Purpose of Request:
The request BZA25-06 is for the following special exception to the Grapevine Comprehensive
Zoning Ordinance 82-73: Section 43.E.3, Nonconforming Uses and Structures, which allows
the Board of Zoning Adjustment to approve the remodeling and/or enlargement of a
nonconforming use. The applicant is requesting a special exception to the requirement that a
minimum of 15% of the total lot area must be maintained as open space, and no more than 85%
of the lot area may be covered by impervious surfaces.

PROJECT DESCRIPTION: BZA25-06/CU25-27; submitted by Baird Hampton & Brown, Inc. for proper ty located
at 1240 Texan Trail, Suite 100, platted as Lot 2, D FW Air Freight Centre Addition. The applicant is re questing
a conditional use permit to allow for the applicati on and installation of paint protection film (windo w tinting) in
conjunction with a proposed business. The applicant also requests a special exception to the requireme nt of
minimum of 15% of the total lot area must be mainta ined as open space, and no more than 85%
of the lot area may be covered by impervious surfac es . The property is zoned “LI”, Light Industrial
District and is owned by Tarrant County Properties, LLC.
PLANNING SERVICES
Non-conforming uses and structures
Action is required by the Board of Zoning Adjustmen t (BZA) to address non-conformance of
the subject site with respect to minimum open space and maximum lot coverage. The Zoning
Ordinance requires that a minimum of 15% of the tot al lot area must be maintained as open
space, and no more than 85% of the lot area may be covered by impervious surfaces. Please
contact staff at 817.410.3155 to discuss the BZA pr ocess and next steps.

SUBJECT: BOARD OF ZONING ADJUSTMENT CASE #BZA25-06
1240 TEXAN TRAIL
MEETING DATE: MONDAY, SEPTEMBER 8, 2025
BACKGROUND INFORMATION:
The subject property is developed with two one-story, 80,054 square foot
office/warehouse buildings on a 279,220 square foot (6.41 acre) lot. The zoning district
at the time of development was both “C2” Commercial Business District (1970-10) or
“CW” Commercial Warehouse District (Ord. 1982-73), and was rezoned to “LI”, Light
Industrial District in the 1984 City-wide Rezoning.
On August 19, 2025, City Council approved the first reading of an ordinance, conditional
use permit CU25-27, on the subject site, to allow for the application and installation of
paint protection film and window film (window tinting) in conjunction with a proposed
business, and occupy an existing, 8,422 sq. ft. lease space.
The application was submitted by Skylar Lyle, of Barid, Hampton and Brown, on behalf
of the property owner.
REQUEST:
The applicant is requesting a special exception to reduce minimum open space, exceed
maximum impervious area, and allow reduced landscaping regulations.
The following special exception is requested:
Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming
use.
The applicant is requesting a special exception to the allow the subject site to remain as
developed and to allow exceptions to Section 31, “LI”, Light Industrial District, and to
Section 53, Landscaping Regulations.
The subject site does not meet the following requirements:
· Subsection 31.F.2, Minimum Open Space, of Section 31.F, Density
Requirements, of Section 31, “LI”, Light Industrial District stipulates that at
least 15% of the total lot area shall be devoted to open space. The existing

development includes approximately 16,753 square feet of open space which
equals 6.0% of the total lot area.
· Subsection 31.F.4, Maximum Impervious Area, of Section 31.F, Density
Requirements, of Section 31, “LI”, Light Industrial District stipulates the
combined area occupied by all buildings structures, off-street parking, and paved
areas shall not exceed 85% of the total lot area. The site is covered with building
area or other impervious surface area of approximately 262,467 square feet or
94% of the total lot area.
· Subsection 31.G.3, Front Yard, of Section 31.G, Area Regulations, of Section
31, “LI”, Light Industrial District requires that every lot shall have a front yard
of not less than 30 feet and be used as a landscaped setback area consisting of
grass, shrubbery, vines or trees, except for minimum access for driveways and
sidewalks. An approximately 10-foot pavement encroachment extends into the
required front yard/landscaped setback.
· Subsection 53.H.1, 53.H.2, and 53.H.I, of Section 53, Landscaping
Regulations enumerates multiple requirements for the minimum landscaped area
within the parking and vehicular use areas, perimeter landscaping, and non-
vehicular open space. None of these standards are met with the current
development as it consists primarily of paved area throughout the lot.
CONDITIONS:
The subject site is an existing developed lot. The subject site was developed in 1983,
compliant with Zoning Ordinance (70-10) and Zoning Ordinance (82-73) and prior to
rezoning of the property in the 1984 City-wide rezoning to an “LI”, Light Industrial District.
The zoning requirements for development at the time of development were less restrictive
than current requirements. Currently and as proposed, the site is not compliant with
Zoning Ordinance (82-73) relative to the existing minimum open space, maximum
impervious area, uninterrupted 30-foot landscaped front yard, and landscape regulations.
RECOMMENDATION:
Staff recommends the Board of Zoning Adjustment approve a special exception to the
Grapevine Comprehensive Zoning Ordinance 82-73, Subsection 43.E.3, Nonconforming
Uses and Structures to allow the subject site to remain as developed as shown on the
plot plan.
