called the Planning and Zoning Commission deliberation session to order at 8:02 p.m.

4) CONDITIONAL USE REQUEST CU02-29 — EAGLE BELIEVERS CHURCH
First for the Commission to consider and make a recommendation to the City Council was
Conditional Use Request CU02-29 submitted by G. Philip Morley for property located at 925
Minter's Chapel Road and platted as Lot 1, Block 1, HFCC Addition. The applicant was
requesting a Conditional Use permit to allow for a religious institution.
The subject property was developed as a nursing home in the late 1960's, and operated as
such until its recent closure. The new owner of the property was proposing to utilize the
existing structure as a church and vocational school. The vocational school is a permitted
use within the "Ll" Light Industrial District.
To correct existing design problems in the parking lot, the applicant was proposing to add
approximately four feet of paving along the northern edge of the parking lot. This additional
paving would allow the parking space dimensions and drive aisle width to meet City
requirements, without necessitating the removal of four 24 -inch caliper trees in this area.
The applicant was also proposing to remove the parking spaces currently located within the
front yard setback and replacing these spaces with landscaping and landscape islands
throughout the parking lot.
Mr. Morley, representing the owner, was present to answer questions and request favorable
consideration of the request.
There were questions regarding the instructional business and Dr. Nosa Evbuomwan
explained the vocational school would combine medical nursing training as well as
computer hardware and software training by certified instructors. He estimated there would
be four to six classrooms with approximately eight to ten students during operation. Dr.
Evbuomwan assured Council the church business would not conflict with the educational
business and all classes would be available to the public for a fee.
With no further guests to speak, one letter of concern, and no petitions, the public hearing
was closed.
In the Commission's deliberation session, Rob Undersander moved, with a second by Chris
Coy, to approve Conditional Use Request CU02-29, and the motion prevailed by the

CONDITIONAL USE REQUEST CU02-30 — GREENBACK NURSERY

William D. Tate Avenue, and platted as Lot 4R-1, Block 1, Tom Thumb Addition, Number
One. The applicant was requesting to amend the previously approved site plan of CU99-48
(Ord. 99-151), specifically to allow for outside storage in conjunction with a retail nursery
and a garden supply store.
The applicant was proposing a landscape nursery and garden supply store comprised of a
12,383 square foot primary structure, a 24,978 square foot shade structure and
approximately 1.8 acres of outdoor storage generally located on each side and rear of the
two structures. The outdoor storage of landscaping materials was proposed to be screened
with a six-foot, vinyl coated, chain link fence.
A monument sign was proposed at the entrance of the site along William D. Tate Avenue.
Currently, four signs serve the planned commercial center, including two monument signs
along Hall -Johnson Road and two monument signs along William D. Tate Avenue.
Alan Miller, representing the applicant, was present to answer questions and request
favorable consideration of the request. Mr. Miller answered questions regarding the outside
storage area, noting what types of goods would be stored in this area and stating the area
would be accessible to the public. Mr. Miller also assured Council that the applicant would
consider different materials for the storage area screening.
With no further guests to speak, no letters, and no petitions, the public hearing was closed.
In the Commission's deliberation session, there was discussion regarding the storage area
fencing. Mr. Coy suggested a wrought iron material similar to the look of Home Depot on
State Highway 114. It was noted the applicant should be requested to get approval of the
detailed changes via the Site Plan Review Committee and prior to obtaining their Building
Permit.
Chris Coy moved, with a second by Danette Murray, to approve Conditional Use Request
CU02-30 contingent upon SPRC approval of the changes to the outside storage screening
on the East, North, and South boundaries, specifically that the screening be a wrought iron
material with stone pillars. The motion prevailed by the following vote:
Ayes: Oliver, Fry, Coy, Busbee, Murray, Nicholson, and Undersander

Thumb Addition No. 1 submitted by Mr. Michael Clark of Winkelmann & Associates for

49 property located at 4120 William D. Tate Avenue. The applicant was final platting 11.123
acres for the proposed development of a retail nursery and garden supply store.

Nicholson, to approve the Statement of Findings and Final Plat Application of Lots 4R1 and
6, Block 1, Tom Thumb Addition Number One. The motion prevailed by the following vote:

CONDITIONAL USE REQUEST CU02-31 — J. A. GREEN TRADE PARK WEST
Next for the Commission to consider and make a recommendation to the City Council was
Conditional Use Request CU02-31 submitted by Daniel Green for property located at 601,
701, and 801 Hanover Drive, and platted as Lot 1, Block 1, J. A. Green Trade Park West
Addition. The applicant was requesting to amend the previously approved site plan of
C000-41 (Ord. 2000-100) to allow freight forwarding, specifically, to permit a 75 foot by 75
foot outside storage structure located behind Building 15.
An air cargo container shipping company proposed to lease approximately 34,000 square
feet of space located in Building 15. The company was proposing to use the site to build,
repair and ship air cargo containers and requesting to construct a 75 -foot by 75 -foot secure
outside storage area, located at the western end of building 15, for outdoor storage of the
air freight containers. The screening walls of the storage area were proposed to be a
maximum of eight feet high, and the containers shall be single stacked to a height of nine
feet, six inches high. The applicant was proposing that the portion of the storage area visible
from Hanover Street be constructed of the same tilt wall material as the building itself.
Those portions of the screening wall located interior to the site would be constructed of
wood screening.
Daniel Green, President of J A Green Development Corporation, was present to answer
questions and request favorable consideration of the request. Mr. Green explained that this
area would require special security considerations in order to comply with Federal Aviation
regulations.
With no further guests to speak, one letter of support, and no petitions, the public hearing
was closed.
In the Commission's deliberation session, there was discussion regarding the necessity of
additional outside storage when the buildings adequately provided for ample space. Rob
Undersander made a motion to approve the case which failed with no second. Chris Coy

CONDITIONAL USE REQUEST CU02-33 -TAP-IN RESTAURANT
Next for the Commission to consider and make a recommendation to the City Council was
Conditional Use Request CU02-33 submitted by Ken Wiles for property located at 120
South Main Street, # 40, and platted as Lot 1, Block A, Starr Addition. The applicant was
requesting to amend the previously approved site plan of CU99-42 (Ord.99-168) allowing
the possession, storage, retail sale and on -premise consumption of alcoholic beverages
(beer, wine and mixed drinks) in conjunction with a restaurant, specifically to enlarge the
restaurant.
Greg Robertson, representing the applicant, was present to answer questions and request
favorable consideration of the request.
With no further guests to speak, no letters, and no petitions, the public hearing was closed.

to approve Conditional Use Request CU02-33, and the motion prevailed by the following

ZONING ORDINANCE AMENDMENT AM02-06 — AMENDMENTS TO SECTION 49,
SPECIAL USE PERMITS AND SECTION 12, DEFINITIONS RELATIVE TO CHURCHES
Next for the Commission to consider and make a recommendation to the City Council were
the proposed amendments to Section 49, Special Use Permits and Section 12, Definitions
relative to church uses and religious campuses. Staff has drafted an amendment to Section
49, Special Use Permits, to require a Special Use Permit for all churches in the "LB" Limited
Business District, "GV" Grapevine Vintage District, "CN" Neighborhood Commercial District,
"CC" Community Commercial District, "HC" Highway Commercial District, "PO" Professional
Office District, "CBD" Central Business District, "HGT" Historic Grapevine Township District,
"HCO" Hotel Corporate Office District, "RA" Recreation Amusement District, "Ll" Light
Industrial District, "BP" Business Park District, "PCD" Planned Commerce Development
District, "PID" Planned Industrial Development District, and "GU" Governmental Use District.

A relatively new trend in church development has been the establishment of large multi-
faceted religious campuses, such as Fellowship Church in Grapevine or Prestonwood
Baptist Church in Plano. With memberships commonly exceeding 10,000 people, religious
services, church -sponsored functions and administrative activities often must be carried out
seven days a week. As a result, these developments can create a substantial impact on
traffic patterns and surrounding properties. This type of development should be considered
by the Planning and Zoning Commission and City Council to ensure that the development
will not negatively impact its surrounding environment and that adequate public facilities are
in place to support the development.
In addition to the proposed changes to Section 49, Special Use Permits, Staff has drafted
an amendment to Section 12.A.61, Definitions, which updates and broadens the definition
for `church' to include all uses commonly associated with a modern religious campus,
including facilities for religious worship, training, education, child care, recreation, and
administration, as well as rectories and other residential quarters for religious organization
personnel.

ZONING ORDINANCE AMENDMENT — AM02-03 - AMENDMENTS TO SECTION 60
SIGN REGULATIONS RELATIVE TO SIGNAGE IN "GU" GOVERNMENTAL USE
DISTRICT
Next for the Commission to consider and make a recommendation to the City Council were
the proposed amendments to Section 60, Sign Regulations relative to signage in "GU"
Governmental Use District.
Prior to the 1984 citywide rezoning, the sign regulations did not apply to uses located within
the "GU" Governmental Use District. In 1984, the sign ordinance was amended to require
that uses located within this district adhere to the sign regulations for the most restrictive
abutting district, thus making the sign regulations for the "GU", Governmental Use District
the most restrictive of any other district within the city.
This proposed amendment to Section 601 incorporated the same sign regulations for the
"GU" district that are currently used for other commercial districts within the city with the
added provision that any proposed sign for the "GU" district not conforming to the sign
regulations must first be approved by the City of Grapevine Facilities Committee.

deviate from these sign regulations. Any sign that does not conform
with the sign regulations must first be approved by the City of Grapevine
Facilities Committee.

In the Commission's deliberation session, there was discussion regarding the necessity of
the proposed changes. Herb Fry noted the changes were in his opinion too extreme. Mr. Fry
stated one solution could be to require each situation make individual requests as needed.
Herb Fry moved, with a second by Chris Coy, to table AM02-06 for revisions to allow the
existing regulations to stay in place and in situations whereby the ordinance is too
restrictive, a conditional use permit may be submitted. The motion prevailed by the following
vote:
Ayes: Fry, Coy, Busbee, Murray, Nicholson
Nays: Undersander and Oliver

PARKING PLAN APPLICATION - PP02-01 — CENTURY PLAZA — (TAP -IN RESTAURANT)
Next for the Commission to consider was the proposed Parking Plan, PP02-01 submitted by
Tap -In Restaurant for property located at 120 South Main Street #20 and platted as Lot 1,
Block A, Starr Addition. The applicant was requesting to revise the previously approved
parking plan PP95-01 to accommodate an additional twenty required spaces for the
proposed expansion of the Tap -In Restaurant.
The original parking plan for Century Plaza was approved on July 20, 1995 (PP95-01) and
amended in January 1996. The original plan allowed retail and professional office uses and
a maximum of 2,400 square feet of restaurant space by providing 31 off-street parking
spaces on-site and five spaces in the public right-of-way along Barton Street for a total of 36
parking spaces. The amendment approved in January 1996 eliminated one off-street
parking space to provide space for a dumpster, bringing the total number of provided
parking spaces down to 35.
The applicant was proposing to utilize the 45 parking spaces in the public parking lot located
at the corner of Church Street and Texas Street to accommodate the restaurant expansion.
While this lot is utilized during the day by City Hall staff, it would be available for use by the
restaurant during their peak hours in the evening and on weekends. This additional space

4) would increase by 80 spaces the total number of spaces available to Century Plaza.

the Statement of Findings and Final Plat Application of Lots 1 and 2, Block 1, Darby's Place
Addition submitted by Greg Stowers for property located along the west side of North Dove
Road. The applicant was final platting 1.852 acres for the development of a single family
site. The property is zoned "R-7.5" Single Family District and is owned by Greg Stowers.
