The site contains 1.791 acres. y The property has approximately 206 feet of frontage = along the eastbound service road of West State Glade Rd - Highway 114 and 153 feet of frontage along s Crossroads Drive. REQUESTED CONDITIONAL USE AND COMMENTS: The applicant is requesting a conditional use permit to amend the previously approved site plan of CU03-17 (Ord. 2003-31) for a planned commercial center with the possession, storage, retail sale, and on-premise consumption of alcoholic beverages(beer, wine, and mixed beverages) specifically to revise the building elevations, floor plan, allow outdoor speakers, outside dining, a 40-foot pole sign and a 20-foot pole sign in coniunction with a restaurant. The applicant intends to convert the former Tilted Kilt into a Daylight Golf Restaurant. This is a casual dining restaurant which also features golf simulators to enhance the patrons dining experience. A change to the floor plan includes adding five golf simulators which will allow patrons to simulate golf play within a climate controlled environment. A change to the building elevation includes the addition of a shade structure covered 1,440 square foot 1 October 10,2018(8 03 AM) 0 IZCWC1118-28 d patio on the east side of the building. The proposed restaurant will seat 238 patrons; 95- seats outside and 143-seats inside. The total proposed 238-seats is a reduction of 52- seats, from the 290-seats of the previous tenant. Total required parking is 110 parking spaces-123 parking space have been provided. Eleven television monitors and four outdoor speakers are proposed on the patio. A portion of the bar is accessible from the outdoor patio by way of operable windows. A new entry feature, wooden accents, new stucco, new stone veneer, wall sconces, new entry doors and painted brick sum up the proposed exterior changes. The applicant also requests a 40-foot pole sign and a 20-foot pole sign on the subject property. The previous operator(Tilted Kilt) had a 40-foot pole sign and a 20-foot pole sign on site. When that restaurant closed the cabinets were removed but the poles remained. The current request is for a 288-square feet, 40-foot pole sign and 108-square feet,20-foot pole sign, in the same locations as the previous signs. PRESENT ZONING AND USE: The property is currently zoned "CC", Community Commercial District with conditional use permits for a planned commercial center and on-premise alcoholic beverage sales and consumption. HISTORY OF TRACT AND SURROUNDING AREA: The subject and surrounding property was zoned "I-1" Light Industrial District prior to the 1984 City Rezoning. The subject property was rezoned from "GU" Governmental Use District and "PID" Planned Industrial Development District to"CC"Community Commercial District with a master site plan for a Planned Commercial Center in conjunction with an Outback Steakhouse (Z92-04 and CU92-14). TGI Fridays amended the approved site plan (CU92-20) at the December 15, 1992 joint public hearing and developed a restaurant with on-premise consumption of alcoholic beverages and a 40-foot pole sign. California Pizza Kitchen was approved at the January 18, 1994 joint public hearing (CU93-14)which also allowed for a restaurant with on-premise consumption of alcoholic beverages and a 40-foot pole sign. CU94-03 was approved by Council on March 22, 1994 and allowed TGI Fridays to consolidate two smoking areas into one area with an approved floor plan. CU94-10 was approved by Council on May 17, 1994 and allowed for the development of a Don Pablo's Restaurant with on-premise consumption of alcoholic beverages and a 40-foot pole sign. CU94-11 was also approved at the May 17, 1994 joint public hearing which established a Boston Chicken Restaurant with a 40-foot pole sign within the planned commercial center. CU94-25 and CU94-26 were heard and approved at the September 20, 1994 joint public hearing—CU94-25 established a Red Robin Restaurant with on-premise consumption of alcoholic beverages and CU94-26 allowed changes to the floor plan for Don Pablo's restaurant. CU94-36 was approved at the December 20, 1994 joint public hearing and allowed for additional wall signage for the California Pizza Kitchen. CU95-07 established Denny's Restaurant with a 40-foot pole sign and was approved at the May 16, 1995 joint public hearing. CU95-18 was approved at the August 15, 1995 joint public hearing which O./ZCU/CU16-28.4 2 October 10,2016(12 25PM) allowed for a 40-foot pole sign and a 20-foot pole sign for Red Robin Restaurant. CU98-08 was approved on April 21, 1998 at the joint public hearing,which allowed for a 781 square foot expansion to the existing restaurant. CU98-29 was approved in July 1998, approving a revision to the floor plan of TGI Friday's Restaurant. The Site Plan Review Committee approved CU01-61 in October 2001 allowing interior and exterior renovations to TGI Friday's. The work was not started and the Conditional Use permit expired. At the May 20, 2003 Council approved a conditional use permit (CU03-12) to modify the floor plan and exterior elevations for TGI Friday's. Conditional Use Request CU04-18 was approved by Council at the May 18, 2004 meeting which allowed for on-premise alcohol beverages sales in conjunction with a restaurant (Buffalo Wild Wings) at the northeast corner of Crossroads Drive and William D. Tate Avenue. Conditional Use Request (CU04-36) and Special Use (SU04-03) were approved by City Council at the October 19, 2004 meeting which allowed for on-premise alcohol beverages sales and consumption and one pool table in conjunction with a restaurant (Boston's The Pizza Gourmet). The Site Plan Review Committee approved CU05-34 on May 25, 2005 allowed a 159-square foot, 40-foot pole sign for Buffalo Wild Wings. The Site Plan Review Committee approved CU06-43 on September 28, 2006 allowing a 603 square foot outdoor ding in area for Buffalo Wild Wings. The Site Plan Review Committee approved CU06-57 on December 21, 2006 allowing a patio cover for Buffalo Wild Wings. On the subject site a Conditional Use Request (CU09-01) and Special Use Request (SU09-01) was considered and denied by Council at their February 17,2009 meeting in which the applicant requested to add outside dining, a new 40-foot pole sign and one billiard table to the former TGI Friday's for a new restaurant concept called the Tilted Kilt. Conditional Use Request CU10-20(Ord. 2010-53) was approved by Council at the September 21, 2010 meeting which allowed for on-premise alcohol beverages sales, outside dining, outdoor speakers and two pole signs in conjunction with a restaurant (Plucker's Wing Bar) within the former Pablo's/Tio Joe's building on Crossroads Drive. Conditional Use Request CU11-03 (Ord. 2011-13) was approved by Council at the March 15, 2011 meeting which allowed for a revised floor plan and exterior elevations for Buffalo Wild Wings. Conditional Use Request CU11-05 (Ord. 2011-17)was approved by Council at the April 19, 2011 meeting which allowed for outside dining and on-premise consumption of alcoholic beverages in conjunction with a restaurant (Freebirds)within the former Denny's The Site Plan Review Committee approved CU15- 07 on March 7, 2015 to allow for updated exterior elevations changes for Hooter's. The site Plan Review Committee approved CU15-20 on July 8, 2015 to allow for updated exterior elevations and revising the existing pole sign cabinet. To the west, Classic Chevrolet has be granted numerous conditional use permits (CU91- 01, CU92-01, CU92-16, CU94-02)for a car dealership with automobile repair,40-foot pole signs, a used car showroom with eight service bays, parts storage, sales offices and a customer lounge area. CU95-15 was approved by Council on June 20, 1995 and allowed Classic Chevrolet a 6.354 acre expansion to develop a paint and body shop, a used car sales building, with display and inventory parking. CU96-31 was approved by Council on November 19, 1996 and allowed for an additional pole sign and the revision of sign copy on another. The City Council approved CU98-71 in January, 1999 permitting the installation of shade structures over the display parking area. The Site Plan Review 0/ZCU/CU16-28 4 3 October 10,2016(12 25PM) Committee approved C1107-06 on February 28, 2007 permitting the installation of a 32-foot aluminum arched entry feature to the existing main showroom and additional wall signage. The Hayley Addition to the north, another planned commercial center also has several retail stores,40-foot pole signs and numerous conditional use permits for restaurants with on-premise alcoholic beverage sales including Uncle Julio's which the City Council approved CU06-08 on April 18, 2008 on the site of a former movie theatre. SURROUNDING ZONING AND EXISTING LAND USE: NORTH: "HC" Highway Commercial District-In and Out Burger, Grimaldi's, La Madeleine, Chili's Grill and Bar, Pappadeaux Seafood Kitchen, P.F. Chang's Chinese Bistro and Uncle Julio's SOUTH: "CC" Community Commercial District-Cultural Catch, Original Pancake House, Red Robin, Hooter's, Pluckers Wing Bar, Buffalo Wild Wings and Red Robin. EAST: "CC" Community Commercial-Outback Steakhouse and Great Scott WEST. "CC"Community Commercial District-California Pizza Kitchen, Classic Chevrolet AIRPORT IMPACT: The subject tract is located within "Zone B" Middle Zone of Effect as defined on the "Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" map. In Zone B, the following uses may be considered only if sound treatment is included in building design: multi family apartments, motels, office buildings, movie theaters, restaurants,and personal and business services. Single family residential and sound sensitive uses such as schools and churches should avoid this zone. The proposed restaurant revision is an appropriate use in this noise zone. A portion of the planned commercial center at the southwest corner is located within"Zone C"zone of greatest effect as defined on the"Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" map. In Zone C, industrial and commercial uses that can tolerate a high level of sound exposure are appropriate. The proposed restaurant revision is an appropriate use in this noise zone. MASTER PLAN APPLICATION: The Master Plan designates the subject property as Commercial. Mfr - DAYLIGHT GOLF '._ III Daylight Golf is proposed as a unique entertainment venue with virtual golf,televised sports, and great food and beverage to operate at the 1041 West Hwy 114 address in Grapevine, Texas. The business will feature five state of the art golf simulators in exciting and comfortable environment where 30 large TV screens keep the guests up to date on all major sporting events. A full menu of food and beverages will satisfy the taste buds of a wide variety of patrons. A remodel of the exterior of the building along with the addition of a patio is proposed to enhance the property. The landscaping will be upgraded to increase curb appeal for the property and the neighborhood. This Conditional Use Permit Application requests approval for the above improvements.Also requested is the approval for the sale of alcoholic beverages, outdoor dining, and outdoor speakers. adequacy of parking as determined by requirements of this ordinance for off-street parking facilities; location of ingress and egress points for parking and off-street locating spaces, and protection of public health by surfacing on all parking areas to control dust; effect on the promotion of health and the general welfare; effect on light and air; the effect on the overcrowding of the land; the effect on the concentration of population; the effect on the transportation, water, sewerage, schools, parks and other facilities; and WHEREAS, the City Council of the City of Grapevine, Texas, at a public hearing called by the City Council of the City of Grapevine, Texas, did consider the following factors in making a determination as to whether this requested conditional use permit should be granted or denied; effect on the congestion of the streets, the fire hazards, panics and other dangers possibly present in the securing of safety from same, the effect on the promotion of health and the general welfare, effect on adequate light and air, the effect on the overcrowding of the land, the effect on the concentration of population, the effect on the transportation, water, sewerage, schools, parks and other public facilities; and WHEREAS, all of the requirements of Section 48 of Ordinance No. 82-73 have been satisfied by the submission of evidence at a public hearing; and WHEREAS, the City Council further considered among otherthings the character of the existing zoning district and its peculiar suitability for particular uses and with the view to conserve the value of buildings and encourage the most appropriate use of land throughout this City; and WHEREAS, the City Council of the City of Grapevine, Texas, does find that there is a public necessity for the granting of this conditional use permit, that the public demands it, that the public interest clearly requires the amendment, that the zoning changes do not unreasonably invade the rights of those who bought or improved propertywith reference to the classification which existed at the time their original investment was made; and WHEREAS, the City Council of the City of Grapevine, Texas, does find that the conditional use permit lessens the congestion in the streets, helps secure safety from fire, panic and other dangers, prevents the overcrowding of land, avoids undue concentration of population, facilitates the adequate provisions of transportation, water, sewerage, schools, parks and other public requirements; and Ordinance No. 2 WHEREAS, the City Council of the City of Grapevine, Texas, has determined that there is a necessity and need for this conditional use permit and has also found and determined that there has been a change in the conditions of the property surrounding and in close proximity to the property requested for a change since this property was originally classified and, therefore, feels that the issuance of this conditional use permit for the particular piece of property is needed, is called for, an is in the best interest of the public at large, the citizens of the City of Grapevine, Texas, and helps promote the general health, safety and welfare of this community. That the City does hereby issue a conditional use permit in accordance with Section 48 of Ordinance No. 82-73, the Comprehensive Zoning Ordinance of the City of Grapevine, Texas, same being also known as Appendix"D"of the City Code, by granting Conditional Use Permit CU16-28 to amend site plans CU03-17 SPRC and CU03-12 (Ordinance No. 2003-31)fora planned commercial center to allow the possession, storage, retail sale and on-premise consumption of alcoholic beverages(beer, wine, and mixed beverages), specifically to revise the building elevations and floor plan, to allow outdoor seating, outdoor speakers, five golf simulators, a 40-foot pole sign and a 20- foot pole sign in conjunction with a restaurant (Daylight Golf) in a district zoned "CC" Community Commercial District within the following described property: Lot 2R, Block 1, Crossroads or DFW Addition (1041 West State Highway 114) all in accordance with a site plan approved pursuant to Section 47 of Ordinance No. 82-73, attached hereto and made a part hereof as Exhibit"A", and all other conditions, restrictions, and safeguards imposed herein, including but not limited to the following: None. Section 2. That the City Manager is hereby directed to amend the official zoning map of the City of Grapevine, Texas, to reflect the herein conditional use permit. Section 3. That in all other respects the use of the tract or tracts of land herein above described shall be subject to all the applicable regulations contained in said City of Grapevine zoning ordinance and all other applicable and pertinent ordinances of the City of Grapevine, Texas. Section 4. That the zoning regulations and districts as herein established have been made in accordance with the comprehensive plan for the purpose of promoting health, safety, morals and the general welfare of the community. They have been designed with respect to both present conditions and the conditions reasonably anticipated to exist in the foreseeable future; to lessen congestion in the streets, to secure safely from fire, panic, flood and other dangers; provide adequate light and air; to prevent overcrowding of land, to avoid undue concentration of population; facilitate the adequate provisions of transportation, water, sewerage, drainage and surface water, parks and other public requirements, and to make adequate provisions for the normal business, commercial needs and development of the community. They have been made with reasonable Ordinance No. 3 consideration, among other things, of the character of the district, and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. Section 5. That this ordinance shall be cumulative of all other ordinances of the City of Grapevine, Texas, affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances which are in direct conflict with the provisions of this ordinance. Section 6. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract or tracts of land described herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the tract or tracts of land described herein. Section 7. That any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Thousand Dollars ($2,000.00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 8. That the fact that the present ordinances and regulations of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this ordinance shall become effective from and after the date of its final passage, and it is accordingly so ordained.
