RECOMMENDATION:
Staff recommends Council table Conditional Use Request CU02-47 to the January 21,
2003 meeting and take any other action necessary.
BACKGROUND INFORMATION:
This request was tabled during the public hearing at the November 19, 2002 meeting in
order for the applicant to address the City Council's concerns relative to sound
attenuation. The applicant is in the process of preparing a presentation detailing the
steps that will be taken to reduce noise levels at the subject site. The applicant is also
working out an agreement with the Dallas/Fort Worth Airport Board to garner their
support for the project. See the attached letter.

We are in the process of preparing a presentation for the public hearing and, whip; everything
continues to look very positive, we will not have all the inforrnatiort we had hoped to in time to
make the presentation.
We have tentatively reached an agreement with the Dallas Fort Worth Airport Board that should
he tinalixed prior to the January meeting. Also, we will have our i'ornial reports by then, along
with other information that we feel will be helpful for the Council in making their decision.

The subject property is located at the southwest
corner of Mustang Drive and Southwest Grapevine
Parkway and is proposed to be platted as Lot 1 R-2
Southwest Grapevine Commercial Park. The site
contains approximately 2.4 acres and has 434 feet of
frontage along Southwest Grapevine Parkway, 368
feet of frontage along Mustang Drive, and 528 feet of
frontage along Heritage Avenue.
REQUESTED CONDITIONAL USE AND COMMENTS:
The applicant is requesting a conditional use permit to allow the develgpment of a personal
care facility.
This is the first phase of a multi -phase project. This first phase will contain 42 -beds for the
proposed personal care facility.
This request was tabled during the public hearing at the November 19, 2002 meeting in
order for the applicant to address the Councils' concerns relative to sound attenuation.

PRESENT ZONING AND USE:
The property is currently zoned "CC" Community Commercial District and is undeveloped.
HISTORY OF TRACT AND SURROUNDING AREA:
The subject and surrounding property was rezoned from "R-1" Single Family District to
"PID" Planned Industrial Development District, "LI" Light Industrial District, "CC" Community
Commercial District and "R -MH" Manufactured Home District during the 1984 Citywide
Rezoning. The property to the south of the subject site received a zone change (Z99-14)
at the September 21, 1999 meeting rezoning 4.435 acres from "PID" Planned Industrial
Development District to "CC" Community Commercial District for an office development.
SURROUNDING ZONING AND EXISTING LAND USE:
NORTH: "R -MH" Manufactured Home District and "LI" Light Industrial District—
existing mobile home park and vacant property
SOUTH: "CC" Community Commercial District—office development
� EAST: "CC" Community Commercial District—vacant
WEST: "CC" Community Commercial District—vacant
The subject tract is located within "Zone B" Middle Zone of Effect as defined on the
"Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" map. In Zone B,
the following uses may be considered only if sound treatment is included in building design:
multi family apartments, motels, office buildings, movie theaters, restaurants, personal and
business services. Single family residential and sound sensitive uses such as schools and
churches should avoid this zone. The applicant's proposal is an appropriate use in this
noise zone.
The Master Plan designates the subject property as a Commercial land use. The
applicant's request is in compliance with the Master Plan.
Mustang Drive is designated a Type B Major Arterial with a minimum 80 -foot right-of-way

developed as four lanes with a dividing median. Heritage Avenue is designated a Type C
Minor Arterial with a minimum 80 -foot right-of-way developed as four lanes with a center
left -turn lane. Southwest Grapevine Parkway is not designated as a thoroughfare by the
City of Grapevine Thoroughfare Plan.

will be placed on the agenda for public hearing at the discretion of the staff. Based on the size
of the agenda, your application may be scheduled to a later date.
All public hearings will be opened and testimony given by applicants and interested citizenry.
Public hearings may be continued to the next public hearing. Public hearings will not be
tabled.
Any changes to a site pian (no matter how minor or major) approved with a conditional use or
a special use permit can only be approved by city council through the public hearing process.
Any application for a change in zoning or for an amendment to the zoning ordinance shall
have, from the date of submittal, a period of four months to request and be scheduled on an
agenda before the Planning and Zoning Commission and City Council. if after said period of
hour months an application has not been scheduled before the Commission and Council said
application shall be considered withdrawn, with forfeiture of all filing fees. The application,
along with the required filing fee may be resubmitted any time thereafter for reconsideration.
Delays in scheduling applications before the Planning and Zoning Commission and City
Council created by city staff shall not be considered a part of the four month period.

RE: Conditional Use Application, 2.4 -acre tract locate on East Side of Heritage Avenue,
South of Mustang Road, Grapevine, Texas
Gentlemen:
This letter is written to be included in the Conditional Use Application pertaining to the above
captioned property.
We propose to improve the property with a one story building designed as an Assisted Living
Facility for residents with memory impairment. The facility will provide living units for 42
residents, along with a commercial kitchen, dining rooms, staff offices, bathing areas, laundry
rooms and common areas to include game rooms, library, therapeutic kitchen and greenhouse
area. There will also be secured outside garden areas for the use of residents.
The building will be staffed 24 -hours per day, 7 days per week and will be fully secured to
prevent residents from leaving the building without staff supervision.
We feel that the proposed use will positively influence the value, use and enjoyment of other
property within the neighborhood, as the facility will be of very high quality construction and
provide a buffer between the residential area to the south and the commercial uses provided on
the adjoining land and our building will blend very well with the medical office building directly
across Heritage Avenue. Also, since the residents do not drive, there should be very little
additional vehicular traffic generated by this facility.
The site plan submitted with this application has been designed to meet all city requirements.
