RECOMMENDATION:
Staff recommends the Building Board of Appeals deny the request to City of Grapevine
Code of Ordinances, Chapter 7, Article IV, Section 7-127 for property addressed as 3400
William D. Tate Avenue, platted as Lot 1, Block 1, Grapevine III Addition, Grapevine, Texas
as follows:
Section 7-127, Fences, Front Yard Requirements, prohibits fences in the required or
established front yard , whichever is greater, exceeding 36" in height.
The applicant is requesting a five foot tall steel fence with six foot tall columns within the
required and established front yard adjacent to the State Highway 121 frontage road as
shown on the plot plan.
SPECIAL CONDITION:
Staff finds no hardship or special condition that warrants approval of this case.
BACKGROUND INFORMATION:
An application was submitted to the Department of Development Services by Cirrus -
Grapevine III, L.P. The building is existing.

Sec. 7-127. Front yard requirements.
(a) Corner lots: It shall be unlawful to erect a fence in the required front yard building
setback area or the established front yard area, whichever area is greater in depth, on
any corner lot, except along the interior lot line in accordance with subsection (b).
(b) Interior lots:
(1) It shall be unlawful to erect a fence, hedge or vines over 36 inches in height in
the required front yard area or the established front yard area, whichever area is
greater in depth, on any interior lot.
(2) It shall be unlawful to erect a fence, hedge or vines in the required front yard
area or the established front yard area, whichever area is greater in depth, on
any interior lot that does not have at least 50 percent through vision.
(3) It shall be unlawful to maintain a fence, hedge or vines in the required front yard
area or an established front yard area, whichever area is greater in depth, of an
interior lot in a manner that does not permit at least 50 percent through vision.
(4) For the purpose of this section, "established front yard area" shall mean an
open, unoccupied space on a lot facing a street and extending across the front of
a lot between the side yard lines and extending from the abutting street to a
principal building or structure. The phrase "required front yard" shall have the
meaning ascribed to it in the Grapevine Zoning Ordinance No. 82-73.

Dear Gary:
As we have discussed, we are willing to withdraw our request for a hearing in front of the City of
Grapevine Building Board of Appeals scheduled for this evening conditional upon the following:
1. We are allowed to constrict the fence as detailed on Enclosure 1 and as shown on Enclosure
2 at a height not to exceed three (3) feet in the "front yard". The front yard is defined as that
area bounded by the Highway 121 service road, and turning west on Western Oaks until
behind a line extending from the front facade of the building to Western Oaks.
2. We are allowed to construct the same fence along the continuation of Western Oaks (ie: the
side yard) until its terminus at our western boundary.
3. The City Staff will support our construction of the fence and provide a building permit with
the above limitations and no additional hearing or public forums will be necessary.
If the above detail of try understanding correctly describes the situation as it now exists, please forward
our formal withdrawal notice to the City immediately along with our thanks for their assistance in this
regard.

session, Monday, November 12, 2001, at 6:15 P.M., in the Council Chambers,
200 South Main Street, Grapevine, Texas with the following members present:

Chairman Joe Lipscomb called the meeting to order at approximately 6:30 P.M.
OATH OF OFFICE
Gerrie Anderson administered the Oath of Office to Members Joe Lipscomb, Art
Gordon, Dennis Roberts, Charles Bloomberg, Russell Kidd, newly appointed
Members John Rath, Jerry Sklar, and 1st Alternate Michael Shupp.
ELECTION OF OFFICERS
For office of Chairman, Art Gordon re -nominated Joe Lipscomb. Russell Kidd
seconded the motion which prevailed by the following vote:
Ayes: Gordon, Roberts, Bloomberg, Kidd, Rath, Sklar
Nays: None
Abstain: Lipscomb
Absent: None

nominations. Russell Kidd seconded the motion which prevailed by the following

PROCEDURE
Next the Board considered the proposed Rules of Procedure.

Mr. Williams discussed some of the items of the Rules of Procedure, such as
Failure of Applicant to Appear, Notices of Hearings, and Decisions.
Mr. Williams presented the following amendments to be incorporated in the
proposed Rules of Procedure:
Addition of a new Section 6 under Article I: All references to the Building Official
shall mean the Assistant Director of Development Services/Building Official or his
designated representative.
Amendment to Section 1, Article V: An appeal from a decision of the Assistant
Director of Development Service/ Building Official or his designated
representative 9F aRy etheF administFativeOffiGe of the City may be taken by any
person aggrieved, officer, department, board, or bureau of the City affected by
the decision.
Deletion of Section 9 under Article V.
Amendment to Section 2, Article XI: The proposed amendment must be
presented in writing at a regular or special meeting at
which the vote is taken.
After discussion, Dennis Roberts made a motion to adopt the proposed Rules of
Procedure with amendments. Art Gordon seconded the motion which prevailed
by the following vote:

Lipscomb, Gordon, Bloomberg, Roberts, Kidd, Rath, Sklar

The next item was for the Building Board of Appeals to consider Building Board
of Appeals Case BBA01-10, submitted by Cirrus — Grapevine III, L.P., for
property located at 3400 William D. Tate Avenue, and platted as Lot 1, Block 1,
Grapevine III Addition. The following request was to Grapevine Code of
Ordinances, Chapter 7, Article IV:
Section 7-127, Fences, Front Yard Requirements, prohibits fences in the
required or established front yard, whichever is greater, exceeding 36" in height.
The applicant requested a five foot tall steel fence with six foot tall columns within
the required and established front yard adjacent to the State Highway 121

Mr. Williams explained that Staff recommended the Board accept the applicant's
letter of withdrawal of the case. He explained that the applicant reconsidered,
and would construct a required three foot tall fence in the required front yard
setback instead of a five foot tall fence.
Charles Bloomberg made a motion to accept the applicant's request to withdraw
case BBA01-10. Dennis Roberts seconded the motion which prevailed by the
following vote:
Ayes: Lipscomb, Gordon, Roberts, Bloomberg, Kidd, Rath, Sklar
Nays: None
Absent: None
BUILDING BOARD OF APPEALS TO CONSIDER ADOPTION OF THE 2000
INTERNATIONAL RESIDENTIAL CODE AND ITS AMENDMENTS
Mr. Williams recommended that this item be withdrawn. He explained that he
was still working with the City Attorney due to the complexity of the ordinance.
John Rath made a motion to accept Staffs recommendation to withdraw the
case. Jerry Sklar seconded the motion which prevailed by the following vote:
Ayes: Lipscomb, Gordon, Roberts, Bloomberg, Kidd, Rath, Sklar
Nays: None
Absent: None
BRIEFING REGARDING STATE MANDATED ENERGY CONSERVATION AND
ASBESTOS ABATEMENT
Mr. Williams explained that the 77th Legislature passed two laws. He explained
that the first one required all new buildings and additions had to comply with the
State Energy Code. He explained that residential buildings would be under the
Energy Chapter of the International Residential Code, and commercial structures
would be under the International Energy Conservation Code. He explained that
the second law required all public buildings have an asbestos survey if any
additions or alterations were being made.
BRIEFING ON RECENT CHANGES TO PERMIT FEES
Mr. Williams explained that in July the City Council adopted to increase the
building permit fees. He explained that the fees doubled across the board but
still did not put Grapevine above other cities. He also explained that the
electrical, plumbing and mechanical permit fees were all on one application form.
He noted that all fees would be calculated by valuation of work or square
footage.

STAFF REPORTS
Mr. Williams informed the Board that Frank Parra Dodge had opened, Neiman
Marcus was on schedule and would open the first of the year, and a Certificate of
Occupancy was issued to China Garden.
Mr. Williams also noted that construction of the structure on the Opryland project
had not slowed down and the developers were very committed to the project. He
explained that there was a six to nine month delay on the project.
MINUTES
Next the Building Board of Appeals considered the minutes of the May 14, 2001,
meeting.
Charles Bloomberg made a motion to approve the minutes, of the May 14, 2001,
meeting. Art Gordon seconded the motion, which prevailed by the following vote:
Ayes: Lipscomb, Gordon, Roberts, Bloomberg, Kidd, Rath, Sklar
Nays: None
Absent: None
ADJOURNMENT
With no further discussion, Art Gordon made a motion to adjourn. Russell Kidd
seconded the motion, which prevailed by the following vote:

As we discussed earlier this afternoon, we are withdrawing our request to the Building Board of Appeals
for reasons expressed on the attached memo form Bill Hutchison of The Cirrus Group, the Applicant.
Per my understanding of our conversation, we are allowed to build a 3 foot high fence within the
required or established front yard, which ever is greater. The drawings which were attached to
the Building Board of Appeals application shows our intent which is acceptable in all regards
with the exception to the fence height in the front yard.
If any of the above is incorrect please let me know at your earliest convenience.
