SUBJECT: DESIGN CONTRACT AMENDMENT # 3 — ELEVATED
STORAGE TANK
RECOMMENDATION:
City Council consider approving Amendment # 3 to the Engineering Services Contract
with Freese & Nichols, Inc. for the elevated Storage Tank Project in an amount not to
exceed $91,000.00, authorize staff to execute said amendment, and take any necessary
action.

BACKGROUND:

City Council approved the original contract with Freese & Nichols, Inc. for the design of
the elevated storage tank in an amount of $ 143,900.00 on March 28, 2000 and contract
modifications # 1 and 2 in the total amount of $58,500.00 on August 6, 2001. These
past contract modifications included design of two climate controlled floors for storage of
City records and investigation of the water system model.
The proposed contract amendment # 3 in an amount of $ 91,000.00 with Freese &
Nichols provides specialized construction inspection and material testing services for the
construction of the 2 Million Gallon water tower and the storage facilities incorporated in
the tower. City Staff does not have the specific expertise in elevated water tank
construction to provide the services needed for this project.
Staff has anticipated this third party inspection and testing need since the outset of the
design of the project and has maintained a budget item for these services in the overall
project budget.
Staff recommends approval.

Additional Services for Construction
Dear Mr, Laster:
We are please to provide additional construction services for the installation of the new 2.0 million
gallon elevated tank. In accordance with your request, we propose to use Deltatek Engineers as a
sub contractor to perform the bulk of the additional construction services. We are estimating at this
time that these services will be performed over an eighteen month period beginning in February 2002
and ending in August 2003.
Our scope for additional services include the following items:
SCOPE Of SERVICES
Item. 1. Project Administration
1. Attend pre-eonstxuetion, and progress meetings during construction. Record or list
meeting notes to be included into meeting minutes.
2. Review pay requests with the Contractor and make recommendations to the OWNBR for
payment.
3. Perform on site observation as required by the project activities. Consultant's on site
visits shall be coordinated with the activities of the Contractor and shall be sufficient in
number to assure all installations and tests can be observed as outlined in the folluwrizrg
scope of service items.
4. Review project changes and assist the Contractor with project mark-ups for use in
preparation of "Record Drawings".
5. Perforin substantial project completion walls-diru and prepare list of items to be corrected
or addressed.

6. Perform final project walk-thm and assist the OWNER with the project closeout.
Item 2. Architectural
1. Provide on site observation for installation of doors, windows, floors, ceilings, and
interior finish out.
Item 3. Concrete Testing
Consultant will provide on-site technician to collect concrete compressive strength
cylinders for the tank support system to include but not limited to the foundation,
concrete pedestal and structural floors.
2. As a minimum, one set of four cylinders will be collected and tested at 14 day and 28 day
for each 30 cubic yards of concrete placed as part of the tower foundation, pedestal and
support system.
3. Each lift of concrete pedestal will be tested using one set of four cylinders per lift.
4. Test cylinders will be collected and tested for all structural floors.
S_ Consultant will review placement of the reinforcement steel and the orientation will be
checked for compliance with the contractor's shop drawings, construction documents,
local code, and ACI.
Item 4. Steel Fabrications
1. Consultant will inspect the steel fabrication and welded joints for compliance with AWS,
AW"WA D100, and perform radiographic testing (x-ray) to ensure sufficient weld
penetration has been provided.
Item 5. 'Ward Piping
Provide on-site observation of installation of yard piping and pipe embedment. This
shall include valve boxes, vaults, and manholes_ Verify backfill densities for pipe
embedments.
2. Witness hydrostatic pressure testing of all pressure piping.
3. Witness low pressure air testing of installed sanitary sewer system piping and manholes.
Item 6. Mechanical and HVAC
1. Provide on-site observation of installation and testing of all mechanical equipment
including but not limited to heating, air conditioning, plumbing, fire protection and
elevator systems.

Item 7. Electrical Systems

Provide on-site observation of installation and testing of all electrical installation system
including but not limited to conduit, wiring, disconnects, switches, and lighting.
Item 8. Instrumentation and Controls
Provide on-site observation ofinstallation and testing of all instrumentation and controls
including but not limited SCADA system and interfacing with existing SC.4DA system,
water level control valves and related pressure sensors, and alarm systems.
Item 9. Coating Applications
Consultant shall inspect surface preparation and shop prime coat applications work to be
incorporated into the project.
2. Consultant will verify the application of prime, intermediate and final coatings and layer
thickness in accordance with the specifications as outlined in Section 9901 and Section
9905.
Services to be performed include:
a_ Check surface preparation of tank interior and exterior.
b. Measure surface profile of metal substrate for interior and exterior of tank and all
other metals scheduled for coating.
c. Inspect immediate coat applications and measure vet film thickness of all items
scheduled for coatings.
d. Measure dry film thickness of all items scheduled for coatings
e. Perform holiday detection test on tank interior.
Item 10. Miscellaneous Improvements and Site Clean-up
Provide on site observation for miscellaneous improvements, temporary grading and
site clean-up as directed by the Owner. It is anticipated that the final site grading,
fencing, site lighting and Final landscaping will be performed by the Owner after final
completion of the construction project.
Item 11. Time of Completion
This additional service has been, prepared with the following milestone dates. The
agreement shall remain in effect until completion of the work as outlined in the
milestones:
1. Project Pre -construction Meeting February 1, 2002
2, Project Award by Owner February 5, 2002
3. Substantial Completion of Water Storage February 1, 2003
4. 100 Percent Project Completion & Final Walk Through July 31, 2003
5. Submittal of "As -Built" Drawings to the Owner August 31, 2003

We respectfully request an amendment to the SPECL�L SERVICES section of our existing contract
amount for the additional work to be perforrn.ed. We request an additional amount not to exceed $
91,000 for the additional services as listed above. This additional request will modify the current
contract amount as follovvs:
Original contract amount for Basic Services $121,000.00
Modification to Basic Services $ •49,000.00
Subtotal Basic Services $170,000.00
Original contract amount for Special Services $ 22,900.00
Proposed Additional Construction Services $ 91,000.00
Subtotal Special Services $113,900.00

Dear lair. Robertson:
In accordance wit: your fax dated February 7, 2002, we have amended the request letter to Mr. Stan
Laster. These amendments include adding testing of backfill densities for pipeline embedment and
we have added the term "not to exceed" in our fee request.
With regard to our fee break down, we have included the following:
1. Adjusted our request as per our discussion with Mr. Mike Brownlee.
2. Amended the total number of site visits for Project Administration by the sub consultant .
3. Added a column indicating the Sub Consultants Billable rates for this project.
4. Indicated the unit costs for the various tests that will be performed.
5. Updated our spread sheet to indicate current totals and a not to exceed fee request of
$91,000.
