SUBJECT: RIGHT OF WAY ABANDONMENT — SOUTHEAST CORNER OF
WILDWOOD DRIVE AND DOOLEY STREET INTERSECTION
RECOMMENDATION:
City Council consider adopting an ordinance abandoning an 864 square foot segment of
right of way located at the southeast corner of the intersection of Dooley Street and
Wildwood Drive, retaining said 864 square foot segment as a utility easement, and take
any necessary action.
BACKGROUND INFORMATION:
The owners of a tract of land being platted as Lot 1, Block 4, Kelley Addition, have
requested that an 864 square foot segment of right of way located at the southeast corner
of the intersection of Dooley Street and Wildwood Drive be abandoned for incorporation
in the development of a multifamily residential development. The segment is not needed
by the City for right of way purposes.
The City will retain a utility easement on this 864 square foot segment.
Staff recommends approval.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS, ABANDONING AND VACATING A
PORTION OF RIGHT OF WAY LOCATED AT THE
SOUTHEAST CORNER OF THE INTERSECTION OF
DOOLEY STREET AND WILDWOOD DRIVE IN THE CITY OF
GRAPEVINE, TEXAS, AS HEREINAFTER DESCRIBED,
RETAINING SAID PORTION OF STREET RIGHT OF WAY AS
A UTILITY EASEMENT; PROVIDING A SEVERABILITY
CLAUSE; DECLARING AN EMERGENCY AND PROVIDING
AN EFFECTIVE DATE
WHEREAS, the property owners of a tract of land described in the deed to Dorothy
Kelly and Guy Kelly Jr., recorded in Volume 2152, Page 532, Deed Records of Tarrant
County, Texas, the property containing a portion of right of way located at the southeast
corner of Dooley Street and Wildwood Drive, more specifically described in Exhibits "A" and
"B" attached hereto and incorporated herein for all purposes, has requested the right of
way, as herein after described be abandoned and vacated; and
WHEREAS, the right of way is not needed for public use and will not be needed in
the future for public use; and
WHEREAS, abandoning and vacating the said right of way will relieve the City of
Grapevine, Texas from the cost and expense of maintaining said property.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS.
Section 1. That all matters stated in the preamble of this ordinance are true and
correct and are hereby incorporated into the body of this ordinance as if copied in their
entirety.
Section 2. That the right of way located within the property described in Exhibits
"A" and "B", attached hereto and incorporated herein for all purposes, is hereby abandoned
and vacated for public use as street right of way and the same is hereby abandoned and
vacated insofar as all public right, title, interest in and to said right of way is concerned,
save and except the City shall retain subject right of way as a utility easement for perpetual
public use.
Section 3. That the terms and provisions of this ordinance shall be deemed to be
severable, and that if the validity of any section, subsection, word, sentence or phrase shall
be held to be invalid, it shall not affect the remaining part of this ordinance.
Section 4. The fact that the right of way is no longer needed by the public for
public usage and would create a hardship or burden upon the City of Grapevine to keep
open and maintain such right of way creates an urgency and an emergency for the
immediate preservation of the public health, safety, and general welfare which requires that
this ordinance shall take effect immediately from and after its passage and it is accordingly
so ordained.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS on this the 17th day of July, 2001.

Being 0.021 acres of land located in the A. F. Leonard Survey, Abstract No. 946, Tarrant
County, Texas. Said 0.21 acres of land being more particularly described as follows:
BEGINNING at a point in the West line of a tract of land described in the deed to Dorothy Kelly
and Guy Kelly Jr. recorded in Volume 2152, P. 532, Deed Records, Tarrant County, Texas, said
point lying S46°54'11" W 7.85 feet from the Northwest corner of said Kelly tract;
THENCE along said West line of the Kelly tract as follows:
1.S46°54'11 "W, a distance of 42.15 feet to a point;
2.S23°09'11 "W, a distance of 41.94 feet to a point;
THENCE Northerly, 67.74 feet along a non tangent curve to the right, having a radius of
1,170.00 feet, a central angel of 03019'03" and a chord bearing N08051'05"E, 67.74 feet to a
point;
THENCE N89019'49"E, a distance of 36.85 feet to the point of beginning, containing 0.021
acres of land.
The bearings recited hereon are oriented to a line between Grapevine monuments No. 6 and 7.
