SUBJECT: EASEMENT ABANDONMENT — 1600 WEST NORTHWEST
HIGHWAY
RECOMMENDATION:
City Council consider adopting an ordinance abandoning a 20 -foot wide sanitary sewer
easement located at 1600 West Northwest Highway, on a 21.591 acre tract of land in the
Thomas Mahan Survey, Abstract No. 1050, as recorded in Volume 6321, Page 738, Deed
Records of Tarrant County, Texas, and take any necessary action.
BACKGROUND INFORMATION:
The owner of 1600 West Northwest Highway, Joe L. Wright, has requested that the 20 -foot
sanitary sewer easement be abandoned. Portions of the existing sanitary sewer
improvements are not located within the dedicated easement. A revised 15 -foot sanitary
sewer easement will be dedicated by plat to reflect the actual field location of the existing
sanitary sewer improvements.
The Developer has requested that the City abandon the existing easement to accurately
reflect the location of existing sanitary sewer improvements.
Staff recommends approval.

BEING a portion of a perpetual twenty (20') feet sanitary sewer easement to the City of
Grapevine located in the Thomas Mahan Survey, Abstract No. 1050, situated in the City of
Grapevine, Tarrant County, Texas, and as recorded in Volume 6321, Page 738 of the Deed
Records of Tarrant County, Texas, said portion of easement to be abandoned being the entirety
of said easement within a 21.591 acre tract of land in the Thomas Mahan Survey, Abstract No.
1050, situated in the City of Grapevine, Tarrant County, Texas, and as recorded in Volume
13006, Page 405 of the Deed Records of Tarrant County, Texas, and being more particularly
described by metes and bounds as follows:
Said perpetual easement across the above described tract being twenty (20') feet in width with
centerline being more particularly described as follows:
COMMENCING at the northeast corner of said 21.591 acre tract, said corner also being
a.the southeast corner of Dove Creek Phase I as described in Volume 388-158, Page 14
Plat Records of Tarrant County, Texas;
THENCE North 89 degrees 24 minutes 52 seconds West, along the north line of said
21.591 acre tract and the south line of said Dove Creek Phase I, a distance of 185.40 feet
to a point, said point being the POINT OF BEGINNING for the centerline of said twenty
(20') feet sanitary sewer easement;
THENCE South 57 degrees 16 minutes West, departing the north line of said 21.591 acre
tract and the south line of said Dove Creek Phase I, a distance of 211.0 feet;
THENCE South 87 degrees 25 minutes West, continuing along said centerline, a distance
of 107.6 feet;
THENCE South 81 degrees 17 minutes West, continuing along said centerline, a distance
of 436.1 feet;
THENCE South 54 degrees 50 minutes West, continuing along said centerline, a distance
of 164.4 feet;
THENCE South 35 degrees 35 minutes West, continuing along said centerline, a distance
of 310.8 feet;
THENCE South 72 degrees 20 minutes West, continuing along said centerline, a distance
of 24.1 feet to a point in the north line of Lot 1, Block 1, Hubbell DDS Addition as
described in Cabinet A, Slide 3944, of the Plat Records of Tarrant County, Texas;
Said portion of perpetual easement being twenty (20') feet in width and total length of
1254.0 feet, more or less, measured along the centerline of said perpetual easement.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS, ABANDONING AND VACATING A
TWENTY FOOT (20') SANITARY SEWER EASEMENT IN
THE CITY OF GRAPEVINE, TEXAS AS HEREINAFTER
DESCRIBED; PROVIDING A SEVERABILITY CLAUSE;
DECLARING AN EMERGENCY AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, the property owner of a portion of a twenty foot (20') sanitary sewer
easement located on 1600 West Northwest Highway, recorded in Volume 6321, Page 738,
Deed Records of Tarrant County, Texas, more specifically described in Exhibits "1" and "2"
attached hereto and incorporated herein for all purposes, has requested the sanitary sewer
easement, as herein after described be abandoned and vacated; and
WHEREAS, the sanitary sewer easement is not needed for public use and will not
be needed in the future for public use; and
WHEREAS, abandoning and vacating the said sanitary sewer easement will relieve
the City of Grapevine, Texas from the cost and expense of maintaining said property.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1. That all matters stated in the preamble of this ordinance are true and
correct and are hereby incorporated into the body of this ordinance as if copied in their
entirety.
Section 2. That the sanitary sewer easement located within the property
described in Exhibits 1" and "2", attached hereto and incorporated herein for all purposes,
is hereby abandoned and vacated for public use and the same is hereby abandoned and
vacated insofar as all public right, title, interest in and to said sanitary sewer easement is
concerned.
Section 3. That the terms and provisions of this ordinance shall be deemed to be
severable, and that if the validity of any section, subsection, word, sentence or phrase shall
be held to be invalid, it shall not affect the remaining part of this ordinance.
Section 4. The fact that the sanitary sewer easement is no longer needed by the
public for public usage and would create a hardship or burden upon the City of Grapevine
to keep open and maintain such sanitary sewer easement creates an urgency and an
emergency for the immediate preservation of the public health, safety, and general welfare

which requires that this ordinance shall take effect immediately from and after its passage
and it is accordingly so ordained.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS on this the 5th day of March, 2002.
