The existing dwelling was built in 1940 prior to the rezoning of the subject site in the 1984 City Rezoning to "R-7.5" Single Family District. The applicant's intent as shown on the plot plan, is to create three lots for residential use, and to bring the subject property closer into compliance by rezoning and replatting. Also the existing dwelling encroaches approximately six -feet (6) into the required twenty-five foot (25') rear yard setback adjacent to the west property line and the existing garage encroaches approximately eleven -feet (11') into the required fifteen -foot (15') side yard setback adjacent East Wall Street and the north property line. As shown on the plot plan, a 1,733 square foot dwelling and detached garage exist on the northern most part of the property, situated at the southwest corner of West Wall Street and South Church Street. Building plans for the two remaining lots are not available. On September 20, 2016 Council approved on the first reading of an ordinance a zone change request to rezone the subject site from "CN" Neighborhood Commercial District to "R-5.0" Zero -Lot -Line District to allow for the development of three single family lots. If approved by the Board, the second reading of the ordinance for the subject site is scheduled to be considered by Council at their October 18, 2016 meeting.
