SUBJECT: ZONING ORDINANCE AMENDMENT AM02-05—REQUEST TO
AMEND SECTION 31, "LI" LIGHT INDUSTRIAL DISTRICT TO
INCLUDE PROFESSIONAL OFFICE USES AS A PERMITTED
USE
RECOMMENDATION:
Staff recommends the Planning and Zoning Commission consider the request by Ms.
Tonya Brookmole to amend Section 31, "LI" Light Industrial District to include
professional office uses as a permitted use, and take any action necessary.
BACKGROUND:
As the ordinance is currently written, stand-alone professional office uses are not
permitted within the "LI" Light Industrial District. Professional office uses are allowed if
they are clearly incidental and accessory to a permitted or conditional use allowed within
the district. As a policy, Staff has not allowed office uses to exceed fifty percent of any
building space within the "LI" Light Industrial District as an accessory use.
Ms. Tonya Brookmole, Leasing Manager for property addressed as 1702 through 1712
Minters Chapel Road has requested that we amend Section 31 to allow professional
offices uses as permitted uses within the "LI" Light Industrial District. Ms. Brookmole has
had several prospective tenants for property that she manages along Minters Chapel
Road that Staff has determined were professional office uses—Certificates of
Occupancy were not issued for these prospective tenants. See the attached letter.
Staff recommends the Planning and Zoning Commission consider Ms. Brookmole's
request to amend Section 31, "LI" Light Industrial District, and if necessary authorize
Staff to set a public hearing for the amendment.

Dear Mr. Stombaugh,
AIP-SWAG Operating Partnership, LP ("Owner'') is the owner and landlord of 1702-
1712 Minters Chapel Rd located in Grapevine, TX ("Property") and is hereby requesting
an amendment of the zoning for this Property.
As of this date, the Property is zoned Light Industrial. The 1712 building is a single -
tenant, cross -dock distribution facility, while 1702 is a multi -tenant building with
office/warehouse suites on the first floor and mezzanine office on the second. The
second floor mezzanine office area in the 1702 building does not have direct access to the
first floor warehouse, except through an exterior stairwell entrance, as shown on the
attached site plan.
The building was originally constructed in 1984, and upon completion, the City permitted
office use. Recently, prospective tenants, who do much of their business in the immediate
vicinity, have sought to lease the mezzanine office, but the City has refused to issue
Certificates of Occupancy because City staff believes that office use is not permitted
unless it is ancillary to a warehouse use, thus precluding the owner from leasing from this
portion of the Property. Without a change in Grapevine's zoning ordinance, valuable
office space in the Owner's building will go unused, and the potential users will take their
jobs and pay their taxes elsewhere.
Generally speaking, so long as the parking and other requirements of section 31 of the
Grapevine City Code are met, office use is compatible with other uses in light industrial
zoning districts. In fact, office use was a permitted use in light industrial districts under
prior versions of the Grapevine Code, and it is now a permitted use in light industrial
districts in virtually every other city code in the area.
Office use should be allowed at the 1702 multi -tenant building, if the office use for the
second floor mezzanine is compatible with other businesses in the building and in the
