SUBJECT: ADOPTION OF THE 2000 INTERNATIONAL RESIDENTIAL
CODE
RECOMMENDATION:
The Building Board of Appeals and Staff recommends Council adopt the enclosed
ordinance relative to the 2000 International Residential Code and take any necessary
action.
BACKGROUND INFORMATION:
The 77th Legislature recently passed SB 365, adopting the 2000 International
Residential Code (IRC) as the municipal residential building code in Texas. The State
adoption of this code is the result of lobbying and support by builders associations,
architects, and others. Unlike our other codes, this is a stand-alone document, with
building, plumbing, mechanical and electrical provisions contained within. This
legislation allows cities to review and adopt amendments to the IRC, and does not
require cities to adopt or enforce the electrical provisions of the code. The proposed
ordinance amendment deletes the electrical provisions, and defers to the currently
adopted Grapevine electrical code (1996 National Electrical Code).
The IRC will replace the 1994 Uniform Building Code, 1994 Uniform Mechanical Code,
and 1991 Uniform Plumbing Code for one and two family dwellings and multi -family
structures with property lines between units three stories or less in height with separate
means of egress and their accessory structures only.
Enclosed are amendments relative to the adoption of the code, and amendments to the
code itself (most of which are recommended by the North Central Texas Council of
Governments). Many amendments simply place provisions that were in our existing
ordinances under the International Residential Code (examples include minimum class
"C" fire retardant roofs, non fire -rated exterior walls for zero lot line homes, and fees).
Major amendments to the code itself include the prohibition of unvented gas appliances,
protection from freezing for water lines, and prohibition of potentially unsanitary
plumbing practices.
At its November 26th meeting, the Building Board of Appeals reviewed this ordinance
and code, and forwarded a recommendation of approval to Council.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS AMENDING THE GRAPEVINE CODE OF
ORDINANCES BY AMENDING CHAPTER 7, BUILDINGS AND
CONSTRUCTION, RELATING TO THE ADOPTION OF THE
2000 INTERNATIONAL RESIDENTIAL CODE FOR ONE AND
TWO FAMILY DWELLINGS AS PUBLISHED BY THE
INTERNATIONAL CODE COUNCIL, PROVIDING
AMENDMENTS TO SAME, REPEALING CONFLICTING
ORDINANCES; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING A PENALTY, NOT TO EXCEED TWO THOUSAND
DOLLARS ($2,000.00) FOR EACH SEPARATE OFFENSE AND
A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED
UPON EACH DAY DURING OR ON WHICH A VIOLATION
OCCURS; DECLARING AN EMERGENCY AND PROVIDING AN
EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS:
Section 1. That Chapter 7, Buildings and Construction, Article I is hereby
amended in the following particulars:
A. Sec. 7-1. Building Code — Adopted is hereby amended by adding a
second paragraph to read as follows:
"This code and its amendments shall not apply to one and two family
dwellings and multi -family dwellings of not more than three stories with
individual exits and property lines between dwelling units and their
accessory buildings unless otherwise stated. Such structures shall be
regulated by the current International Residential Code as adopted by the
city."
B. Sec. 7-3. Same — Amendments, is hereby amended by amending Sec.
106.2, Work exempt from permit, by deleting Subsections 9 and 10 and renumbering
the remainder of the section.
C. Sec. 7-3. Same —Amendments, Section 302.4 Fire Ratings for Occupancy
Separations, as amended by the City, is hereby deleted in its entirety.
D. Sec. 7-3. Same — Amendments, Section 1006.9 Handrails, as amended
by the City, is hereby deleted in its entirety.

the City, is hereby amended to read as follows:

F. Sec. 7-3. Same — Amendments, Table No.5-A, as amended by the City, is
hereby deleted in its entirety.
G. Sec. 7-4. Creation of Building Board of Appeals, composition and
qualification of members, first paragraph shall be amended to read as follows:
"The City Council shall appoint seven members to the following boards
who shall collectively and jointly serve as the membership of said boards;
Housing Advisory and Appeals Board as authorized by the IJRifGFM
current edition of the International Residential
Code as adopted by the Cit
y1 Building Board of Appeals as authorized by
the 1994 Edition of the Uniform Building Code, Plumbing Board of
Appeals, Electrical Board of Appeals, Mechanical Board of Appeals. The
membership of each named board shall consist of the same seven
individuals. The boards named herein shall be collectively called the
Building Board of Appeals, hereinafter referred to as the board."
H. Sec. 7-8. General contractors registration subsection (a) is amended to
read as follows:
"(a) Required; contents. Each contractor shall be required to maintain a
registration with the city before performing any type of construction work
regulated by the Grapevine Building Code- , or the Grapevine Residential
Code. Each contractor shall furnish the building inspection division with
the following information:"
Section 2. That Chapter 7, Article V, Housing Code, is hereby deleted in its
entirety and replaced by the following:
"ARTICLE V. RESIDENTIAL CODE
Section 7-140. Adoption
ORD. NO. 2
There is hereby adopted for the purpose of establishing rules and
regulations for the construction, alteration, removal, demolition,
equipment, use and occupancy, location and maintenance of buildings
and structures, that certain code known as the International Residential
Code, copyrighted by the International Code Council being particularly the
2000 edition thereof, of which not less than three copies have been and
now are filed in the office of the city secretary, and the same is hereby
adopted and incorporated as fully as if set out at length herein. The
provisions of this code shall regulate the construction of all one and two
family dwellings and multi -family dwellings with property lines between
units not more than three stories in height with a separate means of
egress and their accessory structures, subject to all amendments thereof
or superseding provisions contained in this chapter.
Section 7-141. Conflicts
When any portion of this code conflicts with any other code or ordinance
adopted by the City, the most restrictive requirement shall apply.
When any provision in this code conflicts with any other provision in this
code the most restrictive requirement shall apply.
All references made to electrical provisions shall be replaced with the
words "Electrical Code adopted by this jurisdiction".
All references to the International Building Code shall mean the building
code adopted by the City.
All references to the International Plumbing Code shall mean the plumbing
code adopted by the City.
All references to the International Mechanical Code shall mean the
mechanical code adopted by the City.
Any item not specifically addressed by this code shall be regulated by the
current building code adopted by the City."
Section 3. That the Residential Code herein adopted is specifically amended
as follows:
"Sec. 7-142. Amendments:
Sec. R102.4. Referenced codes and standards is amended to read as
follows:

Sec. R102.4. Referenced codes and standards. The codes, when
specifically adopted, and standards referenced in this code shall be
considered part of the requirements of this code to the prescribed extent
of each such reference. Whenever amendments have been adopted to
the referenced codes and standards, each reference to said code and
standard shall be considered to reference the amendments as well. Any
reference made to NFPA 70 or the ICC Electrical Code or any other
reference to electrical provisions shall mean the Electrical Code and its
amendments as adopted.
Where differences occur between provisions of this code and referenced
codes and standards, the provisions of this code shall apply.

thereafter be returned to the applicant or destroyed by the Building
Official. The Building Official may extend the time for action by the
applicant for a period not exceeding 180 days on request by the applicant
showing that circumstances beyond the control of the applicant have
prevented action from being taken. No application shall be extended more
than once. In order to renew action on an application after expiration, the
applicant shall resubmit plans and pay a new plan review fee.
Sec. R105.5. Expiration is amended in its entirety to read as follows:
Sec. R105.5. Expiration. Every permit issued by the Building Official
under the provisions of this code shall expire by limitation and become null

and void if the building or work authorized by such permit is not
commenced and an inspection requested within 180 days from the date of
such permit, or if the building or work authorized by such permit is
suspended or abandoned at any time after the work is commenced for a
period of 180 days or if more than 180 days pass between any two
inspections of the building or work, including the final inspection. In the
event of an expired permit, before such work can be recommenced,
and/or inspections requested, a new permit shall be first obtained to do so,
and the fee therefor shall be one-half the amount required for a new
permit for such work, provided no changes have been made or will be
made in the original plans and specifications for such work; and provided
further that such suspension or abandonment has not exceeded 30 days.
In order to renew action on a permit more than 30 days after expiration,
the permittee shall pay a new full permit fee. The Building Official shall
have the sole discretion, except as otherwise provided herein, to extend
permits and inspection deadlines for projects of an unusually large scope.
Any building or work subject to a permit which has expired for a period of
more than 30 days shall be declared a nuisance in accordance with
Chapter 7, Article 11 of the Grapevine Code of Ordinances.
Any permittee holding an unexpired permit may apply for an extension of
the time within which work may commence under that permit when the
permittee is unable to commence work within the time required by this
section for good and satisfactory reasons. The Building Official may
extend the time for action by the permittee for a period not exceeding 180
days on written request by the permittee showing that circumstances
beyond the control of the permittee have prevented action from being
taken. No permit shall be extended nor renewed more than once.
Sec. R108. Fees, is amended by the addition of Table R108, Permit Fees,
attached hereto as Exhibit "A", and incorporated herein by reference.
Sec. R108.5. Refunds, is amended in its entirety and replaced with the
following:
Sec, R108.5. Refunds. Plan review fees are not refundable. 80% of the
building, electrical, mechanical, and/or plumbing fee may be refunded,
provided that no inspections have been performed.

work for which a permit is required by this code has been commenced

Sec. R112.1. Board of Appeals -General is amended to read as follows:
Sec. 8112.1. General. In order to hear and decide appeals of orders,
decisions or determinations made by the Building Official relative to the
application and interpretation of this code, there shall be and is hereby
created a Board of Appeals. Such board shall consist of the members of
the Building Board of Appeals established in Article I of this code. The
Building Official shall be an ex officio member of said board but shall have
no vote on any matter before the board. The Board of Appeals shall be
appointed by the City Council and shall hold office at the pleasure of the
City Council. The board shall adopt rules of procedure for conducting its
business, and shall render all decisions and findings in writing to the
appellant with a duplicate copy to the Building Official.
Sec. R112.2.1. Determination of substantial improvement in areas prone
to flooding, is hereby deleted in its entirety.

Sec. R302.1. Exterior Walls. Exterior walls with a fire separation distance
of less than 3 feet (914mm) shall have not less than a one-hour fire -
resistive rating with exposure from both sides, with the sole exception of
walls of structures located on property zoned R-5.0, as provided for in
Section 16, Zero Lot Line District, of the Grapevine Comprehensive
Zoning Ordinance No. 82-73. Projections shall not extend beyond the
distance determined by the following two methods, whichever results in
the lesser projections:
1. A point one-third the distance to the property line from an assumed
vertical plane located where protected openings are required.
2. More than 12 inches (305 mm) into areas where openings are
prohibited.
Projections extending into the fire separation distance shall have not less
than one-hour fire -resistive construction on the underside. The above

of the property line without fire -resistive or opening protection when the
location of such is approved as required by other adopted ordinances.
Sec. R302.2. Openings, is amended to read as follows:

wall of a dwelling or accessory building with a fire separation distance less
than 3 feet (914 mm), with the sole exception of structures located on

buildings. Regardless of other provisions of this code, the use of kraft
waterproof building paper or asphalt saturated rag felt is permitted only
when covered by a veneer approved by this code. The use of wood
shakes or wood shingles as an exterior wall covering is only permitted
when such materials meet minimum Class "C" roofing material standards
as demonstrated by a nationally recognized testing agency.
Sec. R703.7.4.1. Size and spacing, is amended by the adoption of a
second paragraph to read as follows:

concrete roof tile, exposed concrete roof deck, ferrous or copper shingles
or sheets; and metal sheets and shingles, shall be considered Class A
roof coverings.
Sec. 8907.1. General is amended to read as follows:
Sec. R907.1. General. Materials and methods of application used for
recovering or replacing an existing roof covering shall comply with the
requirements of this chapter. Repairs to existing roofs and roof coverings
shall comply with the provisions of Chapter 34 of the International Building
Code, but more than 25 percent of the roof covering of any building shall
not be removed and replaced within a 12 -month period unless the entire
roof covering is made to conform to the requirements for new roofing.
Exception: Reroofing shall not be required to meet the minimum design
slope requirement of one-fourth vertical in 12 units horizontal (2 -percent
slope) in Section R905 for roofs that provide positive roof drainage.
The replacement materials for all or part of a roof shall comply with all of
the requirements of Section R902. In those cases where it proves
necessary to replace all or part of an ordinary wood shingled roof, and
minimum Class "C" roofing does not meet the exposure length of the
existing roof, Class "C" composition shingles may be overlaid on the
existing shingles, subject to the other provisions of this chapter.
Sec. R1005.2. Exterior air intake is amended to read as follows:

Sec. N1101.2. Compliance. Compliance with this chapter shall be
demonstrated by meeting the requirements of the applicable sections and
tables of this chapter. Where applicable, provisions are based on the
climate zoned where the building is located. The climate zone where the
building is located shall be based on zone assignments in Table N1101.2
for the county and state in which the building is constructed. Alternatively,
the climate zone shall be permitted to be determined by the Heating
Degree Days assigned by the Building Official.
It shall be the responsibility of the permit applicant to provide
documentation satisfactory to the Building Official that the provisions of
this chapter are met. When any local, State and/or federal law requires
review or inspection by certified personnel, it shall be the responsibility of
the permit applicant to obtain the services of such personnel.
Sec. N1101.2.1. Residential Buildings, Type A-1. Compliance shall be
demonstrated by one of the following:
Meeting the requirements of this chapter for buildings with a glazing
area that does not exceed 15 percent of the gross area of exterior
walls;
Z Meeting the requirements of this chapter for buildings with a glazing
area that is greater than 15 percent but not exceeding 20 percent of
the gross area of exterior walls and air conditioning equipment
rated 12 SEER or higher,
3. Meeting the requirements of this chapter for buildings with a glazing
area that is greater than 20 percent but not exceeding 25 percent of
the gross area of exterior walls and air conditioning equipment
rated 14 SEER or higher; or
4. Meeting the requirements of the International Energy Conservation
Code for residential buildings, Type A-1.
Sec. N1101.3. Materials and Equipment is hereby amended by the
addition of a new Section N1101.3.4. to read as follows:
Sec. N1101.3.4. Exterior basement or slab insulation. When susceptibility
to termite damage is classified as "very heavy" according to Table
R301.2(1), designs employing basement or slab exterior insulation

five (5) feet (1524 mm) for each 90 -degree (1.6 rad) bend that occur after

Sec. M2005.2. Prohibited locations. Fuel -fired water heaters shall not be
installed in a room used as a storage closet. Water heaters located in a
bedroom or bathroom shall be installed in a sealed enclosure so that
combustion air will not be taken from the living space. Access to such
enclosure may be from the bedroom or bathroom when through a solid
door, weather-stripped in accordance with the exterior door air leakage
requirements of the International Energy Conservation Code and
equipped with an approved self-closing device. Direct -vent water heaters
are not required to be installed within an enclosure.
Sec. G2403. General definitions, definition of "Unvented Room Heater" is
amended to read as follows:
Sec. G2403. General definitions, UNVENTED ROOM HEATER. An
unvented heating appliance designed for stationary installation and utilized
to provide comfort heating. Such appliances provide radiant heat or
convection heat by gravity or fan circulation directly from the heater and
do not utilize ducts. For the purpose of installation, this definition shall
also include "Unvented Decorative Appliances."
All such equipment is prohibited by this code.

Where the appliances and equipment listed in Items 1 through 6 above
are installed so that the aggregate input rating exceeds 20 Btu per hour
per cubic foot (207 wafts per m3) of volume of the room or space in which
such appliances and equipment are installed, one or more shall be
provided with venting systems or other approved means for conveying the
vent gases to the outdoor atmosphere so that the aggregate input rating of
the remaining unvented appliances and equipment does not exceed the
20 Btu per hour per cubic foot (207 wafts per m3) figure. Where the room
or space in which the equipment is installed is directly connected to
another room or space by a doorway, archway or other opening of
comparable size that cannot be closed, the volume of such adjacent room
or space shall be permitted to be included in the calculations.
Sec. G2437.5. Clothes dryer ducts is amended by the addition of a
sentence at the end of the paragraph to read as follows:

The size of duct shall not be reduced along its developed length nor at the
point of termination.
Sec. G2437.5.1. Maximum length is amended to read as follows:
Sec. G2437.5.1 (613.6.1). Maximum length. The maximum length of a
clothes dryer exhaust duct shall not exceed 25 feet (7620 mm) from the
dryer location to the outlet terminal with not more than two bends. When
extra bends are installed, the maximum length of the duct shall be
reduced two and one-half (2 Y2) feet (762 mm) for each 45 -degree (0.79
rad) bend and five (5) feet (1524 mm) for each 90 -degree (1.6 rad) bend
that occur after the first two bends, measuring in the direction of airflow.

Sec. G2443. Unvented room heaters is amended in its entirety to read as
follows:

and decorative appliances shall be prohibited by this code.

Sec. G2446. 1. 1. Installation requirements is amended to read as follows
Sec. G2446.1.1 (623.1.1). Installation requirements. The requirements for
water heaters relative to access, sizing, relief valves, drain pans and scald
protection shall be in accordance with this code.
Sec, P2503.5.1. Rough plumbing, Item 1; is amended by the addition of a
sentence at the end of subsection one to read as follows:

tested for water tightness by filling with water to the level of the
rough threshold. The drain shall be plugged in a manner so that

be installed outside of a building, in exterior walls, in attics or crawl
spaces, or in any other place subjected to freezing temperature unless
adequate provision is made to protect it from freezing by insulation or heat
or both. Water service pipe shall be installed not less than 12 inches (305
mm) deep or less than six (6) inches (152 mm) below the front line.
Building sewers shall be a minimum of 12 inches below grade.
Sec. P2708.1, General is amended to read as follows:
Sec. P2708.1, General. Shower compartments shall have at least 900
square inches (0.581 ml) of floor area and be of sufficient size to inscribe
a circle with a diameter not less than 30 inches (762 mm). Hinged shower
doors shall open outward. The wall area above built-in tubs having
installed shower heads and in shower compartments shall be constructed
as per Section 307.2. Such walls shall form a water -tight joint with each
other and with either the tub, receptor or shower floor. Thresholds shall
be of sufficient width to accommodate a minimum 22 inch (559 mm) door.

or platform in which a water heater is installed is more than eight (8) feet
(2438mm) above the ground or floor level, it shall be made accessible by
a stairway or permanent ladder fastened to the building.
Sec. P2801.7.1. Whenever the mezzanine or platform is not adequately
lighted or access to a receptacle outlet is not obtainable from the main
level, lighting and a receptacle outlet shall be provided in accordance with
Section M1305.1.3.1.
Sec, P2803.6.1. Requirements for discharge is amended to read as
follows:
Sec. P2803.6.1. Requirements for discharge. The outlet of a pressure
relief valve, temperature relief valve or combination thereof, shall not be
directly connected to the drainage system. The discharge from the relief
valve shall be piped full size separately to the outside of the building or to
an indirect waste receptor located inside the building.
In areas subject to freezing, the relief valve shall discharge through an air
gap into an indirect waste receptor located within a heated space, or by
other approved means. The discharge pipe shall not discharge into the
pan required in Section P2801.5.
The discharge shall be installed in a manner that does not cause personal
injury or property damage and that is readily observable by the building
occupants. The discharge from a relief valve shall be trapped. The
diameter of the discharge piping shall not be less that the diameter of the
relief valve outlet.

The discharge pipe shall be installed so as to drain by gravity flow and
shall terminate atmospherically. When discharging outside the building,
the point of discharge shall be with the end of the pipe not more than two
(2) feet (610 mm) nor less than six (6) inches (152 mm) above the ground
or the floor level of the area receiving the discharge and pointing
downward.
The end of the discharge pipe shall not be threaded.
Table P2904.4.1. Water service installation is amended by the deletion of
all references to "Polybutylene (PB) plastic pipe and tubing".
Sec. P2904.5. Water -distribution pipe is hereby amended by deleting the
reference to "PB" plastic pipe.

Sec. P3111.1. Type of fixture is amended to read as follows:
Sec. P3111.1. Type of fixture. A combination waste and vent system shall
not serve fixtures other than floor drains, standpipes, and indirect waste
receptors. Combination drain and vent systems shall not receive the
discharge of a food waste grinder.
Sec. P3111.2. Installation is amended to read as follows:
Sec. P3111.2. Installation. The only vertical pipe of a combination drain
and vent system shall be the connection between the fixture drain of a
standpipe, and the horizontal combination waste and vent pipe. The
maximum vertical distance shall be eight (8) feet (2438 mm).
Chapter 33 General Requirements is hereby amended to read as follows:

Section 4. Any person violating any of the provisions of this ordinance shall be
deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not
to exceed Two Thousand Dollars ($2,000.00) for each offense and a separate offense
shall be deemed committed each day during or on which an offense occurs or
continues.
Section 5. All ordinances or any parts thereof in conflict with the terms of this
ordinance shall be and hereby are deemed repealed and of no force or effect.
Section 6. If any section, subsection, sentence, clause or phase of this
ordinance shall for any reason be held to be invalid, such decision shall not affect the
validity of the remaining portions of this ordinance.

Section 7. The fact that the present ordinances and regulations of the City of
Grapevine, Texas are inadequate to properly safeguard the health, safety, morals,
peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an
emergency for the immediate preservation of the public business, property, health,
safety and general welfare of the public which requires that this ordinance shall become
effective from and after the date of its passage, and it is accordingly so ordained.
Section 8. That this ordinance shall become effective on January 1, 2002.
