REQUESTED CONDITIONAL USE, SPECIAL USE AND COMMENTS:
The applicant is requesting a conditional use permit to amend the previously aeproved site
plan of CU07-15 (Ord. 07-40) specifically to allow the development of a 56,485 square foot,
five-story parking garage with 864 parking spaces. The applicant is also requesting a
special use permit to allow a helistop on the top tier of the proposed parking garage.
The applicant is requesting approval for a new parking structure. The proposed parking
garage will be a five-story, 864-parking stall structure located on the west side of the
hospital and attached to the current emergency entrance. The proposed parking garage
combined with the existing parking on site, will allow for a total of 2,193 parking spaces
throughout the Baylor campus. Also proposed for the top tier of the proposed garage is a
new helistop. The existing helistop, which is located south of the proposed garage, will be
eliminated during the construction of the garage.

PRESENT ZONING AND USE:
Current zoning on the property is "PCD" Planned Commerce Development District and
"CC" Community Commercial District and is currently developed with a hospital, medical
office tower and a helistop. A two-story addition to the south tower and the new central
utility plant are under construction. The proposed new parking structure and helistop are
zoned "CC" Community Commercial District and "PCD" Planned Commerce Development
District:
HISTORY OF TRACT AND SURROUNDING AREA:
The subject property was rezoned in 1982 (Z82-34) from "PD", Planned Development
District allowing for multifamily dwellings, community business, light industrial, off-street
parking, a greenbelt recreational area to "SP" Specific Use Permit District for the
construction and operation of a multiple story professional building, construction and
operation of a multiple story patient bed tower and the expansion and operation of a power
plant all incidental to the operation of a medical center complex, providing the height does
not exceed the maximum height permitted by the Dallas/Fort Worth Regional Airport
Zoning Ordinance, 756 feet or seven floors; whichever height is lesser of the permitted
heights all in accordance with a site plan. The "SP" Specific Use Permit District was
amerded in 1989 with the location of a future physical plant and future helistop site and
future 4-story expansion to patient tower(CU89-07)and a location of a helistop pad (SU89-
02). The Specific Use Permit District containing 15.288 acres was expanded to add
10.9866 for a total of 26.2746 acres (CU92-06) in 1992 to add a new physical plant and
expand the parking area. The District was amended by CU94-30 in 1994 to develop a one-
story 12,830 square foot family clinic. Conditional Use Permit(CU95-04)amended the site
plan to expand the development for the outpatient facility emergency room, diagnostic
radiology and medical imaging, women's service center and intensive care. SU96-11
allowed for six wireless communications antennas and associated equipment to be placed
atop the Professiona! Building. Conditional Use Permit CU96-32 amended the site plan to
expand the Women's Center. Special Use Permit SU96-15 allowed for three wireless
communications antenna arrays of three panels each (nine total panels) and associated
equipment panels to be placed inside the elevator equipment penthouse. Special Use
Permit SU97-05 was approved on March 18, 1997 for three wireless communications
antenna arrays of three panels each (nine total panels) to be placed on the sides of the
Professional Building with an equipment shelter to be placed on the roof. Conditional Use
Permit CU97-11 amended the site plan to allow a 300 square foot addition to the Dietary
Center, modifications to the patient drop-off drive and canopy, and an addition of a 115-
vehicle parking lot. Conditional Use Permit CU98-37 (Ord. 99-05)allowed the expansion of
the existing hospital facility, the addition of a 436 vehicle parking garage, an additional
dock drive, and finro(2)temporary surface parking lots (not to exceed 18 months from date
of approval). Conditional Use Permit CU00-23 amended the site plan specifically to
convert the approved 54 temporary parking spaces on the northwest side of the property to
permanent parking for the Baylor Hospital. At the November 21, 2000 meeting Council
approved Conditional Use Permit U00-55 (Ord. 00-121) specifically to amend the site plan

to allow the conversion of a previously approved four-story addition to a five-story addition
and the conversion of a previously approved one-story addition to a two-story addition. At
the June 19, 2001 meeting Council approved Conditional Use Permit CU01-26 (Ord. 01- '
48) specifically to amend the site plan to add a sixth floor to previously approved five floor
administration/patient facility and locate a new generator on the lower level of the existing
parking garage. Conditionat Use Permit CU05-55 amended the site plan specifically to
allow for a 1.90 acre, 145 space parking lot for the existing hospital facility. Conditional
Use Permit CU06-09 amended the site plan specifically for an expansion in excess of
6,000 square feet to the emergency services area of the medical complex. Conditional
Use Permit CU06-30 amended the site plan specifically to add shade structures to cover a
designated handicap parking area adjacent to the south side of the existing parking
garage. At the July 17, 2007 meeting Council approved CU07-15 which was a request for
a two story addition to the south tower of the Baylor Medical Center, and a new 17,000
square foot central utility plant and engineering office.
The "R-12.5", Single Family District, "R-3.5", Two-Family District, and" PO", Professional
Office District areas to the north were rezoned from "R-1", Single Family District, "R-2",
Two Family District, "R-3", Multifamily District and "C-2", Community Business District in the
1984 City Rezoning.
The "CC", Community Commercial District area to the south was rezoned from "PCD",
Planned Commerce Development District in 1987 (Z87-09) and from "PD", Planned
Development District in the 1984 City Rezoning. The Planned Commerce Development
District area to the south was rezoned from "C-2", Community Business District and "CC", "'""'°°
Community Commercial District in the 1984 City rezoning. The `PO", Professional Office
District area to the east was rezoned from "PCD", Planned Commerce Development
District in 1987 (Z87-09) and from "PD", Planned Development District in the 1984 City
Rezoning. The "LI", Light Industrial District area to the west was rezoned from "I-1", Light
Industrial District in the 1984 City Rezoning.

AIRPORT IMPACT:
� The subject tract is located within "Zone A" Minimal Zone of Effect as defined on the
"Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" map. Few
activities will be affected by aircraft sounds in Zone A, except for sound sensitive activities
such as auditoriums, churches, schools, hospitals, and theaters. The proposed parking
structure and helistop are appropriate in this noise zone.
MASTER PLAN APPLICATION:
The Master Plan designates the subject property as a Commercial Land Use and a small
area to the east as a Low Intensity Commercial Land Use. Both requests are in
compliance with the Master Plan. �
THOROUGHFARE PLAN APPLICATION:
The Thoroughfare Plan designates College Street as a Type E Collector, requiring a 75-
foot right-of-way,which is developed with four lanes. Lancaster Drive and Baylor Parkway
are local non-residential streets and are not designated thoroughfares.

The total parking space count is revised from 855 stalls to 864 stalls.
The rypical floor height is revised from 11'to 11'-6". This additional6" will provide 10"
space for sprinkler assembly below double tees. The breakdown of typical floar height is:

The Federal Aviation Administration has conducted an aeronautical study under the provisions of 49 U.S.C.,
Section 44718 and if applicable Title 14 of the Code of Federal Regulations, part 77, concerning:

This aeronautical study revealed that the structure does not exceed obstruction standards and would not be a
hazard to air navigation provided the following condition(s), if any, is(are) met:
Based on this evaluation,marking and lighting are not necessary for aviation safety. However, if marking
and/or lighting are accomplished on a voluntary basis, we recommend it be installed and maintained in
accordance with FAA Advisory circular 70/7460-1 K Change 2.
This determination is based, in part, on the foregoing description which includes specific coordinates,heights,
frequency(ies) and power. Any changes in coordinates, heights, and frequencies or use of greater power will
void this determination. Any future construction or alteration, including increase to heights, power, or the
addition of other transmitters,requires separate notice to the FAA.
This determination does include temporary construction equipment such as cranes, derricks, etc., which may be
used during actual construction of the structure. However, this equipment shall not exceed the overall heights as
indicated above. Equipment which has a height greater than the studied structure requires separate notice to the
FAA.
This determination concerns the effect of this structure on the safe and efficient use of navigable airspace
by aircraft and does not relieve the sponsor of compliance responsibilities relating to any law, ordinance, or
regulation of any Federal, State,or local government body.
A copy of this determination will be forwarded to the Federal Communications Commission if the structure is
subject to their licensing authority.

complied with, the case having come before the City Council of the City of Grapevine,
Texas, after all legal notices requirements, conditions and prerequisites having been
complied with; and
WHEREAS, the City Council of the City of Grapevine, Texas, at a public hearing
called by the City Council did consider the following factors in making a determination as
to whether this requested conditional use permit should be granted or denied: safety of the
motoring public and the pedestrians using the facilities in the area immediately surrounding
the site; safety from fire hazards and measures for fire control; protection of adjacent
property from flood or water damages, noise producing elements, and glare of the vehicular

transportation, water, sewerage, schools, parks and other facilities; and
WHEREAS, the City Council of the City of Grapevine, Texas, at a public hearing
called by the City Council of the City of Grapevine, Texas, did consider the following factors
in making a determination as to whether this requested conditional use permit should be
granted or denied; effect on the congestion of the streets, the fire hazards, panics and other
dangers possibly present in the securing of safety from same, the effect on the promotion
of health and the general welfare, effect on adequate light and air, the effect on the
overcrowding of the land, the effect on the concentration of population, the effect on the
transportation, water, sewerage, schools, parks and other public facilities; and
WHEREAS, all of the requirements of Section 48 of Ordinance No. 82-73 have been
satisfied by the submission of evidence at a public hearing; and
WHEREAS, the City Council further considered among other things the character
of the existing zoning district and its peculiar suitability for particular uses and with the view �
to conserve the value of buildings and encourage the most appropriate use of land
throughout this City; and
WHEREAS, the City Council of the City of Grapevine, Texas, does find that there
is a public necessity for the granting of this conditional use permit, that the public demands
it, that the public interest clearly requires the amendment, that the zoning changes do not
unreasonably invade the rights of those who bought or improved property with reference
to the classification which existed at the time their original investment was made; and
WHEREAS, the City Council of the City of Grapevine, Texas, does find that the
conditional use permit lessens the congestion in the streets, helps secure safety from fire,
panic and other dangers, prevents the overcrowding of land, avoids undue concentration
of population, facilitates the adequate provisions of transportation, water, sewerage,
schools, parks and other public requirements; and
WHEREAS, the City Council of the City of Grapevine, Texas, has determined that
there is a necessity and need for this conditional use permit and has also found and
determined that there has been a change in the conditions of the property surrounding and
in close proximity to the property requested for a change since this property was originally
classified and, therefore, feels that the issuance of this conditional use permit for the
particular piece of property is needed, is called for, and is in the best interest of the public
at large, the citizens of the City of Grapevine, Texas, and helps promote the general health, A.;<�,
safety and welfare of this community.
ORD. NO. 2
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1. That the City does hereby issue a conditional use permit in
accordance with Section 48 of Ordinance No. 82-73, the Comprehensive Zoning Ordinance
of the City of Grapevine, Texas, same being also known as Appendix"D" of the City Code,
by granting Conditional Use Permit CU08-11 to amend the site plan approved by
Ordinance No. 2007-40 for the development of a parking structure (Emergency Department
Parking Garage — Baylor Regional Medical Center at Grapevine), specifically to allow a
56,485 square foot, five stories, 864-parking space garage addition to the existing
Emergency Department in a district zoned "PCD" Planned Commerce Development District
and "CC" Community Commercial District Regulations within the following described
property: Lot 1A, Block A, Grapevine Medical Center Addition (1660 West College Street)
all in accordance with a site plan approved pursuant to Section 47 of Ordinance No. 82-73,
attached hereto and made a part hereof as Exhibit "A", and all other conditions,
restrictions, and safeguards imposed herein, including but not limited to the following:
None.
Section 2. That the City Manager is hereby directed to amend the official zoning
map of the City of Grapevine, Texas, to reflect the herein conditional use permit.
-� Section 3. That in all other respects the use of the tract or tracts of land herein
above described shall be subject to all the applicable regulations contained in said City of
Grapevine zoning ordinance and all other applicable and pertinent ordinances of the City
of Grapevine, Texas.
Section 4. That the zoning regulations and districts as herein established have
been made in accordance with the comprehensive plan for the purpose of promoting
health, safety, morals and the general welfare of the community. They have been
designed with respect to both present conditions and the conditions reasonably anticipated
to exist in the foreseeable future; to lessen congestion in the streets; to secure safely from
fire, panic, flood and other dangers; provide adequate light and air; to prevent
overcrowding of land, to avoid undue concentration of population; facilitate the adequate
provisions of transportation, water, sewerage, drainage and surFace water, parks and other
public requirements, and to make adequate provisions for the normal business, commercial
needs and development of the community. They have been made with reasonable
consideration, among other things, of the character of the district, and its peculiar suitability
for the particular uses and with a view of conserving the value of buildings and encouraging
the most appropriate use of land throughout the community.
Section 5. That this ordinance shall be cumulative of all other ordinances of the
City of Grapevine, Texas, affecting zoning and shall not repeal any of the provisions of said
ordinances except in those instances where provisions of those ordinances which are in

Section 6. That the terms and provisions of this ordinance shall be deemed to be
severable and that if the validity of the zoning affecting any portion of the tract or tracts of
land described herein shall be declared to be invalid, the same shall not affect the validity
of the zoning of the balance of the tract or tracts of land described herein.
Section 7. That any person violating any of the provisions of this ordinance shall
be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not
to exceed Two Thousand Dollars ($2,000.00) and a separate offense shall be deemed
committed upon each day during or on which a violation occurs or continues.
Section 8. That the fact that the present ordinances and regulations of the City
of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals,
peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an
emergency for the immediate preservation of the public business, property, health, safety
and general welfare of the public which requires that this ordinance shall become effective
from and after the date of its final passage, and it is accordingly so ordained.

College Street), all in accordance with a site plan approved pursuant to Section 49 of
Ordinance No. 82-73, attached hereto and made a part hereof as Exhibit "A", and all other

public requirements, and to make adequate provisions for the normal business, commercial
needs and development of the community. They have been made with reasonable
consideration, among other things, of the character of the district, and its peculiar suitability
for the particular uses and with a view of conserving the value of buildings and encouraging
the most appropriate use of land throughout the community.
Section 5. That this ordinance shall be cumulative of all other ordinances of the
„�� City of Grapevine, Texas affecting zoning and shall not repeal any of the provisions of said

Section 6. That the terms and provisions of this ordinance shall be deemed to be ..�;
severable and that if the validity of the zoning affecting any portion of the tract or tracts of _
land described herein shall be declared to be invalid, the same shall not affect the validity
of the zoning of the balance of the tract or tracts of land described herein.
Section 7. That any person violating any of the provisions of this ordinance shall
be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not
to exceed Two Thousand Dollars ($2,000.00) and a separate offense shall be deemed
committed upon each day during or on which a violation occurs or continues.
Section 8. That the fact that the present ordinances and regulations of the City
of Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, peace
and general welfare of the inhabitants of the City of Grapevine, Texas, creates an
emergency for the immediate preservation of the public business, property, health, safety
and general welfare of the public which requires that this ordinance shall become effective
from and after the date of its passage, and it is accordingly so ordained.
