SUBJECT: Z02-05, MCPHERSON TOWNHOMES (2ND READING)
RECOMMENDATION:
Staff recommends Council table the second reading of an ordinance for Zone Change
Request Z02-05 until the October 15, 2002 meeting and take any other action
necessary.
BACKGROUND INFORMATION:
At the July 16, 2002 meeting, Council approved on a first reading of an ordinance, a
request to rezone 1.30 acres from "R -MF -2" Multifamily District to "R -MF -1" Multifamily
District for a proposed ten -unit apartment project located at 2172 McPherson Drive and
platted as Lot 1, Block 1, Clairmont Place.
Because of the minimum lot size requirement of two acres in the "R -MF -1" Multifamily
District, a variance application for this site had to be considered by the Board of Zoning
Adjustment before final approval of the rezoning. At the August 5, 2002 Board of Zoning
Adjustment meeting, the requested variance to the lot size requirement failed by a vote
of 3-2. The concurring vote of at least four members of the Board of Zoning Adjustment
is necessary to approve any variance to the zoning ordinance.
Staff has received a letter from one of the dissenting voters for the above mentioned
variance requesting that the case be reheard by the Board of Zoning Adjustment. Staff
will place Board of Zoning Adjustment case BZA02-10 on the September 9, 2002
agenda at which time the entire Board will consider whether or not to rehear the case. If
this is approved by the Board, the case will be placed on the Board's October 7, 2002
agenda and they will once again consider the request to vary from the minimum lot size
requirement. Pending action by the Board at that meeting, Council will reconsider the
zone change request at their October 15, 2002 meeting.

Dear Scott:
I am agreeable to another put lic hearing on case BZA 02-10 prior to the standard time
interval.
It seems that the results might be the same wiless the following points are covered,
namely:
• There is no su..table use for the 1.3 acres (56,629 square feet) that does
NOT require a variance; and
• If the 1.3 acre;: should be used as Section 21.F.2, "R -MF -1" Multifamily
District, the request for variance should be supported with a suitable plot
plan indicating; no more than 10 units — the number approved by the City
Council July 16, 2002.
