The City Council of the City of Grapevine, Texas met in Special Session on this the
20th day of September, 1994 at 7:00 p.m. in Conference Room #204, 307 West
Dallas Road, with the following members present to-wit:

CALL TO ORDER
Mayor Tate called the meeting to order at 7:15 p.m.
ITEM 1 . EXECUTIVE SESSION
Mayor Tate announced the City Council would conduct a closed session regarding
pending or contemplated litigation relative to Dallas/Fort Worth International Airport
Board's decision relative to proposed Runway 16/34 West under Section 551 .071,
Texas Government Code.
Upon reconvening in open session in the Council Chambers, Mayor Tate asked if there
was any action necessary relative to the closed session. City Manager Trent Petty
stated there was no action necessary relative to pending or contemplated litigation
relative to Dallas/Fort Worth International Airport Board's decision relative to proposed
Runway 16/34 West under Section 551 .071, Texas Government Code.
NOTE: City Council continued with the Regular City Council meeting.

Council Member Spencer, seconded by Council Member Wilbanks, offered a motion
to adjourn the meeting at 9:25 p.m. The motion prevailed by the following vote:

1 . Mayor Tate to present a proclamation declaring the weeks of September 30
through October 21, 1994 as the 1994 City of Grapevine Employees'
Campaign for GRACE and United Way.
JOINT PUBLIC HEARINGS
2. City Council and Planning & Zoning Commission to conduct a public hearing
relative to Conditional Use Application CU94-20 submitted by Boxies Cafe
requesting a waiver to specific requirements of Section 47E.2 pursuant to
Section 47F of Ordinance No. 82-73, as amended, and requesting a conditional
use permit for an amendment to a site plan approved by Ordinance No. 94-29
for changes to the exterior building elevation and floor plan in conjunction with
the possession, storage, retail sale and on-premise consumption of alcoholic
beverages (beer, wine, and mixed beverages) in conjunction with the operation
of a restaurant. The property is located at 1293 William D. Tate Avenue and
zoned "HC" Highway Commercial District Regulations with a conditional use
permit for a planned commercial center.
3. City Council and Planning & Zoning Commission to conduct a public hearing
relative to Conditional Use Application CU94-21 submitted by Chevron, USA
requesting a wavier to specific requirements of Section 47E.2 pursuant to
Section 47F of Ordinance No. 82-73, as amended, and requesting a conditional
use permit for an amendment to a site plan approved by Ordinance No. 94-38
to remove the existing automatic car wash to allow a �estaurant with a drive- '
through window in conjunction with an existing gasoline service station and
convenience store with the possession, storage, retail sale and off-premise
consumption of alcoholic beverages (beer and wine) and the relocation of a '
twenty foot (20') pole sign. The property is located at 2035 West Northwest
3 Highway and is zoned "CC" Community Commercial District Regulations with
a conditional use permit for a planned commercial center.

relative to Conditional Use Application CU94-22 submitted by EI Fenix

` conjunction with the operation of a restaurant. The property is located at 401
State Highway 114 West and is zoned "CC" Community Commercial District
Regulations with a conditional use permit for a planned commercial center.

relative to Conditional Use Application CU94-26 submitted by Don Pablos
Restaurants requesting a waiver to specific requirements of Section 47E.2
pursuant to Section 47F of Ordinance No. 82-73, as amended, and requesting

Regulations with a conditional use for a planned commercial center.
8. City Council and Planning & Zoning Commission to conduct a public hearing
relative to Special Use Permit SU94-02 submitted by Cinemark, USA requesting
a waiver to specific requirements of Section 47E.2 pursuant to Section 47F of
Ordinance No. 82-73, as amended, and requesting a special use permit to allow
a maximum of 45 skill or coin-operated machines with a redemption center in
conjunction with the operation of a seventeen (17) screen movie theater and
four (4) food service areas. The property is located at 910 State Highway 114
and is zoned "CC" Community Commercial District Regulations.

PUBLIC HEARING
9. City Council to conduct a public hearing relative to SS94-03 submitted by Mr.
Lanny Wilkinson for the Mustang Elite Car Wash to amend the approved site
plan of SS94-02 to relocate rear parking, add a hand wash bay and take any
necessary action.
NEW BUSINESS
10. Consider an ordinance repealing Ordinance No. 89-95 and providing for the
exemption from ad valorem taxation of freeport goods and take any necessary
action.
CONSENT AGENDA
Consent items are deemed to need little Council deliberation and will be acted upon
as one business item. Any member of the City Council or member of the audience
may request that an item be withdrawn from the consent agenda and placed before
the City Council for full discussion. Approval of the consent agenda authorizes the
City Manager, or his designee, to implement each item in accordance with Staff
recommendations.
11 . Consider an ordinance amending the Grapevine Code of Ordinances, Chapter
23 Traffic, Section 23-63, No Parking; Restricted Parking relative to no parking
on Barton Street to relieve a conflict within the City Code. Public Works
Director recommends approval. '

12. Consider an ordinance amending the Grapevine Code of Ordinances, Appendix
E, Construction Standards, Article I, Item 1 .5.1, Inspection Fees to institute a �
Drainage Inspection Fee to be applied to all single-family and duplex
development at the time of building permit application and to swimming pool
construction at the time of permit application within the City of Grapevine. �

13. Consider an ordinance amending the Grapevine Code of Ordinances, Chapter
23 Traffic, Section 23-27 Speed Limits; Schedules of Additional School Zones
to establish school zones on BaII Street. Public Works Director recommends
approval.
14. Consider award of Bid 94-539 Uniform Rental and Service Contract to the
lowest and best bidder meeting specifications, Aratex Services, to establish
contract pricing. Staff recommends approval.
15. Consider award of Bid 94-542 Book Lease Plan to the lowest and best bidder
meeting specifications, Brodart Co. dba McNaughton Book Service. Library
Director recommends approval.
16. Consider award of Bid 94-543 Lubricants Supply Contract to the lowest and
best bidder meeting specifications, Gilco Lubricants, to establish contract
pricing for the lubricants and to reject all bids for Item 4. Staff recommends
approval.
17. Consider award of Bid 94-549 Janitorial Services for twelve city facilities to the
lowest and best bidder meeting specifications, Building Contractors, Inc. Staff
recommends approval.
18. Consider award of Bid 94-550 Plastic Bag Supply Contract to the lowest and
best bidders meeting specifications: Winzen International and Empire Paper
Co., to establish contract pricing. Staff recommends approval.

20. Consider the recommendation of the Planning & Zoning Commission relative to

subsequent ordinance, if applicable. The applicant is requesting a waiver to
specific requirements of Section 47E.2 pursuant to Section 47F of Ordinance
No. 82-73, as amended, and requesting a conditional use permit to amend a
' site plan approved by Ordinance No. 84-02 to expand the future development
area for unpaved outside storage of construction materials and an eight foot
(8') wooden fence on the northern property line on property located at 340
West Northwest Highway and zoned "HC" Highway Commercial District
Regulations and "SP" Site Plan District Regulations. The item was tabled at the
August 16, 1994 City Council meeting.
21 . Consider the recommendation of the Planning & Zoning Commission relative to

ITEM 1 PRESENTATION PROCLAMATION, 1994 CITY OF GRAPEVINE
EMPLOYEES CAMPAIGN FOR GRACE AND UNITED WAY
Mayor Tate presented a proclamation declaring the weeks of September 30 through
, October 21, 1994 as the 1994 City of Grapevine Employees' Campaign for GRACE
and United Way. Assistant to the City Manager David Tesmer reported that
employees had met last year's goal of S 16,000.00 and had set this year's goal at
S 17,000.00. :
ITEM 2. PUBUC HEARING, CONDITIONAL USE APPLICATION CU94-20, BOXIE'S
CAFE
Mayor Tate declared the public hearing open.
Planner Marcy Ratcliff advised Conditional Use Application CU94-20 had been
submitted by Boxie's Cafe requesting a waiver to specific requirements of Section
47E.2 pursuant to Section 47F of Ordinance No. 82-73, as amended, and requesting
a conditional use permit for an amendment to a site plan approved by Ordinance
No. 94-29 for changes to the exterior building elevation and floor plan in conjunction
with the possession, storage, retail sale and on-premise consumption of alcoholic
beverages (beer, wine, and mixed beverages) in conjunction with the operation of a
2,610 square foot restaurant. There are 28 parking spaces required and the applicant
is providing 27 spaces on their lot with the last parking space to be located on the
Midas Muffler property next door. The property is located at 1293 William D. Tate
Avenue and zoned "HC" Highway Commercial District Regulations with a conditional
use permit for a planned commercial center.
Mr. David Hensley represented the applicant before the City Council and Planning &
Zoning Commission requesting favorable consideration of the conditional use
application.
There were no questions from the City Council or Planning & Zoning Commission. :
Council Member Pittman commented that parking in the area was inadequate.
Mayor Tate invited guests present to comment regarding the conditional use
application. No one wished to speak and there was no correspondence to report.
Commissioner Martin, seconded by Young, offered a motion to close the public
hearing. The motion prevailed by the following vote:

Mayor Tate declared the public hearing open.

by Chevron, USA requesting a waiver to specific requirements of Section 47E.2
pursuant to Section 47F of Ordinance No. 82-73, as amended, and requesting a
conditional use permit for an amendment to a site plan approved by Ordinance
No. 94-38 to remove the existing automatic car wash to allow a restaurant with a
drive-through window in conjunction with an existing gasoline service station and
convenience store with the possession, storage, retail sale and off-premise
consumption of alcoholic beverages (beer and wine) and the relocation of a twenty
foot (20') pole sign on Park Boulevard with 50% changeable copy. The applicant is
proposing to develop a 1,355 square foot restaurant (McDonald's) and is required to
provide 11 parking spaces along with the required four parking spaces for the

Mr. John Bauerfeld, 3327 Wintergreen Terrace,addressed the City Council concerning
the plat of Stonewood II. He stated two issues of concern: the effective transition
of property from Druid Hills to Stonewood II and the potential drainage onto their
property. He recommended the fol�owing adjustments to the proposed plat: reduction
of the proposed lots from seven to six; move Hightimber Drive to the east off the
, crest of the hill; and construct a cost effective barrier along the Druid Hills/Stonewood
II boundary to channel water southeast to Barberry Road.
ITEM 8B. CITIZENS REQUEST, MR. MARK S. GWILLIM
Mr. Mark S. Gwillim, 3315 Wintergreen Terrace, stated his concerns regarding the
proposed development of Stonewood II and the way the development on Pool Road
is dramatically changing the property to accommodate building sites. He stated he
was not against the development of Stonewood 11, but asking that the City and the
developer show respect for the character, drainage and value of his neighborhood
during the development process.
ITEM 8C. CITIZENS REQUEST. MR. WAYNE HOLLISTER
Mr. Wayne Hollister, 3413 Wintergreen Terrace, noted his support of the statements
made by his neighbors regarding the possible impacts of the proposed Stonewood II
development on their properties. He expressed his concern regarding the drainage

impact on his property from the proposed Stonewood II development. He stated there
were presentations made by the proposed developer in 1990 that no water would
cross the property lines between Wintergreen and the proposed Stonewood II
development and that he believes it should remain that way if developed today.
ITEM 8D. CITIZENS REQUEST, MR. CARY KYHL
Mr. Cary Kyhl, 3303 Wintergreen Terrace, expressed his support of the comments
made by his neighbors regarding the proposed Stonewood II development. He
recommended the following as a minimal impact on the proposed development to
create a harmonious transition from one neighborhood to the next: remove one lot
from block 1 and move Hightimber Drive east by five feet to decrease drainage
problems and preserve the natural character of the land.
ITEM 9. PUBLIC HEARING. SERVICE STATION PERMIT SS94-03. MUSTANG
ELITE CAR WASH
Mayor Tate declared the public hearing open.
Community Development Director H. T. Hardy stated Service Station Permit SS94-03
had been submitted by Mr. Lanny Wilkinson for Mustang Elite Car Wash requesting
to amend the site plan approved by Service Station Permit SS93-04 for a car wash
with gasoline sales and lube center on property located at 2125 Ira E. Woods Avenue.
The applicant requested to add a hand wash bay at the rear property line and move
the adjacent parking at the rear to the rear property line. The applicant appeared
before the Board of Zoning Adjustments (BZA) requesting variances to the rear yard
building set back and variances to the landscape regulations between the property line
and vehicular use area. The BZA could find no special condition for the requests and
denied the requests.
Mr. Hardy stated that the proposed site plan does not meet the City's Zoning
Ordinance and recommended the City Council deny the request for the amendments
to the site plan.

ITEM 10. ORDINANCE, FREEPORT TAX EXEMPTION. REPEAL ORDINANCE
NO. 89-95
Community Development Director H. T. Hardy recommended the City Council approve
an ordinance repealing Ordinance No. 89-95 adopted in 1989 which allowed the City
to take official action to tax freeport goods. The proposed ordinance, which would
be effective beginning with tax year 1995, would provide for an exemption from ad
valorem taxation for freeport goods and assist in the promotion of economic
development. The strategic location in the center of the Metroplex and proximity to
Dallas/Fort Worth International Airport, as well as the freeport tax exemption, makes
Grapevine an excellent location for industrial distribution facilities. Mr. Hardy noted
that Tarrant County offers the exemption, which would give Grapevine a competitive
edge in attracting distribution facilities.
Finance Director Larry Koonce briefly reviewed the potential financial impact to the
City if the freeport tax exemption were to be granted. He noted there are five
companies currently receiving the Freeport Tax Exemption from Tarrant County. If the
Freeport Tax Exemption is granted by the City, no companies would qualify until tax
year 1995. City Manager Petty stated the freeport tax exemption is not a tax
abatement program and the potential gain of new businesses and new jobs would
justify the potential loss against the potential gain.

ITEM 28. PLANNING & ZONING COMMISSION RECOMMENDATION
PRELIMINARY PLAT, STONEWOOD PHASE II
Mayor Pro Tem Ware conducted this portion of the meeting.
Community Development Director Hardy reported the Commission voted 4-3 to
approve the Statement of Findings relative to the preliminary plat of Stonewood Phase
II and approve the preliminary plat of Stonewood Phase II. The property is being
platted for development of a 57 lot single family residential subdivision located on the
north side of Barberry Road west of W. T. Parr Road.
Council discussion ensued relative to addressing the drainage concerns of the
neighboring citizens. Public Works Director stated the preliminary plat meets the
City's requirements and the drainage issues would be addressed with the submittal
of the construction plans.
Motion by Council Member Traverse, seconded by Council Member Wilbanks, to
accept the Planning & Zoning Commission's recommendation to approve the
Statement of Findings relative to the preliminary plat of Stonewood Phase II and
approve the preliminary plat of Stonewood Phase II prevailed by the following vote:
Ayes : Ware, Spencer, Wilbanks, Traverse, Pittman & Wickman
Nays : None
Abstain : Tate
ITEM 29. PLANNING & ZONING COMMISSION RECOMMENDATION
FINAL PLAT. TOWN PARK ADDITION PHASE II
Community Development Director Hardy reported the Commission voted 7-0 to
approve the Statement of Findings relative to the final plat of Town Park Addition
Phase II and approve the final plat of Town Park Addition Phase II. The property is
being platted for development of a 66 lot single family residential subdivision located

on the southwest corner of Mustang Drive and Heritage Avenue.
Motion by Council Member Wiibanks, seconded by Mayor Pro Tem Ware, to accept
the Planning & Zoning Commission's recommendation to approve the Statement of
Findings relative to the final plat of Town Park Addition Phase II and approve the final
plat of Town Park Addition Phase II prevailed by the following vote:
Ayes: Tate, Ware, Spencer, Wilbanks, Traverse, Pittman & Wickman
Nays: None
ITEM 30. PLANNING & ZONING COMMISSION RECOMMENDATION
FINAL PLAT. NICODEMUS ADDITION
Community Development Director Hardy reported the Commission voted 7-0 to
approve the Statement of Findings relative to the final plat of Nicodemus Addition and
approve the final plat of the Nicodemus Addition with a circle drive as opposed to one
drive backing onto Dove Road. The property is being platted for development of a
single family residence located on the east side of Dove Road, south of Dove Road
Ranchettes.
Motion by Council Member Spencer, seconded by Mayor Pro Tem Ware, to accept the
Planning & Zoning Commission's recommendation to approve the Statement of
Findings relative to the final plat of Nicodemus Addition and approve the final plat of
the Nicodemus Addition to include the circle drive prevailed by the folluwing vote:
Ayes: Tate, Ware, Spencer, Wilbanks, Traverse, Pittman & Wickman
Nays: None
ITEM 31 . PLANNING & ZONING COMMISSION RECOMMENDATION
FINAL PLAT. THE OAKS OF LONESOME DOVE
Community Development Director Hardy reported the Commission voted 7-0 to
approve the Statement of Findings relative to the final plat of The Oaks of Lonesome
Dove and approve the final plat of The Oaks of Lonesome Dove. The property is
being platted for development of a single family residence located on the east side of
Lonesome Dove Road, north of Fire Fox.
Motion by Council Member Pittman, seconded by Council Member Traverse, to accept
the Planning & Zoning Commission's recommendation to approve the Statement of
Findings relative to the final plat of The Oaks of Lonesome Dove and approve the final
plat of The Oaks of Lonesome Dove prevailed by the following vote:
Ayes: Tate, Ware, Spencer, Wilbanks, Traverse, Pittman & Wickman
Nays: None
