PROPERTY LOCATION AND SIZE:
The subject property is addressed as 3560 North
Grapevine Mills Boulevard and is platted as Block A,
Lot 3A1, Grapevine Mills Crossing. The property
contains 3.336 acres and has approximately 352
feet of frontage along North Grapevine Mills
Boulevard.
REQUESTED CONDITIONAL USE AND COMMENTS:
The site was previously approved for a conditional use permit CU19-02 (Ord. 2019-006)
for additional on -premise signage, and to allow for gasoline sales, and off -premise
consumption of alcoholic beverages (beer and wine only) in conjunction with a
convenience store.
This request is specifically for a conditional use permit (CU25-37) to allow three outdoor
soccer fields, a 5.040 square foot recreation area, outdoor speakers, and a check -in and
concessions suite in a portion of an existing building within a planned commercial center.
The applicant is proposing to build a City Futsal soccer complex south of the existing
multitenant building on Lot 3A1. The site will feature three (3) courts and a turf recreation/
warm-up area. There will be a 31,440 sq.ft., 30-foot tall, steel canopy covering the 3
courts. Hours of operation will be Monday through Friday from 4.00 p.m. to 11.00 p.m.
and Saturday and Sunday from 8.00 a.m. to 9.00 p.m.

No additional buildings are proposed. Patrons will check in at the existing multi -tenant
building, suite 300, which will also include restrooms and concessions.
Required parking for Lot 3A1 is 96 spaces. Eighty-five spaces are provided on Lot 3A1.
In order to meet required parking, the applicant has a shared parking agreement with Lot
5AR1 for the additional 11 spaces. All parking requirements are met on lots 3A1 and
5AR 1.
As part of the conditional use request, the applicant is requesting six (6) outdoor speakers
to be used for announcements and background music.
PRESENT ZONING AND USE:
The property is currently developed with a multitenant building and green space and is
zoned "CC", Community Commercial District.
HISTORY OF TRACT AND SURROUNDING AREA:
The subject and surrounding property was rezoned from 1-1", Light Industrial District to
"CC", Community Commercial District during the 1984 City-wide Rezoning.
On February 20, 2007, City Council approved CU06-55 (Ord. 07-06) to establish
a planned commercial center with a first phase 49,348 sq.ft. multi -tenant retail
structure and to allow for two, 40-foot pole signs.
On April 17, 2018, City Council approved CU18-08 (Ord. 2018-037) to establish a
master site development plan to include, by not be limited to, building elevation
improvements to the existing multi -tenant building, along with the addition of new
multi -structure retail and restaurant development, and two, four-story multifamily
structures and two, three-story, brownstone structures.
On February 19, 2019, City Council approved CU19-02 (Ord. 2019-006) which, for
Lot 3A1, reconfigured lot lines to accommodate a transformer on Lot 3A2.

AIRPORT IMPACT:
The subject site is located within "Zone B" Middle Zone of Effect as defined on the "Aircraft
Sound Exposure: Dallas/ Fort Worth Regional Airport Environs" Map. In "Zone B", the
following uses may be considered only if sound treatment is included in the building
design: multifamily apartments, motels, office buildings, movie theatres, restaurant,
personal and business services. Single-family residential and sound sensitive uses such
as schools and churches should avoid this zone. The applicant's proposal is an
appropriate use in this noise zone.
MASTER PLAN APPLICATION:
Map 2: Land Use Plan of the Comprehensive Master Plan designates the subject property
as Commercial/ Mixed Use (C/MU) land use. The applicant's proposal is compliant with
the Master Plan.
THOROUGHFARE PLAN APPLICATION:
The City of Grapevine's Thoroughfare Plan designates East Dallas Road as a Type B
Major Arterial with a minimum 80-foot right-of-way developed as four lanes with a median.

scheduling applications before the Planning and Zoning Commission and City Council created
by city staff shall not be considered a part of the four -month period.

-Signage Requirements
The following is a list of requirements for signage associated with zoning applications. A completed checklist
must be submitted with each application. Applicants shall indicate willingness to comply with standards by
checking the box adjacent to the standard.
Zoning signage shall comply with the following standards:

We respectfully submit this narrative letter in support of our application for a Conditional Use Permit (CUP)
amendment for the subject property located at 3560 N. Grapevine Mills Blvd, within the Grapevine Mills
Crossing development.
This CUP amendment request seeks to expand the previously approved site plan (CU19-02) to allow
recreational use on Lot 3A1, Block A. Specifically, the project introduces a community -centric sports facility,
City Futsal Sports Park, which will provide covered small -sided futsal turf courts, and enhanced outdoor
recreational amenities that align with the retail and entertainment character of the Grapevine Mills area.
Proposed Use:
The primary use includes outdoor recreational activities focused on small -sided soccer and futsal
programming. This will include:
• One (1) covered futsal court and Two (2) covered turf fields for small -sided games under a metal
pavilion structure.
• Open turf warm up space and spectator seating.
• A concessions window offering pre -packaged drinks and snacks.
• PA speakers for announcements and background music.
• LED lighting under the covered areas for safe evening use.
This facility is designed to operate Monday -Friday (4pm-11pm) Saturday & Sunday (8am-9pm), with
programming primarily in the late afternoon and evenings during weekdays, and throughout the day on
weekends.

Special Conditions:
• All lighting will be fully shielded LED fixtures, directed downward and in compliance with City
illumination standards.
• Speaker volume will be regulated to ensure background music and announcements do not disrupt
adjacent properties. The sound system will follow applicable noise ordinance levels.
• Trash enclosures, screening, landscaping, and fire lane access meet all ordinance requirements.
• Shared parking will be provided through a formal agreement with adjacent Lot 5AR1, compensating
for on -site parking shortfalls.

The addition of this recreational use enhances the value of the site and surrounding area in several key ways:
• Activates underutilized land with high -quality, community -focused programming.

We are excited about the opportunity to bring the City Futsal program to the Shops of Grapevine and
believe that the following should be considered not only for our development but for the benefit of
Grapevine in general.
1. City Futsal event will pull visitors from both Grapevine and neighboring cities. This increased
foot traffic will translate into higher patronage of local retail, dining, and service businesses, and
thus BOOSTS SALES. Whether it is families grabbing a meal after games or visitors exploring
Main Street during matches, we anticipate a significant increase in our businesses both here in our
development and in other parts of Grapevine.
2. City Futsal promotes physical activity, teamwork, and community among youth, offering a safe
and constructive environment for recreation. These types of programs have a long-lasting,
positive impact on young residents and encourage life-long healthy habits. Our development
would provide an excellent opportunity for OUTSIDE SAFE ACTIVITIES IN OUR GREEN
SPACE FOR OUR YOUTH.
3.. Soccer is a global sport, and we look forward to the World Cup in 2026. City Futsal is especially
popular in urban areas in Dallas and suburban areas such as The Colony. Grapevine would be a
great addition to GROW THE LOVE OF SOCCER.
4. Grapevine is already recognized as a charming, family -oriented destination. Adding City Futsal to
the list of attractions strengthens the city's brand and appeal, especially to younger demographics
and families seeking a blend of recreation and entertainment. As retailers, we would look
forward to bringing out MORE FAMILIES to our development.
5. Many of us would welcome the opportunity to collaborate with the City Futsal program for
promotions, sponsorships, or community events that further INTEGRATES OUR LOCAL
BUSINESSES with the recreational spirit of Grapevine.

PARKING EASEMENT AGREEMENT
This PARKING EASEMENT AGREEMENT (this "Ap-reement") is executed to be
effective as of September 2nd, 2025, by and among Grapevine Retail No. 2, Ltd. a Texas limited
partnership ("Tract 1 Owner"), and Grapevine Retail No. 2, Ltd., a Texas limited partnership
("Tract 2 Owner", together with Tract 1 Owner, the "Owners").
RECITALS:
A. Tract 1 Owner is the fee owner of that certain tract of land ("Tract 1") adjacent to
and abutting Tract 2 being more particularly described on Exhibit A attached hereto and
incorporated herein by reference.
B. Tract 2 Owner is the fee owner of that certain tract of land ("Tract 2") adjacent to
and abutting Tract 1 being more particularly described on Exhibit B attached hereto and
incorporated herein by reference.
C. Tract 2 Owner desires to provide to Tract 1 Owner the rights and benefits of
parking of motor vehicles covering all of the parking spaces on Tract 2.
NOW, THEREFORE, in consideration of the mutual promises herein and for other good
and valuable consideration, the receipt and sufficiency of which are acknowledged and
confessed, the Owners agree as follows:
1. Parkinp- Easement.
(a) Tract 2 Owner hereby GRANTS, BARGAINS, SELLS and CONVEYS and,
where appropriate, DECLARES and RESERVES, to Tract 1 Owner and to and
for the benefit of and appurtenant to Tract 1 (including all the respective
Permittees): (i) a non-exclusive easement for access, ingress, egress and regress
over, upon, across and through the driveways, accessways and sidewalks now or
hereafter located on Tract 2 to grant access to the parking spaces on Tract 2, as
same may be designated from time to time by Tract 2 Owner, and (ii) the non-
exclusive right to utilize up to 11 parking spaces on Tract 2 (the "Parkinp, Area")
as shown on Exhibit C attached hereto, to be designated by Tract 1 Owner in its
reasonable discretion; provided, however, the use of such parking spaces shall be
limited to parking for vehicles no larger than full-size passenger automobiles or
pickup trucks. The grant of easement under this paragraph is subject to all
matters of record.
(b) The Parking Easement shall be perpetual unless and until sooner terminated by
written agreement of both Tract 1 Owner and Tract 2 Owner, with the written
consent of any Mortgagee then holding a lien on Tract 1 and/or Tract 2.
2. Rules and Reeulations. Tract 2 Owner shall have the right to adopt, modify and
enforce reasonable rules and regulations governing the use of the parking spaces on its Tract
from time to time, including any key card, sticker or other identification or entrance system;
provided however, parking will be available on a twenty-four hours per day, seven days per

week basis, subject to Tract 2 Owner's right, in its sole discretion, to reconfigure the surface
parking on its Tract and Tract 2 Owner may temporarily close or limit parking for maintenance
or capital improvements.
3. Other Easements. Tract 2 Owner shall have the right from time to time to grant
further easements in, over, across, through, and under its Tract for any lawful purpose, provided
that the holder of such easement does not unreasonably interfere with the rights herein granted.
Any easement or other encumbrance (including any mortgage, deed of trust or ground lease)
hereafter granted by such Owner which covers or affects any property covered by the easements
granted herein shall be expressly subordinate and subject to such easements and this Agreement.
4. Notices. All notices permitted hereunder shall be in writing and shall be deemed
to have been properly given or served by: (i) via overnight courier service; (ii) hand delivery; and
(iii) the deposit of such with the United States Postal Service or any official successor thereto,
designated as registered or certified mail, return receipt requested, bearing adequate postage and
addressed as set forth below. Each such notice shall be effective upon being deposited as
aforesaid. Rejection of, the refusal to accept or the inability to deliver because of a change of
address of which no notice was given shall not affect the effective date of or validity of such
notice. Any party shall have the right from time to time and at any time until the termination
hereof to change their respective addresses, and each shall have the right to specify its address to
any other address within the United States of America.

Any party hereto may change the address for notice specified above by giving the other party ten
(10) days' advance written notice of such change of address in the manner provided above.
5. Annlicable Law. This Agreement shall be governed by and construed in
accordance with the laws of the State of Texas.
6. Severability. In case any one or more of the provisions contained in this
Agreement shall for any reason be held to be invalid, illegal or unenforceable in any respect,

such invalidity, illegality or unenforceability shall not effect any other provision hereof, and this
Agreement shall be construed as if such invalid, illegal or unenforceable provision had never
been contained herein.
7. Multiple Countemarts. To facilitate execution, this instrument may be executed
in as many counterparts as may be convenient or required. It shall not be necessary that the
signature or acknowledgment of, or on behalf of, each party, or that the signature of all persons
required to bind any party, or the acknowledgment of such party, appear on each counterpart. All
counterparts shall collectively constitute a single instrument. It shall not be necessary in making
proof of this instrument to produce or account for more than a single counterpart containing the
respective signatures of, or on behalf of, and the respective acknowledgments of, each of the
parties hereto. Any signature or acknowledgment page to any counterpart may be detached from
such counterpart without impairing the legal effect of the signatures or acknowledgments thereof
and thereafter attached to another counterpart identical thereto except having attached to it
additional signature or acknowledgment pages.
8. Entire Agreement. This Agreement contains the entire agreement between the
parties relating to the rights herein granted and the obligations herein assumed. Any or all
representations or modifications concerning this instrument shall be of no force and effect except
for a subsequent modification in writing signed by the parties hereto.
9. Binding Effect. The parties covenant and agree that (i) the servitudes, easements,
rights, rights -of -way, privileges, agreements, covenants and restrictions and all other terms,
conditions and provisions hereof shall be binding upon their respective successors and assigns
and all other persons or entities having or hereafter acquiring any right, title or interest in the
respective Tracts, and all other persons and entities claiming by, through or under said Owners
and their respective successors and assigns, and (ii) such servitudes, easements, rights, rights of
way, privileges, agreements, covenants and restrictions and other terms herein shall be covenants
running with the land.
10. Subordination. Any mortgage, deed of trust, ground lease, or other lease hereafter
granted or entered into with respect to Tracts shall be subject, subordinate, and inferior to the
rights, benefits, and obligations created hereby, and the foreclosure under any such mortgage or
deed of trust shall not extinguish or impair the rights, benefits, and obligations created by this
Agreement.
11. Covenants Run With the Land. The rights, obligations and benefits established
pursuant to this Agreement shall run with the land and shall be binding upon each owner of the
Tracts and their respective successors and assigns and all subsequent owners of any portion of
such Tracts. Nothing contained herein is intended nor shall it be construed as creating any rights
in or for the benefit of the general public.
12. Construction. Whenever the context hereof so requires, reference to the singular
shall include the plural and likewise, the plural shall include the singular; words denoting gender
shall be construed to mean the masculine, feminine or neuter, as appropriate; and specific
enumeration shall not exclude the general, but shall be construed as cumulative of the general
recitation.

WHEREAS, an application was made requesting issuance of a conditional use

having been complied with, the case having come before the City Council of the City of
Grapevine, Texas, after all legal notices requirements, conditions and prerequisites
having been complied with; and
WHEREAS, the City Council of the City of Grapevine, Texas, at a public hearing
called by the City Council did consider the following factors in making a determination as
to whether this requested conditional use permit should be granted or denied: safety of
the motoring public and the pedestrians using the facilities in the area immediately
surrounding the site; safety from fire hazards and measures for fire control; protection of
adjacent property from flood or water damages, noise producing elements, and glare of
the vehicular and stationary lights and effect of such lights on established character of the
neighborhood; location, lighting, and types of signs and relation of signs to traffic control
and adjacent property, street size and adequacy of width for traffic reasonably expected
to be generated by the proposed use around the site and in the immediate neighborhood;
adequacy of parking as determined by requirements of this ordinance for off-street
parking facilities; location of ingress and egress points for parking and off-street locating
spaces, and protection of public health by surfacing on all parking areas to control dust,
effect on the promotion of health and the general welfare; effect on light and air; the effect
on the overcrowding of the land; the effect on the concentration of population; the effect
on the transportation, water, sewerage, schools, parks and other facilities; and
WHEREAS, the City Council of the City of Grapevine, Texas, at a public hearing
called by the City Council of the City of Grapevine, Texas, did consider the following
factors in making a determination as to whether this requested conditional use permit
should be granted or denied; effect on the congestion of the streets, the fire hazards,
panics and other dangers possibly present in the securing of safety from same, the effect
on the promotion of health and the general welfare, effect on adequate light and air, the
effect on the overcrowding of the land, the effect on the concentration of population, the
effect on the transportation, water, sewerage, schools, parks and other public facilities;
and
WHEREAS, all of the requirements of Section 48 of Ordinance No. 82-73 have
been satisfied by the submission of evidence at a public hearing; and
WHEREAS, the City Council further considered among other things the character
of the existing zoning district and its peculiar suitability for particular uses and with the
view to conserve the value of buildings and encourage the most appropriate use of land
throughout this City; and
WHEREAS, the City Council of the City of Grapevine, Texas, does find that there
is a public necessity for the granting of this conditional use permit, that the public demands
it, that the public interest clearly requires the amendment, that the zoning changes do not
unreasonably invade the rights of those who bought or improved property with reference
to the classification which existed at the time their original investment was made; and
WHEREAS, the City Council of the City of Grapevine, Texas, does find that the
conditional use permit lessens the congestion in the streets, helps secure safety from fire,
panic and other dangers, prevents the overcrowding of land, avoids undue concentration
of population, facilitates the adequate provisions of transportation, water, sewerage,
schools, parks and other public requirements; and
WHEREAS, the City Council of the City of Grapevine, Texas, has determined that
there is a necessity and need for this conditional use permit and has also found and
determined that there has been a change in the conditions of the property surrounding
and in close proximity to the property requested for a change since this property was
originally classified and, therefore, feels that the issuance of this conditional use permit
for the particular piece of property is needed, is called for, and is in the best interest of
the public at large, the citizens of the City of Grapevine, Texas, and helps promote the
general health, safety and welfare of this community.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS:
Section 1. That the City does hereby issue a conditional use permit in
accordance with Section 48 of Ordinance No. 82-73, the Comprehensive Zoning
Ordinance of the City of Grapevine, Texas, same being also known as Appendix "D" of
the City Code, by granting Conditional Use Permit CU25-37 to amend the previously
approved site plan CU19-02 (Ordinance No. 2019-006), specifically to allow for three
outdoor soccer fields, a 5,040 square foot recreation area, outdoor speakers, and a
check -in and concessions suite in a portion of an existing building within a planned
commercial center in a district zoned "CC", Community Commercial District within the
following described property: Block A, Lot 3A1, Grapevine Mills Crossing (3560 North
Grapevine Mills Boulevard) all in accordance with a site plan approved pursuant to
Section 47 of Ordinance No. 82-73, attached hereto and made a part hereof as Exhibit
"A", and all other conditions, restrictions, and safeguards imposed herein, including but
not limited to the following: None.
Section 2. That the City Manager is hereby directed to amend the official zoning
map of the City of Grapevine, Texas, to reflect the herein conditional use permit.
Section 3. That in all other respects the use of the tract or tracts of land herein
above described shall be subject to all the applicable regulations contained in said City
of Grapevine zoning ordinance and all other applicable and pertinent ordinances of the
City of Grapevine, Texas.
Section 4. That the zoning regulations and districts as herein established have
been made in accordance with the comprehensive plan for the purpose of promoting
health, safety, morals and the general welfare of the community. They have been
designed with respect to both present conditions and the conditions reasonably
anticipated to exist in the foreseeable future; to lessen congestion in the streets, to secure
safely from fire, panic, flood and other dangers; provide adequate light and air; to prevent
overcrowding of land, to avoid undue concentration of population; facilitate the adequate
provisions of transportation, water, sewerage, drainage and surface water, parks and
other public requirements, and to make adequate provisions for the normal business,
commercial needs and development of the community. They have been made with
reasonable consideration, among other things, of the character of the district, and its
peculiar suitability for the particular uses and with a view of conserving the value of
buildings and encouraging the most appropriate use of land throughout the community.
Section 5. That this ordinance shall be cumulative of all other ordinances of the
City of Grapevine, Texas, affecting zoning and shall not repeal any of the provisions of
said ordinances except in those instances where provisions of those ordinances which
are in direct conflict with the provisions of this ordinance.
Section 6. That the terms and provisions of this ordinance shall be deemed to
be severable and that if the validity of the zoning affecting any portion of the tract or tracts

of land described herein shall be declared to be invalid, the same shall not affect the
validity of the zoning of the balance of the tract or tracts of land described herein.
Section 7. That any person violating any of the provisions of this ordinance shall
be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum
not to exceed Two Thousand Dollars ($2,000.00) and a separate offense shall be deemed
committed upon each day during or on which a violation occurs or continues.
Section 8. That this ordinance shall become effective from and after the date of
its final passage.
