SPECIAL CONDITION: Staff finds that a special condition exists, specifically the topography of the site and the lot configuration with the heavily wooded creek along the northern property line adjacent to the "R-20" Single Family District property makes the screening fence inconsequential. The property line lies within a creek bed to the north. A strict interpretation of the ordinance would mandate placement of the screening wall, fence, or berm within the creek bed which would serve no purpose. The single-family property immediately adjacent to the north of the subject site is within a flood plain that is a no -build area. In addition, the subject site and the property to the north are heavily wooded providing effective screening. 0:\BZA\0109-4 Staffs recommendation for approval is conditional based on negative input from property owners within the 200-foot notification zone.
