(AM25-03A) BACKGROUND: The City established the Transit District Overlay, “Overlay”, to guide development around designated transit hubs. The goal is to create compact, walkable, mixed-use environments that encourage transit ridership. Since its adoption, the Overlay has served as a planning tool to concentrate higher-density residential, retail, and employment uses within a quarter mile of transit facilities. Its purpose is to align land use and urban design standards with the community’s long-term vision for transit-oriented growth. ISSUES: The Planning and Zoning Commission proposes amendments to the boundaries of the Overlay. They recommend removing several areas from the Transit District based on their examination. These three areas are grouped and summarized below: 1. 1109 Airline Drive is a private parking lot, zoned “PO”, Professional Office District, located between residential properties and near two single-family homes. Developed in 1980 for Texas Power & Light (TP&L) to store trucks and equipment, it currently serves professional offices at 1101 South Main Street and is being used for private parking. A separate request for a public hearing on a city-initiated rezone of the property exists, Z25-06 which was tabled for consideration for the December 16 joint meeting date. 2. 113 and 131 East Hudgins Street are zoned “LI,” Light Industrial District, while 351 East Hudgins Street is zoned “CC,” Community Commercial District. These properties, located on the north side of East Hudgins Street, contain warehouse buildings, public storage facilities, and an office building and fall within the Transit District Overlay. However, their current development patterns do not align with the Overlay's goals. The Commission aims to prioritize properties with greater potential for redevelopment into transit-supportive uses. 3. The following properties are recommended for removal as “future”: 827 Dawn Lane, 849 East Dallas Road, lots 1-215, Sunshine Harbor subdivision, 1060 Texan Trail, 1084 Texan Trail, 1090 Texan Trail, 1098 Texan Trail, and 1039 East Dallas AM25-03A.4 2 Road. These heavy commercial, industrial properties, and the 215-lot residential subdivision fall outside the 1/4-mile walking distance from the transit hub and do not support the Overlay's goal of promoting compact, pedestrian-friendly development. Their inclusion misrepresents the city’s redevelopment plans. Removing certain properties from the Overlay will: 1. Align boundaries with the transit hub’s walkable area. 2. Focus incentives on properties suited for transit-oriented development. 3. Clarify land use expectations for property owners and the public. Excluding commercial, industrial, and residential properties outside the ¼-mile walkable distance or that host low-intensity uses is important to maintaining the Overlay's purpose. ADDITION Lot 38 0.18 ORDINANCE NO. 2025-081 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF GRAPEVINE, TEXAS, SAME BEING ALSO KNOWN AS APPENDIX “D” OF THE CITY CODE OF GRAPEVINE, TEXAS, AMENDING SECTION 41.B., TRANSIT DISTRICT OVERLAY OF THE ZONING ORDINANCE FOR THE PURPOSE OF AMENDING THE BOUNDARIES OF THE OVERLAY, (AM25-03A); REPEALING CONFLICTING ORDINANCES; PROVIDING A PENALTY; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE WHEREAS, the City Council of the City of Grapevine created Section 41.B., Transit District Overlay of the Zoning Ordinance with adoption of Ordinance No. 2019- 008 on February 19, 2019; and WHEREAS, the City of Grapevine adopted the Transit District Overlay to encourage compact, mixed-use, and pedestrian-oriented development patterns that support the use of public transit; and WHEREAS, the intent of the Transit District Overlay is to concentrate higher- intensity development within a comfortable walking distance of existing and planned transit facilities; and WHEREAS, the Planning and Zoning Commission has reviewed the existing Transit District Overlay boundaries and identified certain properties that are located beyond one-quarter (¼) mile walking distance from a transit station or stop; and WHEREAS, the Planning and Zoning Commission has further determined that some properties within the existing boundary are characterized by low-intensity or non- transit-supportive uses that do not advance the purpose or goals of the overlay; and WHEREAS, the City Council finds it appropriate and consistent with the Comprehensive Master Plan to amend the Transit District Overlay boundaries to exclude properties that are not within the defined walkable area or that are of insufficient development intensity; and WHEREAS, proper notice of the proposed amendment has been given in accordance with state law, and a public hearing was conducted jointly by the Planning and Zoning Commission and City Council; and Ordinance No. 2025-081 2 AM25-03A WHEREAS, the City Council, after due consideration of the recommendation of the Planning and Zoning Commission, the staff report, and all public testimony, finds that the proposed amendment promotes orderly development and is in the best interest of the City of Grapevine; and WHEREAS, the City of Grapevine is a home-rule municipality authorized to adopt and enforce ordinances necessary to protect health, life, and property to preserve good government and the security of its inhabitants; and WHEREAS, the City desires to implement those rules and regulations that protect health, life, and property and that preserve good government, order, and security of the City and its inhabitants; and WHEREAS, all statutory and constitutional requirements for the passage of this ordinance have been adhered to, including but not limited to the Open Meetings Act and Chapter 211 of the Local Government Code. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated hereinabove are found to be true and correct and are incorporated herein by reference as if copied in their entirety. Section 2. That Subsection 2, Boundaries of Section 41.B., Transit District Overlay of the Zoning Ordinance – "Figure 1: Grapevine Transit District.”, is hereby repealed and replaced in its entirety, as follows: See attached Exhibit “A”. Section 3. That Appendix “A”, Transit District Boundaries of Section 41.B., Transit District Overlay of the Zoning Ordinance – “Transit District.”, is hereby, repealed and replaced in its entirety, as follows: See attached Exhibit “A”. Section 4. That Subsection 4, Intensity Sub-Districts and Uses of Section 41.B., Transit District Overlay of the Zoning Ordinance – "Figure 2: Intensity Sub-Districts.”, is hereby repealed and replaced in its entirety, as follows: See attached Exhibit “B”. Section 5. That Appendix “B”, Intensity Sub Districts of Section 41.B., Transit District Overlay of the Zoning Ordinance – “Intensity Sub-Districts.”, is hereby, repealed and replaced in its entirety, as follows: See attached Exhibit “B”. Section 6. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall stay in full force and effect. Ordinance No. 2025-081 3 AM25-03A Section 7. The fact that the present ordinances and regulations of the City of Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, peace, and general welfare of the public creates an emergency which requires that this ordinance become effective from and after the date of its passage, and it is accordingly so ordained. Section 8. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Thousand Dollars ($2,000.00) for each offense. Each day on which a reported violation is committed will be deemed a separate offense. Section 9. All ordinances or any parts thereof in conflict with the terms of this ordinance shall be and hereby are deemed repealed and of no force or effect.
