SUBJECT: RIGHT OF WAY ABANDONMENT — NORTH STARNES STREET
RECOMMENDATION:
City Council consider adopting an ordinance abandoning a 1525 square foot segment of
street right of way located adjacent to Lots H & I, J. J. Hall Addition, and take any
necessary action.
BACKGROUND INFORMATION:
When the J. J. Hall Addition was platted in May, 1948, Starnes Street was platted with a
cul-de-sac at the north end of the roadway. Starnes Street was ultimately extended north
to Turner Street and no longer uses the full right-of-way dedicated for the cul-de-sac.
The owners of Lots H and Lot I, J.J. Hall Addition, have requested that a 1525 square foot
segment of street right of way within the east half of the cul-de-sac bordering the two lots
be abandoned for incorporation in their residential development. A full 50 foot width right-
of-way will be maintained for Starnes Street after the requested abandonment.
The segment proposed for abandonment is not needed by the City for right of way
purposes.
The Utilities have no objections to the requested abandonment.
Staff recommends approval.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS, ABANDONING AND VACATING A
PORTION OF RIGHT-OF-WAY LOCATED ON THE EAST
SIDE OF THE CUL-DE SAC AT THE NORTH END OF
STARNES STREET IN THE CITY OF GRAPEVINE, TEXAS
AS HEREINAFTER DESCRIBED AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, the property owners of Lots H and 1, J.J. Hall Addition, recorded in
Volume 1997, Page 444 Deed Records, Tarrant County, Texas, the property containing
a right-of-way, more specifically described in Exhibits 1" and "2" attached hereto and
incorporated herein for all purposes, has requested the right-of-way, as herein after
described be abandoned and vacated-, and
WHEREAS, the right-of-way is not needed for public use and will not be needed in
the future for public use; and
WHEREAS, abandoning and vacating the said right-of-way will relieve the City of
Grapevine, Texas from the cost and expense of maintaining said property.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1. That all matters stated in the preamble of this ordinance are true and
correct and are hereby incorporated into the body of this ordinance as if copied in their
entirety.
Section 2. That the right-of-way located within the property described in Exhibits
Ili" and "2", attached hereto and incorporated herein for all purposes, is hereby abandoned
and vacated for public use and the same is hereby abandoned and vacated insofar as all
public right, title, interest in and to said right-of-way is concerned.
Section 3. That the terms and provisions of this ordinance shall be deemed to be
severable, and that if the validity of any section, subsection, word, sentence or phrase shall
be held to be invalid, it shall not affect the remaining part of this ordinance.
Section 4. The fact that the right-of-way is no longer needed by the public for
public usage and would create a hardship or burden upon the City of Grapevine to keep
open and maintain such right-of-way creates an urgency and an emergency for the
immediate preservation of the public health, safety, and general welfare which requires that
this ordinance shall take effect immediately from and after its passage and it is accordingly
so ordained.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS on this the 4th day of December, 2001.

EXHIBIT I
LEGAL: BEGINNING at a " T. Vogt" capped steel rod in the East right-of-way for North
Starnes Street, said rod being North 00 degrees 00 minutes West, 25.0 feet from the
Southwest corner of Lot 1, J. J. HALL ADDITION, an Addition to the City of Grapevine,
Tarrant County, Texas, according to the revised plat recorded in Volume 1997, Page
444 Deed Records, Tarrant County, Texas;
T HENCE North 00 degrees 00 minutes West, 86.60 feet, along the proposed East
right-of-way of said North Starnes Street, to a " T. Vogt" capped steel rod, said rod
being the Southeast corner of a tract of land to the City of Grapevine as recorded in
Volume 4554, Page 453 Deed Records, Tarrant County, Texas, and the beginning of
a non -tangent curve, whose center bears 50.00 feet, South 30 degrees 00 minutes
West, a radius of 50.00 feet,
THENCE Southeasterly along said curve a distance of 104.72 feet to the Point of
Beginning and containing 0.035 acres of land more or less.
