ZONE CHANGE REQUEST Z02-01
Staff recommends the City Council consider the applicant's request to withdraw without
prejudice, Zone Change Request Z02-01 and take any other action necessary.
BACKGROUND:
Zone Change Request Z02-01, a request to rezone approximately 13.54 acres from "LI"
Light Industrial District to "CC" Community Commercial District for proposed medical
office/professional office and retail development located at the northeast and northwest
corners of Heritage Avenue and Mustang Drive, was originally scheduled for public
hearing on March 19, 2002. At that meeting the applicant, Mr. G. Phillip Morley of
Morley Architects requested this case be tabled to the May 21, 2002 meeting in order to
resolve issues relative to the dedication of right-of-way and the extension of Heritage
Avenue through the subject site. Since these issues still remain unresolved, the
applicant requests the application be withdrawn. Given the original nature of the zoning
request and the underlying conditions for its withdrawal, Staff recommends Council
consider accepting the applicant's request without prejudice. See the attached letter.

On beholf of my clients, I would like to request that our plotting and rezoning
request be withdrawn from the agenda until further notice. My clients are using
outside legal counsel and real estate advisors to assist them in determining the
terms under which they will be willing to grant the right-of-way for the Heritage
Drive extension.
I anticipate that we will resubmit our re(JUest in the next 60 to 90 days.
