SUBJECT: REGISTRATION OF RETAIL ELECTRIC PROVIDERS
RECOMMENDATION:
City Council approve an ordinance to amend Chapter 20 Streets, Sidewalks, Public
Ways of the Code of Ordinances relating to the registration of Retail Electric Providers
(REP) providing services in the City of Grapevine.
FUNDING SOURCE:
There are no fees or costs associated with the registration process.
BACKGROUND:
On January 1, 2002, the electric market will officially open to competition. The Staff has
historically maintained a "liaison" role with TXU Electric & Gas by answering questions
and facilitating communication between citizens and the company. With the competitive
market, a number of new companies are expected to aggressively market our citizens'
electric accounts.
As a means of monitoring which companies are servicing our community, this ordinance
will require the REP to register with the city. There are no fees associated with the
registration. The Staff is simply interested in having accurate information on the
companies' local representatives in the event citizens contact our office for assistance.
The Utilities Committee, the City Attorney and the Staff recommend approval.

ORDINANCE •
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS AMENDING CHAPTER 20
STREETS, SIDEWALKS, PUBLIC WAYS, ARTICLE IV OF
THE CODE OF ORDINANCES OF THE CITY OF
GRAPEVINE, TEXAS; AND ADOPTING THIS ORDINANCE
AS SECTION 20-57(C) "REGISTRATION FOR RETAIL
ELECTRIC PROVIDERS (REPs)", IN ORDER TO
MONITOR THE COMPANIES PROVIDING RETAIL
ELECTRIC SERVICE TO THE CITY OF GRAPEVINE;
PROVIDING AN EFFECTIVE DATE AND DECLARING AN
EMERGENCY.
WHEREAS, the legislature of the State of Texas passed a law providing for
electric restructuring to begin on January 1, 2002; and
WHEREAS, citizens have traditionally looked to municipal government to help
them with utility issues; and
WHEREAS, the new law provides that municipalities may register Retail Electric
Providers who offer service within a municipality; and
WHEREAS, registration would provide the City of Grapevine a mechanism to
help facilitate communication between an electric provider and City of Grapevine
consumers; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS:
Section 1. That the findings contained in the preamble of this ordinance are
determined to be true and correct and are hereby adopted.
Section 2. That Chapter 20
Management of Public Rights -of -Ways
following Section 20-57(c):
"Section 20-57 (c)
Streets, Sidewalks, Public Ways, Article IV
is hereby amended by the addition of the
Registration of Retail Electric Providers.
All retail electric providers wishing to sell, offer for sale, or
provide electricity to any consumers in Grapevine, including,
but not limited to industrial, business, institutional or
residential consumers, shall register with the City of
Grapevine."
Section 3. The Registration Form will be provided by and filed with the City
Manager's Office. The REP shall provide information on the company, the business
address, the local contact information, the telephone number, Email address, and other
customer service related information.
Section 4. If any section, subsection, sentence, clause, phrase, or portion of
this ordinance is for any reason held invalid or unconstitutional by any court or
administrative agency of competent jurisdiction, such portion shall be deemed a
separate, distinct, and independent provision and such holding shall not affect the
validity of the remaining portions thereof.
Section 5. This ordinance shall take effect November 20th, 2001, with the
competitive market beginning as of 12:01 AM, January 1, 2002.
Section 6. The fact that the present ordinances and regulations of the City of
Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals,
peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an
emergency for the immediate preservation of the public business, property, health,
safety and general welfare of the public which requires that this ordinance shall become
effective from and after the date of its final passage, and it is accordingly so ordained.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS on this the 20th day of November, 2001.
