TO: HONORABLE MAYOR, CITY COUNCIL MEMBERS, AND THE PLANNING AND ZONING COMMISSION FROM: BRUNO RUMBELOW, CITY MANAGER ERICA MAROHNIC, DIRECTOR, PLANNING SERVICES MEETING DATE: JUNE 17, 2025 SUBJECT: PLANNING SERVICES TECHNICAL REPORT OF CONDITIONAL USE APPLICATION CU25-19, WALMART EV CHARGING STATIONS APPLICANT: Eric Jeon – Kimley-Horn PROPERTY LOCATION AND SIZE: The subject property is located at 1601 West State Highway 114 and is platted as Block 1, Lot 2, Wal- Mart Addition. The property contains 40.97 acres and has approximately 803 feet of frontage along West State Highway 114 and 2,584 feet of frontage along State Highway 26/ Ira E. Woods Avenue. REQUESTED CONDITIONAL USE AND COMMENTS: The site was previously approved for a conditional use permit CU23-01 (Ord. 2023-009) to add two metal storage containers for the purpose of storing new parts and landscape equipment for on- and off-site Walmart facility management. This request is specifically to add six (6), public use, freestanding Level 3 electric vehicle (EV) charging stations to the existing Walmart parking lot. On January 16, 2024, City Council approved AM23-02 (Ord. 2024-006) to create new definitions, allow electric vehicle charging stations as a conditional use, and create use- specific standards, relative to electric vehicle charging stations. With this request, the applicant proposes converting an existing row of 18 head-in parking spaces to the northeast of the main entrances into ten 90-degree EV stalls and two accessible EV stalls. The applicant will install six Level 3, electric vehicle (EV) charging stations. The six EV chargers will charge two vehicles at a time. The stalls and equipment are adjacent to two existing driving aisles of head-in parking spaces. In order to meet knox box distance requirements, the applicant proposes three (3) knox boxes and will install a transformer and switchboard to the northwest of the proposed EV charging stations. A 7.5-foot, masonry screening wall is proposed for the EV charging equipment. The EV chargers will be available 24 hours a day. The total number of required parking spaces is 817. The total number of provided parking spaces is 881. All other use-specific standards in Subsection 42. I. Electric vehicle (EV) charging stations, are met. PRESENT ZONING AND USE: The property is currently zoned “CC”, Community Commercial District with a planned commercial center designation. The subject site is developed as Walmart retail store. HISTORY OF TRACT AND SURROUNDING AREA: The subject site was zoned “R-2”, Two-Family Dwelling District and “I-1”, Light Industrial District prior to the 1984 City-wide rezoning at which time the subject site was rezoned to “LI”, Light Industrial District. On January 15, 2002, City Council approved Z01-19 (Ord. 2002-08) to rezone 40.97 acres from “LI”, Light Industrial District to “CC”, Community Commercial District. On January 15, 2002, City Council approved CU01-71 (Ord. 2002-09) to allow the development of a planned commercial center including an automotive repair facility, gasoline sales, the possession, storage, retail sale and off-premise consumption of alcoholic beverages (beer and wine only) in conjunction with a retail store, and approval of one 40-foot pole sign and two 20-foot pole signs. On March 27, 2002, the Site Plan Review Committee (SPRC) approved CU02-10 to allow modifications to the previously approved building elevations specifically to screen the roof top mechanical equipment by increasing the height of the parapet wall by three feet. On May 30, 2003, SPRC approved CU03-07 to allow modifications to the previously approved site plan, which included, moving the 40-foot pole sign to a different location on site, revising the 24-foot sign located along State Highway 26, and changing the building elevations for roof top mechanical equipment by increasing the height of the parapet wall by 3-feet for Sam’s Club retail store. On July 23, 2003, SPRC approved CU03-29 to allow changes to the previously approved site plan and landscape to move a drive located along State Highway CU25-19.4 2 114 and revise landscaping. On July 7, 2022, SPRC approved CU22-33 to allow restriping the parking lot to accommodate widened pickup parking spaces from 9.5 feet to 12 feet and eliminating 13 parking spaces. On February 21, 2023, City Council approved CU23-01 to add two metal storage containers for the purpose of storing new parts and landscape equipment for on- and off-site Walmart facility management. SURROUNDING ZONING AND EXISTING LAND USE: NORTH: “LI”, Light Industrial District – Wrico Stamping and Butterfly Valves & Controls, Inc. SOUTH: “LI”, Light Industrial District – CubeSmart Self Storage and “CC”, Community Commercial District – Mustang Elite Lube Center, Wash Your Stuff EAST: “CC”, Community Commercial District – Sam’s Club WEST: “LI”, Light Industrial District – Heritage Business Park AIRPORT IMPACT: The subject tract is located within "Zone B" Middle Zone of Effect as defined on the "Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" map. In Zone B, the following uses may be considered only if sound treatment is included in building design: multi-family apartments, motels, office buildings, movie theaters, restaurants, personal and business services. Single-family residential and sound sensitive uses such as schools and churches should avoid this zone. The subject site is also located within “Zone C” Zone of Greatest Effect as defined on the “Aircraft Sound Exposure: Dallas/ Fort Worth Regional Airport Environs” Map. Industrial and commercial uses that can tolerate high levels of sound exposure are appropriate in “Zone C.” The applicant’s proposal is an appropriate use in this noise zone. MASTER PLAN APPLICATION: Map 2: Land Use Plan of the Comprehensive Master Plan designates the subject property as Commercial (CO) land use. The request is compliant with the Master Plan. THOROUGHFARE PLAN APPLICATION: The City of Grapevine Thoroughfare Plan designates Ira E. and WHEREAS, the City Council of the City of Grapevine, Texas, at a public hearing called by the City Council of the City of Grapevine, Texas, did consider the following factors in making a determination as to whether this requested conditional use permit should be granted or denied; Section 2. That the City Manager is hereby directed to amend the official zoning map of the City of Grapevine, Texas, to reflect the herein conditional use permit. Section 3. That in all other respects the use of the tract or tracts of land herein above described shall be subject to all the applicable regulations contained in said City of Grapevine zoning ordinance and all other applicable and pertinent ordinances of the City of Grapevine, Texas. Section 4. That the zoning regulations and districts as herein established have been made in accordance with the comprehensive plan for the purpose of promoting health, safety, morals and the general welfare of the community. That this ordinance shall be cumulative of all other ordinances of the City of Grapevine, Texas, affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances which are in direct conflict with the provisions of this ordinance. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract or tracts Ordinance No. 2025-031 3 CU25-19 of land described herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the tract or tracts of land described herein. Section 7. That any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Thousand Dollars ($2,000.00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 8. That this ordinance shall become effective from and after the date of its final passage.
