The existing shed is with in 1.5 ft of the property line of the neighbors, the city of Grapevine's code is a minimum of 6'0". The home owner says that the shed was there when the home was purchased. It is highly possible that the previous owner self installed to avoid permitting or it is less than minimum square footage requiring city permitting. My questions are: · Are there any utilities in the area that could cause a problem with the shed being to close to the property line? · If there are underground utilities in the area, should the shed be relocated? · What is the height of this overhead patio cover 8' 10' 12'? · What is the material being used for this new structure? · Has the neighbor next to the property in question seen any architectural drawings as to what is proposed? · And how does this effect the neighbor's property in the present and future? · Are there underground utility lines that could require modifications in the future? If so, I believe that the request for variance should be denied. If there are no utilities or future utility access required by any utility companies, then I have no real issue except the city is setting a precedence that easements can be disregarded. I would say that if the city does not require the relocation of the shed to the proper distance the homeowner should consider themselves lucky. I suggest that the homeowner build up to the easement line. TRIPLETT, JR, PLANNER II SUBJECT: BOARD OF ZONING ADJUSTMENT CASE #BZA25-02 2918 CARDINAL DRIVE MEETING DATE: MONDAY, MAY 5, 2025 BACKGROUND INFORMATION: The subject property is developed with a single-story, 1,374 square foot single-family detached residence on an 8,570 square foot (0.20 acre) lot. The lot was developed in 1980 and is platted as Block 4, Lot 12, Kimberly Estates. The subject property was zoned “R-1”, Single Family Dwelling prior to the 1984 City-wide Rezoning at which time it was rezoned “R-7.5”, Single-Family District. REQUEST: The applicant intends to add to the existing 1,374 square-foot, residential dwelling by adding a 192 square foot unenclosed covered patio for outdoor living space. After applying for the building permit, it was discovered that a secondary building exists on the subject site that did not have a permit and did not meet the minimum setback requirement of six feet adjacent to the south property line. The following special exception is requested: Subsection 15.G.3, Width of side yard on each of Section 15, “R-7.5”, Single-Family District requires that each lot have a side yard setback of 6 feet. The existing secondary building is approximately 4-feet from the south property line and encroaches approximately 2-feet into the required side yard setback. ATYPICAL CONDITION: Staff finds that an atypical condition does not exist for the requested special exception on this property. Specifically, minimum side yard setback requirement adjacent to the south property line can be achieved by moving the secondary building to meet the setback requirement. In 2022, a Silver Maple tree located adjacent to the north side of the secondary building was removed; however, the stump remains. The secondary building is supported by a skid foundation. The secondary building if relocated, can accommodate Zoning Ordinance (82-73) relative to Subsection 15.G.3, Width of side yard of Section 15, Area Regulations and of the Zoning Ordinance.
