At their July 11, 2016 meeting, the Board of Zoning Adjustment acted on the following
cases:
BZA16-14 — Neal Cooper, 525 East Worth Street, platted as Lot 7, Block 108,
College Heights Addition.
The Board approved the following request
Section 15.F.2, "R-7.5" Single Family District, Density Requirements, requires a
minimum lot size of 7,500 square feet. The Board approved a variance of 512 -feet
allowing a lot size of 6,988 square feet for the existing lot.
Section 15.G.4., "R-7.5" Single Family District, Area Regulations, requires a
minimum lot width of 65 -feet. The Board approved a variance of fifteen -feet (15')
allowing a lot width of fifty feet (50') for the existing lot.

PUBLIC HEARING
BOARD OF ZONING ADJUSTMENT CASE BZA16-14, NEAL COOPER. 525 EAST
WORTH STREET
The first item for the Board of Zoning Adjustment to consider was BZA16-14 submitted
by Neal Cooper for property located at 525 East Worth Street, platted as Lot 7, Block
108, College Heights Addition.
Section 15.F.2., "R-7.5" Single Family District, Density Requirements, requires a
minimum lot area of 7,500 square feet. The applicant requested a variance of 512
square feet, allowing a lot area of 6,988 square feet for an existing lot.
Section 15.G.4., "R-7.5" Single Family District, Area Regulations, requires a
minimum lot width of 65 -feet. The applicant requested a variance of fifteen -feet (15)
allowing a lot width of fifty (50) feet for an existing lot.
Mr. Triplett explained that Staff found a special condition existed for the variances
requested. Specifically, the lot was originally platted in 1921 predating the City's first
zoning ordinance adopted in 1955. Developed property, an alley and right-of-way
existed to the east, west, north and south respectively, eliminating the possibility to
expand the site to meet the area and width requirements.
Mr. Triplett stated that the applicant intended to construct a new one and one-half story
3,335 square feet dwelling including an attached rear entry garage, covered front porch
and covered patio on the subject site as shown on the plot plan. On May 25, 2016 the
Grapevine Historic Preservation Commission approved CA16-50 for the new
construction.
With no questions for Mr. Triplett, Neil Cooper, of 613 East Texas Street, Grapevine,
Texas, took the Oath of Truth; he gave a brief presentation to the Board and requested
favorable consideration of his request and offered to answer any questions of the
Board.
Chairman Holt announced that one (1) letter of approval had been received.
With no questions for Mr. Cooper, and no additional speakers, Robert Rainwater made
a motion to close the public hearing. Mike Morris seconded the motion which prevailed
by the following vote:

Mr. Stombaugh explained that Staff found no special conditions existed for the
requested variance. He explained that the applicant proposed to install a four (4) foot
by six (6) foot storm shelter in the garage that would occupy the area normally reserved
for a vehicle. This was a self-imposed hardship that did not meet the physical hardship
criteria for granting a variance.
Mr. Stombaugh further stated that typically this type of storm shelter was retrofitted
within a central location of the residence such as a master bedroom closet. The
applicant had stated this had been considered however, the expense of doing so was
prohibitive.
With no questions for Mr. Stombaugh, Alexandra Hernandez, of 4302 Hazy Meadow
Lane, Grapevine, Texas, took the Oath of Truth; she gave a brief presentation to the
Board and requested favorable consideration of her request and offered to answer any
questions of the Board.
George Dalton asked Ms. Hernandez if the storm shelter could be located in the rear of
the garage. Ms. Hernandez stated that there was a ledge that housed plumbing and gas
lines that prohibited it from being located at the rear of the garage.
With no further questions for Ms. Hernandez, James Bird contractor with Valley Storm
Shelters of 1359 Exchange, Richardson, Texas, took the Oath of Truth; he stated that
the structure was not permanent and the homeowner intended to move the structure if
she were to move.
Chairman Holt announced that two (2) letters of approval and two (2) letters of
opposition had been received.
With no questions for Mr. Bird, and no additional speakers, Robert Rainwater made a
motion to close the public hearing. George Dalton seconded the motion which prevailed
by the following vote:

Staff recommends the Board of Zoning Adjustment deny the following variance to the
Grapevine Comprehensive Zoning Ordinance 82-73 for property located at 4302 Hazy
Meadow Lane, platted as Lot 9, Block 6, Glade Crossing IV Addition as follows:
Section 56.C.1., Off -Street Parking Requirements, Number of Parking Spaces
Required, Residential, requires two parking spaces located behind the front building

The applicant is requesting to reduce this to one parking space and if approved by the
Board would allow for only one parking space behind the front building line for the single
family dwelling unit.
SPECIAL CONDITION:
Staff finds that a special condition does not exist for the variance requested. The applicant
proposes to install a storm shelter (4 feet by 6 feet in size) in the garage that would occupy

RE: Building Permit for a Removable Storm Shelter within a Homeowner's Garage
®ear Grapevine Board of Adjustments embers:
I am requesting a re-evaluation of a building permit that would allow us to install a 4' x 6' storm shelter, constructed
by Valley Storm Shelters, in our garage. The original building permit was rejected due to the fact that building the
structure would violate the Grapevine Ordinance: Section 56 Off -Street Parking Requirements.
We are requesting the consideration of the board for the following reasons:
1. Placing the shelter in our backyard is not a possibility as it is inaccessible with a forklift; our side yard is too
narrow for access and the section of our back fence that borders the green belt area is blocked by a utility
box (the majority of our back fence borders our neighbor's yard). A forklift would be necessary as the
structure weighs 3000 lbs.
2. Even if we could gain access through our neighbor's yard (which we cannot, as their side yard is too narrow
and the only other alternative access would require going through both their back and side fences and over
the location they are building a pool) we would need to remove two mature trees (which would cost around
$6000) on our property to do so.
3. Our only central room without windows is a small powder room, so a saferoom would better accommodate
and protect our family in the event of a tornado. This is particularly relevant after the devastating tornados in
Rowlett and the Metroplex earlier this year.
4. 1 had priced retrofitting my master closet (the only closet in my home large enough and only other space in
our home that does not have windows) into a tornado safe room and the costs started around $15,000. This is
considerably beyond our means and much more than the costs for our proposed shelter.
5. The storm shelter is removable, so should we sell the home in the future we can take it with us, thus it does
not affect the original layout or functionality of the home.
6. With the shelter we will still have three (3) parking spaces available to us and our guests and will not put any
greater of a burden upon the city by requiring additional use of on -street parking.
7. We own one (1) car, which we will still be able to park within our garage with the shelter installed.
8. Five years ago, we signed up for The North Central Texas Safe Room Rebate Program
[hftps://saferoom.nctcog.org], sponsored by The North Central Texas Council of Governments, so that we
could afford a safe room for our family and protect ourselves in the event of a tornado. If you are one of the
few accepted each year you are eligible for a subsidy of up to $3000 for approved shelters. It's taken five
years for our name to come up on the list so that we could take part in the program and we are finally
eligible. In order to redeem our rebate the shelter needs to be installed and the city needs to inspect the
shelter before this September. We started the process months ago, but due to issues with the permitting we
are in jeopardy of losing our rebate. They have already granted us an extension to meet their deadlines.
Losing this opportunity and associated cost -savings would be a considerable setback and make moving
forward with a shelter a financial hardship.
9. As the proposed shelter is NOT PERMANENT, purposing part of my garage for its use is no different than how
many of my neighbors have used their garage spaces for uses other than parking a car (storage, workshops,
man -caves, etc...).

Section 56. Off -Street Parking Requirements
In all zoning districts there shall be provided in connection with appropriate allowable
uses, off-street parking space in accordance with the following requirements:
A. MINIMUM OFF-STREET PARKING REQUIREMENTS: The minimum number of
off-street parking spaces herein required shall be computed and provided in
accordance with the following specifications:
1. The number of spaces required shall serve residents, customers, patrons,
visitors and employees.
2. Each parking space shall have adequate drives and room for ingress and
egress to each parking space with a minimum size of eight (8) feet by
twenty-two (22) feet for each parallel parking space and nine (9) feet by
eighteen (18) feet for each angular head -in parking space, and shall be
designed in accordance with minimum City standards.
3. All maneuvering for off-street parking shall be accomplished on private
property.
4. The minimum required off-street parking shall be provided to patrons of
the associated use free of charge, unless approved with a Special Use
Permit in accordance with Section 49 of this ordinance.
B. UNCLASSIFIED USE: Where the proposed land use cannot be classified within
the uses herein specified, the City Council shall determine the specified use most
clearly related to the proposed use and the minimum requirements for the
specified use so determined shall apply to the proposed use.
C. NUMBER OF PARKING SPACES REQUIRED: Multi -use projects shall have
aggregate parking requirements. The minimum number of off-street parking
spaces required shall be as follows:

On Monday evening, July 11, 2016 at 6:15 P.M. in the City Council Chambers, 2nd Floor,
200 South Main Street, Grapevine, Texas, the Board of Zoning Adjustment of the City of
Grapevine will hold a public hearing to consider the following item:
Case Number/Name: BZA16-14
Applicant: Neal Cooper
Location: 525 East Worth Street, Lot 7, Block 108, College Heights.
Current Zoning: "R-7.5" Single Family District
Proposal: The request is for the following variances to the Grapevine
Comprehensive Zoning Ordinance 82-73: Section 15.17.2., "R-7.5" Single Family District,
Density Requirements, requires a minimum lot area of 7,500 square feet. The applicant is
requesting a variance of 500 square feet to this requirement and if approved by the Board
would allow a lot area of 7,000 square feet for an existing lot. Section 15.G.4., "R-7.5"
Single Family District, Area Regulations, requires a minimum lot width of sixty-five feet
(65'). The applicant is requesting a variance of fifteen -feet (15') to this requirement and if
approved by the Board would allow a lot width of fifty -feet (50') for an existing lot.

Location: 4302 Hazy Meadow, Lot 9, Block 6, Glade Crossing IV
Current Zoning: "R-7.5" Single Family District
Proposal: The request is for the following variances to the Grapevine
Comprehensive Zoning Ordinance 82-73: Section 56.C.1., Off -Street Parking
Requirements, Number of Parking Spaces Required, Residential, requires two parking
spaces per single family dwelling. The applicant is requesting to reduce this to one parking
space and if approved by the Board would allow for only one parking space for the single
family dwelling unit. Section 15.F.J., "R-7.5" Single Family District, Off -Street Parking
requires that parking for automobiles shall be allowed as an accessory use to any principal
permitted use provided that such shall not be located on a required front yard. The
applicant is requesting to allow one parking space as needed to be allowed to park within
the required front yard and if allowed by the Board would allow for the parking of one
vehicle within the required front yard.
After all parties have been given an opportunity to speak, the public hearing will be
closed and the Commission will deliberate the pending matters. Please contact the
