SUBJECT: RIGHT-OF-WAY ABANDONMENT — BALL STREET
RECOMMENDATION:
City Council consider adopting an ordinance abandoning a segment of Ball Street Right -
of -Way in the Southwest corner of the intersection of Ball Street and Wall Street,
authorize City Manager to execute the necessary documents to quit -claim the right-of-
way to the abutting property owner, and take any necessary action.
BACKGROUND:
The .1748 acre tract of right-of-way is the balance of a parcel acquired by the City for the
realignment of Ball Street at the intersection with Wall Street in the late 1980s.
The triangular shape parcel serves no purpose to the City, requiring City maintenance
with no viable benefit to the City.
The abutting property owner has requested the City consider abandoning the right-of-
way so that he may incorporate it into his site.
Staff recommends approval.

ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS, ABANDONING AND VACATING A
PORTION OF THE BALL STREET RIGHT-OF-WAY IN THE
CITY OF GRAPEVINE, TEXAS AS HEREINAFTER
DESCRIBED; SAVE AND EXCEPT THE RETENTION OF A
PORTION OF SAID RIGHT-OF-WAY FOR A UTILITY
EASEMENT; PROVIDING A SEVERABILITY CLAUSE;
DECLARING AN EMERGENCY AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, the property owner in the southwest corner of the intersection of Ball
Street and Wall Street has requested that a strip of right-of-way be abandoned and
vacated; and
WHEREAS, the right-of-way is not needed for public use and will not be needed in
the future for public use; and
WHEREAS, abandoning and vacating the right-of-way will relieve the City of
Grapevine, Texas from the cost and expense of maintaining said property.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1. That the right-of-way described in Exhibit "A" is hereby abandoned and
vacated for public use and the same is hereby abandoned and vacated insofar as all public
right, title, and interest in and to right-of-way is concerned save and except the retention
of a ten 10' wide utility easement immediately adjacent to and extending for the full length
of the eastern boundary of subject right-of-way described in Exhibit "A" for public use.
Section 2. This ordinance effectively abandons and vacates the right-of-way
releasing the City's rights to said right-of-way described in Exhibit "A" of this ordinance.
Section 3. The fact that the right-of-way is no longer needed by the public for
public usage or traveling and would create a hardship or burden upon the City of
Grapevine to keep open and maintain the right-of-way and such street creates an urgency
and an emergency for the immediate preservation of the public health, safety, and general
welfare which requires that this ordinance shall take effect immediately from and after its
passage and it is accordingly so ordained.
Section 4. That the terms and provisions of this ordinance shall be deemed to be
severable, and that if the validity of any section, subsection, word, sentence or phrase shall
be held to be invalid, it shall not affect the remaining part of this ordinance.

GRAPEVINE, TEXAS on this the 19th day of December, 2000.
