMERGENCY AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, the First United Methodist Church of Grapevine is the owner of all
properties adjacent to Franklin Street between Scribner Street and Church Street, the
property containing the right-of-way more specifically shown and described in Exhibit "A"
(the "right-of-way") attached hereto and incorporated herein for all purposes, has requested
the right-of-way be abandoned and vacated; and
WHEREAS, the right-of-way is not needed for public use and will not be needed in
the future for public use; and
WHEREAS, abandoning and vacating the right-of-way will relieve the City of
Grapevine, Texas from the cost and expense of maintaining said property.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1. That the right-of-way described in Exhibit "N' is hereby abandoned and
vacated for public use and the same is hereby abandoned and vacated insofar as all public
right, title, and interest in and to right-of-way is concerned save and except the retention
of said right-of-way as a drainage and utility easement for public use.
Section 2. This ordinance effectively abandons and vacates the right-of-way
releasing the City's rights to said right-of-way described in Exhibit "A" of this ordinance.
Section 3. The fact that the right-of-way is no longer needed by the public for
public usage or traveling and would create a hardship or burden upon the City of
Grapevine to keep open and maintain the right-of-way and such street creates an urgency
and an emergency for the immediate preservation of the public health, safety, and general
welfare which requires that this ordinance shall take effect immediately from and after its
passage and it is accordingly so ordained.

Section 4. That the terms and provisions of this ordinance shall be deemed to be
severable, and that if the validity of any section, subsection, word, sentence or phrase shall
be held to be invalid, it shall not affect the remaining part of this ordinance.
