SUBJECT: SOLID WASTE AND RECYCLING RATE ADJUSTMENT REQUEST
RECOMMENDATION:
City Council consider adopting an ordinance adjusting the commercial and residential solid
waste and recycling collection rates for Allied Waste Services and take any necessary
action.
FUNDING SOURCE:
Funds are generated by user fees for this service.
BACKGROUND:
City Council granted Allied Waste Services (Allied) and its predecessor companies a
franchise agreement (Ordinance No. 95-35) to provide solid waste and recycling services
for both residential and commercial customers in Grapevine on May 2, 1995. The term
was for an initial 10 year period with the option to extend the agreement in increments of 5
years. The agreement was extended 5 years to 2010 under Ordinance No. 2001-67.
Section 11 - Item 1 of Ordinance No. 95-35 provides for the establishment of residential
and commercial rates on an annual basis prior to October 1. Allied has requested a rate
adjustment effective October 1, 2008. The last time Allied requested a rate adjustment
was in 2006.
The rate adjustment calculation is a fixed component of the agreement for both commercial
and residential collection. The base rate is divided into operational and disposal
components. Operation equals 70% and disposal 30% of the base rate. Operation is
adjusted based on the Consumer Price Index(CPI-U)forthe most recent 12 month period
(April 1 — March 30). Disposal is adjusted by the average increase in disposal cost of six
local landfills. The residential rate adjustment calculation is as follows:
CPI-U: 3.11% increase
Disposal Average: 1.47% increase
Total 4.58%
The total of these components is a rate increase of 4.58% for the residential and
� commercial solid waste and recycling collection.
Under Section 11 — Rates and Charges, Allied can request "Any other cost increases
including state, federal and local fees, taxes or other additional disposal regulatory charges
imposed on disposal since the last rate modification, and any expenditures required of
Company solely because of federal, state or local law, rule, regulation, ordinance, order,
permit or permit condition becoming effective since the last rate modification may be
considered by City on a case-by-case basis." Allied has requested a fuel cost recovery
adjustment of an additional 4.23%.
The fuel cost recovery adjustment is based on a calculation tied to the Department of
Energy index that tracks regional fuel costs.Allied would develop a multiplier of their overall
fuel cost as a percentage of their operation and maintenance cost and multiply the
Department of Energy indexed fuel cost increase/decrease to develop the adjustment
factor. The adjustment would be re-calculated semi-annually based on market trends for
fuel either up or down. Current cost increases generate a fuel recovery adjustment of
4.23%.
Energy is a component of the Consumer Price Index (CPI). Staff requested that if a fuel
recovery adjustment was to be granted, that the energy component of the CPI should be
removed to avoid a double capture of the adjustment. Allied recalculated the CPI (3.11),
minus energy, to be 2.12%, based on Bureau of Labor Statistics figures issued with the
energy component removed.
In the event Council grants the additional fuel adjustment request, the total rate increase
for residential and commercial solid waste collection is as follows:
CPI-U: (minus energy) 2.12% increase
Disposal Average: 1.47% increase
Fuel Recovery 4.23%
Total 7.82%
The monthly residential rate with the 7.82% rate adjustment will be $ 11.27.
The rate adjustment if the fuel adjustment were not granted would be 4.58% yielding a
monthly residential rate of$10.93.
Utility Committee & Staff recommend approval of the 7.82% rate increase.

GRAPEVINE, TEXAS AMENDING THE GRAPEVINE CODE
OF ORDINANCES, CHAPTER 25 UTILITIES AND
SERVICES, ARTICLE III SOLID WASTE DISPOSAL,
SECTION 25-97 SERVICE RATES--SCHEDULES;
PROVIDING A SEVERABILITY CLAUSE; DECLARING AN
EMERGENCY AND PROVIDING AN EFFECTIVE DATE
WHEREAS, on June 1, 1995, by passage of Ordinance No. 95-35 the City of
Grapevine, Texas granted Laidlaw Waste Systems, Inc. a franchise agreement to provide
for solid waste services for both residential and commercial customers for a ten (10) year
period; and
WHEREAS, on September 18, 2001, by passage of Ordinance No. 2001-67 the City
of Grapevine, Texas granted Laidlaw Waste Systems, Inc. an extension of the franchise
agreement to provide for solid waste services for both residential and commercial
customers for one (1) additional five (5) year period, commencing on June 1, 2005; and

WHEREAS, Laidlaw Waste Systems, Inc. was renamed Trinity Waste Services,
Inc.; and
WHEREAS, Trinity Waste Services, Inc. was renamed, Allied Waste Services Inc.;
and
WHEREAS, Section 12, Item 1 of the franchise agreement provides for the
establishment of residential and commercial rates on an annual basis prior to October 1 of
each year; and
WHEREAS, Allied Waste Services, Inc., has requested a rate adjustment to be
effective on October 1, 2008; and
WHEREAS, the City Council desires to increase the rates for collecting and
removing garbage, recycling, refuse and trash and other solid waste by amending Chapter
25 Utilities and Services, Article III, Solid Waste Disposal, Section 25-97 of the Code of
Ordinances of the City of Grapevine, Texas.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1. That the above premises are found to be true and correct and are ���
incorporated into the body of this ordinance as if copied in their entirety.
Section 2. That Chapter 25 Utilities and Services, Article III, Solid Waste
,LL,�,p,, Disposal, is hereby amended by amending Section 25-97(a) in its entirety to read as
follows:
"Sec. 25-97. Service rates-schedules.
(a) Any houses, buildings or premises used for residential purposes, shall
have their garbage, trash and refuse removed at a monthly charge where
such collection and removal is not required in excess of twice each week,
and have its recyclable materials removed once per week with such rates
established annually by ordinance.

Section 4. That Chapter 25 Utilities and Services,Article III Solid Waste Disposal
is amended by amending Section 25-97(d), to read as follows:
"(d) Collecting and removing of recyclables from multifamily (apartment)
complexes will be performed [by] contractor at least once each week. Every
apartment complex will be assessed a per unit monthly fee with such rates
established annually by ordinance.
Monthly apartment recycling fee...$0.95"
Section 5. That if any section, article, paragraph, sentence, clause, phrase or
word in this ordinance, or application thereto any person or circumstances is held invalid or
unconstitutional by a Court of competent jurisdiction, such holding shall not affect the
validity of the remaining portions of the ordinance; and the City Council hereby declares it
would have passed such remaining portions of the ordinance despite such invalidity,which
remaining portions shall remain in full force and effect.

Section 6. That the fact that the present ordinances and regulations of the City of �
Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, peace
and general welfare of the inhabitants of the City of Grapevine, Texas, creates an
emergency which requires that this ordinance become effective the 1 st day of October,
2008.
