REQUESTED ZONE CHANGE AND COMMENTS:
The applicant is requesting a zone change to rezone approximately 61 acres from r`PID"
Planned Industrial Development District to "R-MF-1" Multifamily District for the development
of a 600-unit apartment complex.
Mr. Stone proposes to develop an apartment complex similar in style to the three-phase
complex he has developed just south and west of the subject site. The layout and building
design will follow the same general scope as his other projects i.e. three story buildings
with garages along the first floor, and reduced building setbacks. At the City Council's
March 5, 2002 worksession, Council authorized Staff to proceed with a zoning text
amendment to Section 21, "R-MF-1" Multifamily District Regulations extending the % mile
distance reference from the Grapevine Mills Mall for apartment projects with three story
building height and reduced building setbacks as a conditional use. This text amendment
will be placed on the April 16, 2002 Council agenda. With this request, Mr. Stone has
submitted deed restrictions to demonstrate to Council his intention to develop a project that

meets or exceeds the standards he has set for this type of project in the immediate vicinity.
In the deed restrictions Mr. Stone agrees to develop the property as follows:

• Present an architectural style similar to that of the existing multifamily projects in the
area.
• Total number of units will not exceed 600.
• At least 60 percent of the units will have garages with direct access.
• The average unit size will be at least 950 square feet.
• The property will contain a park and lake areas similar to the attached concept plan.
With approval from Council on this requested zone change and approval of the zoning text
amendment at the April 16, 2002 meeting, Mr. Stone will subsequently present to Council
a conditional use request for the 600-unit apartment complex with a complete site plan for
the project. This will be the first reading of an ordinance.
PRESENT ZONING AND USE:
The property is currently zoned "PID" Planned Industrial Development District and is
undeveloped.
HISTORY OF TRACT AND SURROUNDING AREA:
The subject and surrounding property was zoned 1-1" Light Industrial District prior to the
1984 City Rezoning. The property to the southeast, previously zoned "R-MF-1" Multifamily
District as part of the large "Terra Tract" rezoning of 1985 was rezoned at the November
20, 2001 meeting (Z01-15) to "CC" Community Commercial District.

NORTH: City of Flower Mound
SOUTH: "CC" Community Commercial District--undeveloped
EAST: "PID" Planned Industrial Development District--undeveloped
WEST: "PID" Planned Industrial Development District--undeveloped

AIRPORT IMPACT:
The subject tract is located within "Zone B" Middle Zone of Effect as defined on the "Aircraft
Sound Exposure: Dallas/Fort Worth Regional Airport Environs" Map. In "Zone B" the
following uses may be considered only if sound treatment is included in building design:
multifamily apartments, motels, office buildings, movie theaters, restaurants, personal and
business services. Single family residential and sound sensitive uses such as schools and
churches should avoid this zone. The applicant's proposal is an appropriate use in this
noise zone.
MASTER PLAN APPLICATION:
The Master Plan designates the subject property as an Industrial land use. The applicant's
request is not in compliance with the Master Plan.

Property at the time of the issuance of the certificate of occupancy are in compliance with
this Declaration.
5, Binding Eft and Duration — These covenants shalll remain in force and effect for a
period of years from the crate of execution of this instrument and
shall be extended for continuous period of five (5) years unless ternninated by written
agreement of the City and the then current owner of the Property.
6. Amendments —This Declaration may be amended only pursuam to a written amendment
executed by City and the then current owner of the Property and recorded in the Read
Records of Tarrant County,Texas.
7. Enforcement—The City shall have the rigk (but not the duty)to enforce the provisions
of this Declaration. Eoforcemeut shall be by any proceeding at law or in equity against
any person or persons violating or attempting to violate any part of the Declaration,either
to restrain violation or to recover damages. Failure by the City to enforce any provision
of the Declaration shall in no event be deemed a waiver of the right to do so thereafter.
With respect to any litigation hereunder, the prevailing party shall be entitled to recover
court costs and reasonable allomeys'fees from the non-prevailing party.
8. Severab--Agy — Itnvand=en of any one or more of tl:e cevenants, conditions and
restrictions contained herein, or any portion thereof; by a judgment or court order shall
not affect any of the other provisions herein contained, wihieh shall remain in full force
and effect. In the event any provision of the instrument requires an act that would violate
any law, ordinance or regulation promulgated by a govemmentsl body having
