BEING a tract of land situated in the A.F. LEONARD SURVEY, ABSTRACT NO. 946,
City of Grapevine, Tarrant County, Texas and being a portion of Lot 1 and Lot 2, Block
1, Grapevine Business Park, an addition to the City of Grapevine, Tarrant County,
Texas, according to the plat thereof recorded in Volume 388-168, Page 98, Map
Records, Tarrant County, Texas, also being all of the same tract of land, as described in
deed to SL Industrial Storage LP, recorded in County Clerk's File No. D222243079,
Official Public Records, Tarrant County, Texas (O.P.R.T.C.T.), and being more
particularly described as follows:
BEGINNING at a point for corner from which a MAG nail found bears North 05 deg 22
min 36 sec East, a distance of 0.40 feet, said point being situated in the North right -of-
way line of W. Northwest Highway (100' right-of-way) and being the Southwest corner of
a tract of land as described in deed to Quick G Properties, LLC, recorded in County
Clerk's File No. D209311331, Deed Records, Tarrant County, Texas (D.R.T.C.T.);
THENCE South 89 deg 25 min 19 sec West, along said North right -of-way line, a
distance of 92.34 feet to a 1/2-inch iron rod with red cap found for corner, said iron rod
being the Southeast corner of a "Save and Except" tract as described in deed recorded
in Volume 7730, Page 350, D.R.T.C.T.;
THENCE North 00 deg 29 min 42 sec West, departing the North right -of-way line of said
W. Northwest Highway and along the East line of said "Save and Except" tract, a
distance of 188.57 feet to a 1/2-inch iron rod with red plastic cap stamped
"PEISERSURVEYING" found for corner, said iron rod being the Northeast corner of
said "Save and Except" tract;
THENCE South 89 deg 20 min 45 sec West, departing the East line and along the North
line of said "Save and Except" tract, a distance of 30.00 feet to a 1/2 -inch iron rod with
red plastic cap stamped "W.A.I. 5714" set for corner, said iron rod being the Nor thwest
corner of said "Save and Except" tract;
THENCE South 00 deg 29 min 42 sec East, departing the North line and along the West
line of said "Save and Except" tract, a distance of 38.90 feet to a MAG nail with washer

from which a 1/2-inch iron rod found bears North 02 deg 19 min 58 sec West, a distance

feet to a 1/2-inch iron rod with yellow plastic cap stamped "ARTHURSURVEYINGCO"

line of said Lot 2, Block 1, a distance of 421.44 feet to a point for corner from which a
5/8-inch iron pipe found bears North 53 deg 11 min 25 sec East, a distance of 0.41 f eet,
said point being the Northeast corner of said Lot 2, Block 1;
THENCE South 00 deg 17 min 48 sec West, departing the North line and along an East
line of said Lot 2, Block 1, a distance of 345.69 feet to an "X" cut in concrete found for
corner, said "X" cut being a Southeast corner of said Lot 2, Block 1 and being the
Northeast corner of said Quick G Properties, LLC;
THENCE South 89 deg 31 min 18 sec West, departing the East line of said Lot 2, Block
1 and along the North line of said Quick G Properties, LLC tract, a distance of 221.01
feet to a MAG nail found for corner;
THENCE South 01 deg 46 min 33 sec West, departing the North line and along the
West line of said Quick G Properties, LLC tract, a distance of 158.50 feet to the POINT

CONTAINING within these metes and bounds 3.760 acres or 163,786 square feet of
land, more or less.
Bearings shown hereon are based upon an on-the-ground Survey performed in the field
on the 3rd day of January, 2024, utilizing a G.P.S. bearing related to the Texas
Coordinate System, North Texas Central Zone (4202), NAD 83, grid values from the
GeoShack VRS network.

Project Narrative
This request is for a conditional use permit ("CUP") to allow for a plumbing supply
company in an existing, completely enclosed building along with outdoor storage of service
vehicles and any other necessary outdoor storage for equipment or materials. The property is
located at 340 W Northwest Highway Grapevine, Texas 76051 (the "Property") and was previously
used as a tile and plaster supply store with outdoor storage of construction materials.
The proposed tenant is Elmer's Home Services. Cascade Services is the parent company of
the proposed tenant. Cascade operates a family of independent residential HVAC, plumbing, and
electrical contractors across the Southeast. The proposed tenant will provide high-quality and
responsive air conditioning and plumbing services to residences in the surrounding area. While the
business will receive service calls 24-hours a day, the on-site operating hours of the business will
be seven days a week from 9am to 5pm. Staff will be reduced on the weekends, but the use will
still operate from 9am to 5pm. Most service vehicles are driven home by staff each night and the
ongoing need for service vehicle outdoor storage on-site will be minimal after-hours.
The prior use on the Property stored various tile and plaster related materials outside in the
rear portion of the Property. There was also extensive outdoor vehicle and equipment storage
outside. The proposed tenant's use requiring the CUP will be less intense than the current use,
which is beneficial for the use and enjoyment of the adjacent single-family residential properties.

I protest, as a property owner within 200 feet of the subject tract. I received the letter and am responding. It will be too
disruptive and unsafe for our young children and elderly people to have a large business as that so close to residential
properties that we pay huge amounts of taxes for. This area is already busy and unsafe, another business that is loud,
disruptive, creating more traffic is not what this neighborhood needs when the middle school is close and children are
walking to and from school. Be considerate of our hard earned money that pays our taxes to keep this neighborhood
peaceful for our children and don't allow this business to destroy our neighborhood.

or surveyor

•Add the following purpose statement to all sheets:
o “The purpose of CU24-28 is to allow to allow a plumbing repair company with

•Revise labeling on drawing; all labels showing existing components or conditions label as “Ex. or
existing” and anything being proposed label as such.
•Label any existing trees on site.
•Label the covered parking adjacent to the north property line as “existing”.
•Number each row of parking with the number of spaces.
•Label and dimension the fire lane.
•Extend the 25’ front yard setback so that in continues from east to west property lines.
•Label the square footage of the open space adjacent to northwest highway.
•Dimension the covered parking canopy.
•Label the building main entry.
•Label any existing signage onsite and dimension the existing sign to the nearest property line.
•Specify and label where the “outdoor vehicle storage” area is on the drawing, how many spaces
are dedicated to it, and the approximate square footage.
•Add the height and purpose of the existing wall adjacent to the north property line.

PROPERTY LOCATION AND SIZE:
The subject property is located at 340 West
Northwest Highway, platted as Block 1, Lot 2,
Grapevine Business Park. The site contains
approximately 3.759 acres and has approximately
122 feet of frontage along West Northwest
Highway.
REQUESTED CONDITIONAL USE AND COMMENTS:
The applicant is requesting a conditional use permit to allow a plumbing repair company
with outdoor storage of service vehicles.
The site was initially developed in 1984 as a commercial building. The applicant plans to use the existing structure, formerly occupied by Classic Tile and Plastering, to run a plumbing repair company. Elmer’s provides air conditioning and plumbing repair, equipment replacement, installation, and 24-hour emergency services to their customers. The first floor will include four offices, a break room, two storage rooms, and a production area. The upstairs mezzanine will have a storage room, office, and restrooms. The site has a total of 68 parking spaces, with 14 designated for outdoor storage of service vehicles. The outdoor storage area will be covered by an existing 10-foot-tall canopy adjacent to the north property line and screened by a stockade fence of varying heights, ranging from 6 to 10 feet tall.

The applicant is also adding 35,885 square feet of open space to the north and south portions of the property. There is one existing access adjacent to West Northwest Highway that is shared between this site and the gas station to the east and an existing monument sign that will be utilized for signage. No other exterior changes are being proposed as part of this request.
PRESENT ZONING AND USE:
The property is currently zoned “HC”, Highway Commercial District and is developed as
a single-story commercial building.
HISTORY OF TRACT AND SURROUNDING AREA:
The subject site was zoned “C-2”, Community Business District and “L-I”, Limited
Industrial District prior to the adoption of the city’s first zoning ordinance in 1955 and
was zoned
“S-P”, Site Plan District prior to the 1984 City-wide Rezoning at which time the subject
site was rezoned to “HC”, Highway Commercial District.

AIRPORT IMPACT:
The subject tract is not located within any of the noise zones as defined on the “Aircraft
Sound Exposure: Dallas Fort Worth Regional Airport Environs” map.
MASTER PLAN APPLICATION:
Map 2: Land Use Plan of the Comprehensive Master Plan designates the subject
property as a Commercial (CO) land use. The applicant’s proposal is compliant with the
Master Plan.
THOROUGHFARE PLAN APPLICATION:
The City of Grapevine’s Thoroughfare Plan designates West Northwest Highway as a
Type C, Minor Arterial with a minimum 80-foot right-of-way developed as 4 lanes with a
turn lane.

WHEREAS, an application was made requesting issuance of a conditional use
permit by making applications for same with the Planning and Zoning Commission of the
City of Grapevine, Texas, as required by State statutes and the zoning ordinance of the
City of Grapevine, Texas, and all the legal requirements, conditions and prerequisites
having been complied with, the case having come before the City Council of the City of
Grapevine, Texas, after all legal notices requirements, conditions and prerequisites
having been complied with; and
WHEREAS, the City Council of the City of Grapevine, Texas, at a public hearing
called by the City Council did consider the following factors in making a determination as
to whether this requested conditional use permit should be granted or denied: safety of
the motoring public and the pedestrians using the facilities in the area immediately
surrounding the site; safety from fire hazards and measures for fire control; protection of
adjacent property from flood or water damages, noise producing elements, and glare of
the vehicular and stationary lights and effect of such lights on established character of the
neighborhood; location, lighting, and types of signs and relation of signs to traffic control
and adjacent property; street size and adequacy of width for traffic reasonably expected
to be generated by the proposed use around the site and in the immediate neighborhood;
adequacy of parking as determined by requirements of this ordinance for off-street
parking facilities; location of ingress and egress points for parking and off-street locating
spaces, and protection of public health by surfacing on all parking areas to control dust;
effect on the promotion of health and the general welfare; effect on light and air; the effect
on the overcrowding of the land; the effect on the concentration of population; the effect
on the transportation, water, sewerage, schools, parks and other facilities; and
WHEREAS, the City Council of the City of Grapevine, Texas, at a public hearing
called by the City Council of the City of Grapevine, Texas, did consider the following
factors in making a determination as to whether this requested conditional use permit
should be granted or denied; effect on the congestion of the streets, the fire hazards,
panics and other dangers possibly present in the securing of safety from same, the effect
on the promotion of health and the general welfare, effect on adequate light and air, the
effect on the overcrowding of the land, the effect on the concentration of population, the
effect on the transportation, water, sewerage, schools, parks and other public facilities;
and
WHEREAS, all of the requirements of Section 48 of Ordinance No. 82-73 have
been satisfied by the submission of evidence at a public hearing; and
WHEREAS, the City Council further considered among other things the character
of the existing zoning district and its peculiar suitability for particular uses and with the
view to conserve the value of buildings and encourage the most appropriate use of land
throughout this City; and
WHEREAS, the City Council of the City of Grapevine, Texas, does find that there
is a public necessity for the granting of this conditional use permit, that the public demands
it, that the public interest clearly requires the amendment, that the zoning changes do not
unreasonably invade the rights of those who bought or improved property with reference
to the classification which existed at the time their original investment was made; and
WHEREAS, the City Council of the City of Grapevine, Texas, does find that the
conditional use permit lessens the congestion in the streets, helps secure safety from fire,
panic and other dangers, prevents the overcrowding of land, avoids undue concentration
of population, facilitates the adequate provisions of transportation, water, sewerage,
schools, parks and other public requirements; and
WHEREAS, the City Council of the City of Grapevine, Texas, has determined that
there is a necessity and need for this conditional use permit and has also found and
determined that there has been a change in the conditions of the property surrounding
and in close proximity to the property requested for a change since this property was
originally classified and, therefore, feels that the issuance of this conditional use permit
for the particular piece of property is needed, is called for, and is in the best interest of
the public at large, the citizens of the City of Grapevine, Texas, and helps promote the
general health, safety and welfare of this community.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS:

Section 1 . That the City does hereby issue a conditional use permit in
accordance with Section 48 of Ordinance No. 82-73, the Comprehensive Zoning
Ordinance of the City of Grapevine, Texas, same being also known as Appendix "D" of
the City Code, by granting Conditional Use Permit CU24-28 to allow a plumbing repair
company with outdoor storage of service vehicles (Elmer's HVAC & Plumbing Supply) in
a district zoned "HC", Highway Commercial District within the following described
property: Block 1 , Lot 2, Grapevine Business Park (340 West Northwest Highway) all in
accordance with a site plan approved pursuant to Section 47 of Ordinance No. 82-73,
attached hereto and made a part hereof as Exhibit "A", and all other conditions,
restrictions, and safeguards imposed herein, including but not limited to the following:
1. Installation and full irrigation of landscaping in the required 25-foot
front yard per Subsection 26.G.3., Front yard of Section 26, "HC",
Highway Commercial District of the Zoning Ordinance be met along
Lot 2's frontage of Northwest Highway; planting three trees, shrubs,
and ground cover, and
2. Remove any mechanical and electrical equipment scrap within 24
hours or by close of the next business day from the site.
Section 2. That the City Manager is hereby directed to amend the official zoning
map of the City of Grapevine, Texas, to reflect the herein conditional use permit.
Section 3. That in all other respects the use of the tract or tracts of land herein
above described shall be subject to all the applicable regulations contained in said City
of Grapevine zoning ordinance and all other applicable and pertinent ordinances of the
City of Grapevine, Texas.
Section 4. That the zoning regulations and districts as herein established have
been made in accordance with the comprehensive plan for the purpose of promoting
health, safety, morals and the general welfare of the community. They have been
designed with respect to both present conditions and the conditions reasonably
anticipated to exist in the foreseeable future; to lessen congestion in the streets; to secure
safely from fire, panic, flood and other dangers; provide adequate light and air; to prevent
overcrowding of land, to avoid undue concentration of population; facilitate the adequate
provisions of transportation, water, sewerage, drainage and surface water, parks and
other public requirements, and to make adequate provisions for the normal business,
commercial needs and development of the community. They have been made with
reasonable consideration, among other things, of the character of the district, and its
peculiar suitability for the particular uses and with a view of conserving the value of
buildings and encouraging the most appropriate use of land throughout the community.
Section 5. That this ordinance shall be cumulative of all other ordinances of the
City of Grapevine, Texas, affecting zoning and shall not repeal any of the provisions of
said ordinances except in those instances where provisions of those ordinances which
are in direct conflict with the provisions of this ordinance.

Section 6. That the terms and provisions of this ordinance shall be deemed to
be severable and that if the validity of the zoning affecting any portion of the tract or tracts
of land described herein shall be declared to be invalid, the same shall not affect the
validity of the zoning of the balance of the tract or tracts of land described herein.
Section 7. That any person violating any of the provisions of this ordinance shall
be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum
not to exceed Two Thousand Dollars ($2,000.00) and a separate offense shall be deemed
committed upon each day during or on which a violation occurs or continues.
Section 8. That the fact that the present ordinances and regulations of the City
of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals,
peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an
emergency for the immediate preservation of the public business, property, health, safety
and general welfare of the public which requires that this ordinance shall become effective
from and after the date of its final passage, and it is accordingly so ordained.
