SUBJECT: RESOLUTION CONCURRING WITH TxDOT RELEASING A
DRAINAGE EASEMENT ON GRAPEVINE MILLS PROPERTY
RECOMMENDATION:
City Council consider adopting a resolution concurring with the State of Texas
determination that a portion of a drainage easement on Grapevine Mills Property is no
longer needed, that the easement be released, and take any necessary action.
BACKGROUND:
Prior to the development of the Grapevine Mills Mall, storm water collected at the north
end of an existing box culvert crossed SH 26 from north to south. The State typically
acquires drainage easements for storm water runoff that concentrates at low points of
undeveloped property before entering underground systems in the highways.
Once the Mills Mall was developed, the area was served by an enclosed system
constructed by the City under the Mills Mall TIF. The new system follows the ring road
and lot lines to accommodate planned development of the outparcels between the ring
road and SH 26.
The easement in question is no longer needed by the State and is a significant
impediment to the development of Lot 2, Block 5, Grapevine Mills Addition.
TxDOT has requested that the City adopt the recommended resolution supporting this
abandonment.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS CONCURRING IN THE STATE OF
TEXAS' DETERMINATION THAT A PORTION OF THE
STATE'S DRAINAGE EASEMENT IS NO LONGER
NEEDED FOR THE USE OF CITIZENS FOR DRAINAGE
PURPOSES OR AS A ROAD AND THAT THE EASEMENT
BE RELEASED IN ACCORDANCE WITH STATE OF
TEXAS REGULATIONS, AND PROVIDING AN EFFECTIVE
DATE
WHEREAS, the State of Texas acquired and holds in its name a drainage
easement on State Highway 26 as described in Exhibit "A" attached hereto and made a
part hereof; and,
WHEREAS, the State of Texas has determined that said drainage easement is
no longer needed for drainage purposes or construction, maintenance and operation of
State Highway 26; and,
WHEREAS, City Staff has studied the public need for said drainage easement and has
determined that said drainage easement is no longer needed by the citizens for
drainage purposes or as a road or for public transportation purposes, and is not suitable
for conservation, park, recreation and/or purposes.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS:
1. That the State of Texas' drainage easement shown on the attached
Exhibit "A" is no longer needed by the citizens for drainage purposes or as a road and is
not suitable for conservation, park, public transportation, recreation or similar purposes.
2. That the City Council of the City of Grapevine, Texas concurs in the
State's plan to release the drainage easement in accordance with the established laws
and regulations of the State of Texas.
3. That this resolution shall become effective from and after its date of
passage.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS on this the 3rd day of July, 2001.

BEING 0.068 of an acre of land, more or less, situated in the County of Tarrant, State of Texas, and being part
of the H. Suggs Survey, Abstract No. 1415, and being a part of a tract of land conveyed to Grapevine Mills
Residual Limited Partnership by deed recorded in Volume 12429, Page 2138 of the Land Records of Tarrant
County, Texas (LRTCT), and being a portion of a Drainage Easement for highway purposes conveyed to the
State of Texas from Rosewood Property Company as recorded in Volume 9804, Page 1213 of the LRTCT and
being a part of Block 5 of a replat of Grapevine Mills as recorded in Cabinet A, Page 3718 of the Plat Records
of Tarrant County Texas PRTCT, said 0.068 of an acre of land being more particularly described as follows
(bearings referenced to the right-of-way for State Highway 26 as per said replat):
BEGINNING at a 5/8 -inch iron rod set for the intersection of the westerly line of a 20 -foot wide drainage
easement as dedicated as a part of Block 5, Grapevine Mills and the southerly line of a channel easement
described by instrument to the State of Texas as recorded in Volume 9804, Page 1213 LRTCT, said iron rod
being located 100 feet left of centerline station 1209 + 44.0 for State Highway 26, and being 35.0 feet at right
angles to the exiting northerly right of way for State Highway 26, same being located N38°40'03" East, a
distance of 544.87 feet from a t/s-inch iron rod found for the most easterly southeast corner for said Block 5,
(the easterly northeast corner for the intersection of Grapevine Mills Blvd. — South and State Highway 26);
(1) THENCE North 58°57'59" West (called North 58°25' West), a distance of 54.56 feet to set 5/8" iron
rod for corner;
(2) THENCE North 31039'01" East (called North 32012' East), a distance of 50.00 feet to a set 5/8" iron
rod for corner;
(3) THENCE South 58°22'42" East (called South 57°50' East), a distance of 63.90 feet to a set 5/8" iron
rod for corner;
(4) THENCE South 42°21'01" West (called South 42°54'West), a distance of 50.32 feet to the POINT V
OF BEGINNING and containing 0.068 of an acre of land, more or less.
